Robinson Subject: RE: Request for Opinions regarding CPA eligibility/ Fall TM projects Hello Faythe, I can send you a fuller opinion, if you’d like, but, briefly, it is my opinion that Projects 2 and 3 are eligible for CPA funds. The Harwich Cemetery Commission seeks CPA monies in the amount of $23,000 to contribute towards the cost of installing a granite memorial in the Evergreen Cemetery in Harwich that will list the names of Harwich and Brewster residents that fought in the Revolution (the “Project”). As you are aware, CPA funds may be used to acquire, preserve, and/or rehabilitate “historic resources”, which term is defined in the CPA as “a building, structure, vessel real property, document or artifact that is listed on the state register of historic places or has been determined by the local historic preservation commission to be significant in the history, archeology, architecture or culture of a city or town.” Implicit in the definition of a historic resource is that the resource is already in existence and has been in existence long enough to be considered significant in the history, archeology, architecture or culture of Brewster. A new memorial, while worthwhile in recognizing the significant contributions of those who fought in the Revolutionary War, is not the kind of historic resource that is contemplated in the CPA, in my opinion. That being said, I note that the memorial will be installed in the Evergreen Cemetery, which itself is of historical significance and could be considered to be a historic resource. In my opinion, it would not be unreasonable for the CPC to recommend funding for the Project if the CPC determines that the memorial makes the historic Cemetery functional for its intended purpose, perhaps in leading to a greater appreciation of the individuals buried in the Cemetery and/ or of the historical significance of the contributions made by such individuals, among other factors. This is to request legal opinions regarding CPA eligibility for three funding applications submitted to Brewster CPC for Fall Town Meeting. 1.Harwich Revolutionary Memorial – This request for Historic Preservation funds is from the Town of Harwich. They are seeking a funding contribution for a Revolutionary War Memorial to be installed in East Harwich listing names of Harwich residents who served in that war. The Town of Brewster was incorporated after that war in 1803. At the time of the Revolutionary War, what is now Brewster was the North Parish of Harwich. 2.Brewster Affordable Buydown Program – This application from the Brewster Affordable Housing Trust is seeking Community Housing Funds to replenish Brewster’s Affordable Buydown Program. 3.0 Millstone Road – this is a request for Community Housing Funds from Housing Assistance Corporation/Preservation of Affordable Housing for $500,000 to develop 45 affordable housing units in Brewster. Regards, Denise From: Stuart Saginor Sent: Monday, July 31, 2023 4:59 PM To: faythe.ellis@outlook.com Subject: CPA Funding Dropped from FY24 State Budget Legislature Drops CPA Funding from FY24 State Budget On Sunday evening, the FY24 State Budget was released from Conference Committee, whose members were charged with reconciling the differences between the House and Senate versions of the budget. And while we were optimistic after the Senate's proposal for the budget included language allocating $30M in surplus funding for the CPA Trust Fund, unfortunately this language was dropped in the newest version of the state budget. This development is especially disappointing during a year in which revenue for the Trust Fund has dropped by over 33% (primarily due to rising interest rates and declining home sales across the state). Without any additional revenue in the form of surplus dollars, it is likely that the CPA Trust Fund will only be able to support a 20% base match, at most, for CPA municipalities this year. Is There Still Hope for Additional Funding for the CPA Trust Fund this Year? Yes! Rest assured - the Coalition has not given up on this effort. There are still other legislative avenues available, such as a supplemental budget bill that is typically filed each September. And as you may recall, our current circumstances are far from unprecedented. Last year, the CPA surplus language was also dropped from the FY23 state budget after being caught up in a line-item veto from Governor Baker. We later secured a supplemental distribution of $20 million through a separate bill filed in the fall, and we will be considering all similar vehicles in the coming weeks. This news is certainly a setback, but the fight is far from over. We will continue to advocate on behalf of the 195 CPA municipalities to support the CPA Trust Fund - stay tuned for more updates as we work on this issue.
