ORDINANCE NO. /Z2
AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, VACATING AND
DISCONTINUING A PORTION OF GARFIELD STREET.
WHEREAS, it has been shown to the City Council of the City of
Jefferson, Missouri, that the owners of land adjacent to and
abutting upon Garfield Street in the City, have petitioned the City
Council to vacate right-of-way; and,
WHEREAS, it has further been shown that it would not
inconvenience the public or the citizens of the City to discontinue
a portion of the right-of-way of Garfield Street, as is described
in Section 1 of this Ordinance; and
WHEREAS, it has further been shown that it would not
inconvenience the public or the citizens of the City to discontinue
such right-of-way for public use as described in Section 1 of this
Ordinance, subject to a reservation in the City of an easement in
that portion vacated for the maintenance, repair, location and
relocation of all sanitary sewer, surface water sewer or public
utility facilities now existing or hereafter to be constructed
within said right-of-way.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF
JEFFERSON, MISSOURI, AS FOLLOWS:
Section 1. The City Council of the City of Jefferson, hereby
declares it necessary, reasonable and proper to discontinue as a
right-of-way a portion of Garfield Street and forever vacate the
following described right-of-way in said City:
A strip of land being part of the Southwest Quarter of the
Northwest Quarter and part of the Southeast Quarter of the
Northwest Quarter, all in Section 16, Township 44 North, Range
11 West, in the City of Jefferson, County of Cole, Missouri;
being more particularly described as follows:
From a point on the North Line of East McCarty Street
(formerly Old U.S. Route 50) , said point also being on the
East Line of Block 28 of Renn Addition to the City of
Jefferson, as per plat of record in Plat Book 2, Page 5, of
the Cole County Recorder's Office, said point being 31.21 feet
South of the Northeast corner of Lot 38 of said Block 28;
thence North 05 degrees 20 minutes West along the East line
of said Block 28, 231.21 feet to the point of beginning for
this description; thence continuing North 05 degrees 20
® minutes West along the East Line of said Block 28 and Block
30 of said Renn Addition to the City of Jefferson, 949.39 feet
to the Southerly Line of Boggs Creek; thence leaving said East
Line on a bearing of said Boggs Creek, 30.44 feet to the
Amok Northwest corner of a parcel as described in Book 212, Page
149, of the Cole County Recorder's Office; thence leaving the
Southerly Line of said Boggs Creek on a bearing of South 05
degrees 20 minutes East and along the West Lines of the
following parcels as described in Book 212, Page 149; Book
211, Page 329, Book 247, Page 355; and in Book 249, Page 405,
of the Cole County Recorder's Office, 939.05 feet; thence
South 83 degrees 54 minutes West, 28.48 feet to the point of
beginning.
Containing in all, 0.62 acres, more or less.
Section 2. The statutory right of reversion in the owners of
the abutting property is hereby confirmed as is provided by the
laws of the State of Missouri, and the Mayor and the Clerk of the
City are hereby authorized to execute all necessary instruments
required to confirm the reversionary rights of the owners of
property abutting on the area vacated, as described in Section 1
of this Ordinance, in the right-of-way vacated.
Section 3. This Ordinance shall be in full force and effect
from and after its passage and approval.
