ORDINANCE NO. 112-2-7
AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, RELINQUISHING A
CERTAIN EASEMENT FOR SANITARY SEWER PURPOSES ON PROPERTY AT THE
SOUTHWEST CORNER OF THE INTERSECTION OF MISSOURI BLVD. AND STADIUM
WEST BLVD. IN JEFFERSON CITY, MISSOURI.
WHEREAS, by an easement dated January 4, 1985, and recorded
in Book 284, Page 440, Cole County Recorder's Office, a sewer
easement was granted to the City of Jefferson, a Municipal
Corporation, to excavate within, install, construct, maintain and
repair structures for the routing and conveyance of sewer in, under
and through the lots, tracts or parcels of land described -1n
Section 1;
BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI,
AS FOLLOWS:
Section 1. The Council finds that the following described
easement is surplus property of the City and is no longer needed
for any public purpose:
Part of the southwest quarter of the northwest
quarter of Section 11, Township 44 North, Range 12 West,
in the City of Jefferson, County of Cole, Missouri, more
particularly described as a strip of land 10 feet wide
lying 5 feet each side of and parallel to the following
described centerline:
From the southeast corner of the southwest quarter
of the northwest quarter of said Section 11; thence
northerly along the quarter quarter section line, N 050
31' 59" W, 53.47 feet to the point of beginning of said
centerline; thence leaving said quarter quarter section
line, N 720 45' 06" W, 8.51 feet; thence N 490 35' 11"
W, 154. 53 feet; thence N 800 39 ' 45" W, 142 .70 feet (to
a point to be referred to as Point 10A") ; thence S 840 40 '
10" W, 1017.26 feet; thence S 720 02 ' 13" W, 102.52 feet
to a point on the west line of said Section 11 and the
point of termination.
ALSO, part of the southwest quarter of the northwest
quarter of Section 11, Township 44 North, Range 12 West,
in the City of Jefferson, County of Cole, Missouri, more
particularly described as a strip of land 10 feet wide,
lying 5 feet each side of and parallel to the following

Beginning at the aforementioned Point "All; thence
N 060 21' 42" W, 152.23 feeti thence N 220 05' 22" W,
452.77 feet to the point of termination.
section 2. The easement described in Section 1 is hereby
relinquished, and the City does hereby release and abandon whatever
interest it has in the easement.
Section 3. The Mayor and City Clerk are hereby authorized to
execute any necessary legal document relinquishing all of the
Cityfs interest in the tract of ground described in Section 1.
Section 4. This ordinance shall be in full force and effect
from and after the date of its passage and approval.

ON
THE VACATING OF A SANITARY SEWER EASEMENT
AND A FINAL, PLAT
Re: Request filed by CEI Engineering Associates, Inc. on behalf
of Wal-Mart Stores, Inc. for approval of a final plat of Wal-
Mart Supercenter Development
This plat is for a 48.5 acre commercial development located
at the southwest corner of Missouri Boulevard and Stadium West
Boulevard. It includes one large tract of 39.73 acres (Wal-Mart
Store site) and seven outlots for satellite businesses. The plats
include the requested dedicated street right-of-way at the south
edge of the property plus triangular shaped right-of-way at the
intersection of Missouri and Stadium. This triangular right-of-
way is needed for an additional turn lane.
This plat has been reviewed by the Departments of Public Works
and Planning and Code Enforcement and by the Fire Chief (fire
hydrant locations and sizes of water lines) . The plat meets the
requirements of the Subdivision Regulations and improvement plans
have been submitted. At its meeting of April 13, 1989, the
Planning and Zoning Commission voted to recommend that this plat
be approved.
The sewer easement is on the Wal-Mart site and is no longer
being used. The Department of Public Works recommends the easement
be vacated.
