AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, ESTABLISHING THE
MINIMUM REGULATIONS GOVERNING THE CONDITIONS AND MAINTENANCE OF ALL
PROPERTY, BUILDINGS AND STRUCTURES BY PROVIDING THE STANDARDS FOR
SUPPLIED UTILITIES AND FACILITIES AND OTHER PHYSICAL THINGS AND
CONDITIONS ESSENTIAL TO ENSURE THAT STRUCTURES ARE SAFE, SANITARY
AND FIT FOR OCCUPATION AND USE; AND THE CONDEMNATION OF BUILDINGS
AND STRUCTURES UNFIT FOR HUMAN OCCUPANCY; ESTABLISHING POWERS AND
DUTIES OF THE CODE OFFICIAL AND HIS DESIGNATED HOUSING INSPECTORS)
AND PROVIDING PENALTIES FOR THE VIOLATION THEREOF.
BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
SECTION 1. The BOCA National Existing Structures Code, second
edition, 1987, as published by the Building Officials and Code
Administrators International, Inc. is hereby adopted and
incorporated herein by reference as the Existing Structures Code
of the City of Jefferson, with the additions, insertions, deletions
and changes contained in this ordinance.
SECTION 2_ Definitions.
® a. Wherever the word "municipality" is used in the
Existing Structures Code it shall be held to mean the City of
Jefferson, Missouri.
b. Wherever the job title "code official" is used in the
Existing Structures Code it shall be held to mean the Director
of Planning and Code Enforcement or his designee, the Housing
Inspector(s) .
C. Wherever the term "department" is used in the
Existing Structures Code it shall be held to mean the
Department of Planning and Code Enforcement.
d. Wherever the term "legal representative" is used in
the Existing Structures Code it shall be held to mean City
Counselor for the City of Jefferson, Missouri.
SECTION 3. Duties of the code official and his designated
Housing Inspector(s) .
a. The Existing Structures Code shall be enforced by the
code official or his designee.
b. The code official shall maintain or cause to be
• maintained a written record of all inspections, violations and
the disposition thereof and to prepare therefrom an annual
report containing all proceedings under this code to be
® transmitted to the City Administrator of the City of
Jefferson, Missouri.
SECTION 4. Supplements.
The Existing Structures Code is supplemented as follows:
Every interior wall, ceiling, door and floor or parts thereof
shall be maintained in sound condition and good repair, free of any
holes, cracks, loose plaster or other defects that would provide
access for insects or rodents. All interior surfaces shall be
finished with wall paper, paint, or other accepted materials so as
to be easily cleanable, reasonably smooth, clean and tight. Floors
shall also be reasonably true and level, free of any fixed,
irregular or broken surface material that would create a tripping
hazard.
SSECTION 5. Deletions.
a. Delete Section PM-110.0 in its entirety.
SECTION 6. Penalties.
a. Any person who shall violate any of the provisions
of the code hereby adopted or fail to comply therewith, or who
shall violate or fail to comply with any order made
S thereunder, or who shall build in violation of any detailed
statement of specifications or plans submitted and approved
thereunder, or any certificate or permit issued thereunder,
and from which no appeal has been taken, or who shall fail to
comply with such an order as affirmed or modified by the City
Council or by a court of competent jurisdiction, within the
time fixed herein, shall severally for each and every such
violation and noncompliance respectively, be guilty of a
misdemeanor, punishable by a fine of not less than $25.00 nor
more than $500.00 or by imprisonment for nor more than 180
days or by both such fine and imprisonment. The imposition
of one penalty for any violation shall not excuse the
violation or permit it to continue; and all such persons shall
be required to correct or remedy such violations or defects
within a reasonable time; and when not otherwise specified,
each ten (10) days that prohibited conditions are maintained
shall constitute a separate offense.
b. The application of the above penalty shall not be
held to prevent the enforced removal of prohibited conditions.
SECTION 7. Validity.
The City Council hereby declares that, should any section,
• paragraph, sentence, or word of this ordinance or of the code
hereby adopted be declared for any reason to be invalid, it is the
intent of the City Council that it would have passed all other
S portions of this ordinance independent of the elimination herefrom
of any such portion as may be declared invalid.
SECTION 8. This ordinance shall take effect and be in force
from and after its passage and approval. .
