HomeMy Public PortalAboutORD11230 BILL NO. 89-22 SPONSORED BY COUNCILMAN SCHEULEN ORDINANCE NO. 112- 30 AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, DECLARING CERTAIN FIRE TRUCKS TO BE SURPLUS PROPERTY AND AUTHORIZING THE TRADING OF SAID PROPERTY TO THE UNIVERSITY OF MISSOURI-COLUMBIA FOR TRAINING SESSIONS FOR THE FIRE DEPARTMENT AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE ALL NECESSARY DOCUMENTS PERTAINING HERETO. BE IT ENACTED BY THE COU14CIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. The Council of the City of Jefferson, Missouri, finds that certain property in the custody of the Fire Department and described as follows: 1969 Ford Pumper Truck (fire) , VIN #F70EUE50768 1954 Ford Pumper Truck (fire) , VIN #F80K4H48762 is surplus property, and as such represents a burdensome cost for storage and maintenance, and that the property is no longer needed for any public purpose. Section 2. The above referenced equipment shall be given to 'the University of Missouri-Columbia in exchange for training sessions for the fire department at a value of $9,487.60. Section 3. The Mayor and Clerk are hereby authorized and directed to execute an agreement with the University of Missouri- Columbia for the training sessions for the fire department. Section 4 . The agreement shall be substantially the same in form and content as that agreement attached hereto as Exhibit A. Section 5. This ordinance shall be in full force and effect from and after the date of its passage and approval. Passed ` �-� l 5 /`� �� Approved `7�1 :E - /�� esidi fficer r ,r ATTEST: City Clerk SERVICE AGREEMENT This Agreement made and entered this 5-lck day of 1989, by and between the City of Jefferson, Missouri, a m nicipal corporation, hereinafter referred to as "City, " and The University of Missouri, Fire and Rescue Training Institute, hereinafter referred to as "University". WHEREAS, City has acquired two surplus fire vehicles described as follows: 1969 Ford Pumper Truck (fire) , VIN #F70EUE50768 1954 Ford Pumper Truck (fire) , VIN #F80K4H48762 WHEREAS, University is willing to provide certain services in exchange for said vehicle. NOW, THEREFORE, be it agreed as follow: 1. Training Services. The University hereby agrees to provide the City a five year training services support package which includes the following: a. Remission of Winter Fire School registration fees for up to six individuals per year for five years (1990-1994) . b. Remission of Summer Fire School registration fees for up to six individuals per year for five years (1989-1993) . C. Remission of the usual and customary instructional and administrative fees for three Advanced Vehicle Extrication courses, one per shift, conducted in and for Jefferson City prior to December 31, 1991. Wrecked vehicles utilized for the course will be provided by Jefferson City. d. Remission of the usual and customary instructional and administrative fees for three, 12 hour Handling LP Gas Emergencies, courses, one per shift, conducted in and for Jefferson City, prior to December 31, 1991. Costs for fuel and other consumable supplies will be the responsibility of the Jefferson City Fire Department. e. Remission of the usual and customary instructional and administrative fees for three, 12-15 hour Emergency Response Driving courses, one per shift, conducted in and for Jefferson City prior to December 31, 1991. Vehicles will be provided by the Jefferson City Fire Department. f. Remission of the usual and customary instructional and administrative fees for one, 18 hour Instructional Technic-rues for Comply Officers course for up to 18 members of the Jefferson City Fire Department conducted in and for Jefferson City prior to December 31, 1991. This course will meet the Fire Department Instructor certification requirements of the Missouri Division of Fire Safety. g. Remission of the usual and customary instructional and administrative fees for one, 40 hour Fire Service Instructor I course for up to 15 members of the Jefferson City Fire Department conducted in and for Jefferson City prior to December 31, 1991. This course will meet the Fire Service Instructor I certification requirements of the Missouri Division of Fire Safety. h. Remission of the usual and customary instructional and administrative fees for two, 4 hour National Fire Academy Hazardous Materials Recognition and Identification courses conducted in and for Jefferson City during calendar years 1990 and 1991. This course will meet in part, the requirements for annual hazardous materials training requirements of 29 CFR 1910 and NFPA Standard 472. i. Remission of the usual and customary instructional and administrative fees for one, 12 hour National Fire Academy Hazardous Materials Incident Analysis course conducted in and for Jefferson City in calendar year 1990. This course will meet in part, the requirements for annual hazardous material training requirements of 29 CFR 1910 and NFPA Standard 472. The estimated value of the services to be provided is Nine Thousand Four Hundred Eighty-seven Dollars and Sixty Cents ($9,487.60) . 2 . Transfer of Vehicles. In exchange for the above described training, the City agrees to transfer to the University the vehicles and equipment described herein, free and clear of all encumbrances and conditions: 1969 Ford Pumper Truck (fire) , VIN #F70EUE50768 1954 Ford Pumper Truck (fire) , VIN #F80K4H48762 3 . Request for Courses. The courses offered in this contract must be requested at least ninety (90) days prior to the desired delivery date. 4. Inspection. The vehicles must be roadworthy and meet the applicable Missouri motor vehicle inspection requirements. The City agrees to accept responsibility for the inspections and certifications to accomplish said transfer. • 5. Termination. If for whatever reason the University is not able to provide services as set forth pursuant to this contract, this agreement may be cancelled upon ten (10) days written notice. In the event the agreement is terminated prior to December 31, 1994, University at its option may either return the vehicles received from the City or may reimburse City in an amount equal to the value of the training courses/materials not received by City and University shall retain possession of the vehicles. 6. Notiges. All notices, consents, authorizations, requests and statements hereunder shall be deemed to have been properly given if delivered by hand or mailed by first class United States mail, postage prepaid, if to the owner to 320 E. McCarty, Jefferson City, Missouri, 65101, and if to the University to 228 Lewis Hall, Columbia, Missouri 65211.
