AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, VACATING AND
DISCONTINUING THE RIGHT-OF-WAY FOR A PORTION OF A NORTH-SOUTH ALLEY
RUNNING NORTH FROM CAPITOL AVENUE.
WHEREAS, the north-south alley running north from Capitol
Avenue to the east-west twenty (20) foot alley is not utilized by
the general public; and
WHEREAS, it has been shown to the City Council of the City of
Jefferson, Missouri, that the owners of land adjacent to and
abutting portion of east-west twenty (20) foot alley has petitioned
the City Council to vacate right-of-way, more particularly
described as follows:
A private alley, approximately 10 feet in width, running 78
feet 2 inches North from East Capitol Avenue approximately
parallel with Madison Street. The West line of said private
alley being 133 feet 1. 5 inches easterly of the East line of
Madison Street in the South half of Inlot 101. More
particularly described as follows:
Beginning at a point on East Capitol Avenue 133 feet 1.5
inches easterly from the southwesterly corner of Inlot 100,
at the intersection of East Capitol Avenue and Madison
Streets, thence easterly along East Capitol Avenue
approximately 10 feet, thence northerly parallel with Madison
Street 78 feet 2 inches to the point of beginning.
WHEREAS, it has further been shown that it would not
inconvenience the public or the citizens of the City to disclaim
such right-of-way for public use as described in Section 1 of this
Ordinance.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF
JEFFERSON, MISSOURI, AS FOLLOWS:
Section 1. The Council of the City of Jefferson, Missouri,
hereby declares it necessary, reasonable and proper to disclaim as
a right-of-way for a alley and forever vacate the following
described right-of-way:
A private alley, approximately 10 feet in width, running 78
feet 2 inches North from East Capitol Avenue approximately
parallel with Madison Street. The West line of said private
alley being 133 feet 1.5 inches easterly of the East line of
Madison Street in the South half of Inlot 101. More
® particularly described as follows:
Beginning at a point on East Capitol Avenue 133 feet 1.5
inches easterly from the southwesterly corner of Inlot 100,
at the intersection of East Capitol Avenue and Madison
Streets, thence easterly along East Capitol Avenue
approximately 10 feet, thence northerly parallel with Madison
Street 78 feet 2 inches to the point of beginning.
Section 2. The statutory right of reversion in the owners of
the abutting property is hereby confirmed, as is provided by the
laws of the State of Missouri, and the Mayor and the Clerk of the
City are hereby authorized to execute all necessary instruments
required to confirm the reversionary rights of the owners of
property abutting on the area vacated, as described in Section 1
of this ordinance, in the right-of-way vacated.
Section 3. This ordinance shall be in full force and effect
from and after its passage and approval.
