HomeMy Public PortalAboutPC Resolution 2013-05-01 Approval of the Subdivision Exemption Plat for Amended Lot 32, EMF 1 FRASER PLANNING COMMISSION RESOLUTION NO.2013-05-01 A RESOLUTION RECOMMENDING APPROVAL OF THE SUBDIVISION EXEMPTION PLAT FOR AMENDED LOT 32,EMF1,TOWN OF FRASER,GRAND COUNTY,COLORADO At the regular meeting of the Fraser Planning Commission held on May 22,2013,Rainsford A.Brown, III,represented by Kent Whitmer,requested a recommendation of approval for the Subdivision Exemption Plat,Amended Lot 32,East Mountain Filing 1. WHEREAS, Rainsford A.Brown,III,is the owner of Lot 32, EMF1,on which lot there exists a single family home;and WHEREAS, Rainsford A.Brown,III,also presently has Lot 30 EMF1 under contract; WHEREAS,Lot 30 and Lot 32 are contiguous lots and the applicant is requesting to vacate the lot line between Lots 30 and 32 in order to protect his view;and WHEREAS,Staff has determined that the application is in compliance with the subdivision exemption regulations of the Town of Fraser. NOW THEREFORE BE IT RESOLVED that the Fraser Planning Commission has voted to recommend approval of the Subdivision Exemption Plat,Amended Lot 32,with the following conditions to be satisfied prior to review of the application by the Board of Trustees: 1. Show the lot line to be vacated on the second page of the plat. 2. Add a signature block for the HOA to sign off on the plat,in accordance with C.R.S. 3. Provide 911 mylar and electronic copy of the plat in accordance with the Subdivision Regulations. 4. Add the following 4 plat notes: 1. Former Lots 30 and 32 are hereby forever combined to form Amended Lot 32 herein. 2. Amended Lot 32 shall forever be sold,transferred,mortgaged or otherwise encumbered only as a single unit. 3. No portion of Amended Lot 32 shall ever be sold,transferred,mortgaged or otherwise encumbered separately. 4. One single family residence shall be allowed on Amended Lot 32.
