AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING
ACQUISITION OF CERTAIN PROPERTY FOR USE IN CONJUNCTION WITH THE
SEVEN HILLS ROAD PROJECT INCL17DING THE USE OF THE POWER OF EMINENT
DOMAIN. WHEREAS, THE CITY COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, HAS ADOPTED A PLAN FOR THE ACQUISITION OF CERTAIN
PROPERTIES HEREINAFTER LEGALLY DESCRIBED, FOR STREET AND UTILITY
PURPOSES, AND FOR THE PAYMENT OF THE SAME.
BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI,
AS FOLLOWS:
Section 1. That it is hereby determined that improvements be
made to Seven Hills Road between Greenberry road and Bald Hill
Road, for the purpose of improving safety and convenience of the
public and that said roadway be realigned and constructed in a
manner necessary and convenient for public use.
Section 2. That it is hereby determined that it is necessary
and desirable that the City shall acquire title to and possession
of the following described real property which said real property
® is necessary, required and needed for right of way and utility
easement for Seven Hills Road Project and lying adjacent or within
the limits of the City of Jefferson, to wit:
Part of the Southwest Fractional Quarter of Section 20, Township
44 North, Range 11 West, in the County of Cole, Missouri; being
more particularly described as follows:
BEGINNING at a point on the South Line of Seven Hills Road, said
point being 454.84 feet West of the East Line of the Southwest
Quarter of said Section 20, and also the Northwest corner of a
tract as described in Book 224, Page 30, of the Cole County

Seven Hills Road, 717.07 feet to the Northeast corner of a parcel
as described in Book 299, Page 131, of the Cole County Recorder's

Section 3. That the Director of Public Works and the City
Counselor, be and hereby are authorized, empowered and directed to
negotiate for and in behalf of said City with the owner or owners
of the hereinabove described real property for the purchase thereof
by said City.
Section 4. In the event that the said City is unable to agree
with the owners of said property as to the compensation to be paid
therefor, then title to and possession of said real property
legally described in Section 2 of this Ordinance shall be acquired
by the City through condemnation, and the Director of Public Works

and City Counselor, as representatives for the City are hereby
authorized, empowered and directed to institute proceedings in any
court of competent jurisdiction to acquire title to and possession
of said property and for said City in accordance with the eminent
domain laws of the State of Missouri, and specifically Section
82.240 RSMo and to provide for managing, controlling and policing
the same.
Section 5. The firm of Stockard, Andereck, Hauck, Sharp &
Evans, 101 W. McCarty Street, Jefferson City, Missouri, may be
retained and may be utilized by the City Counselor to assist in the
preparation and presentation of any required court actions related
to acquisition.
Section 6. This Ordinance shall take effect and be in full
force from and after its passage and approval.
