AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT WITH THE HEART OF MISSOURI HUMANE SOCIETY FOR A SPAY/NEUTER PROGRAM. BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section I. The Mayor and Clerk are hereby authorized and directed to execute an agreement with the Heart of Missouri Humane Society for Spay/Neuter Program. Section 2. The agreement shall be substantially the same in form and content as that agreement attached hereto as Exhibit A. Section 3 . This Ordinance shall be in full force and effect from and after the date of its passage and approval. Passed Approved 1 i residi fficer or ATTEST: J City Clerk A G R E E M E N T T REEMENT, made and ente ed into this day of , 19 , by and between the City of Jef f(6rscoi, Missouri, a municipal corporation of the State of Missouri, hereinafter "City", and The Heart of Missouri Humane Society, a non-profit organization of the State of Missouri, hereinafter "Society". WHEREAS, parties of the first and second part are desirous of providing a service which best serves the current and long-range needs of City; and WHEREAS, it is in the mutual interest of both parties to prevent animals from running at large and in reducing the number of incidents related to animals running at large; and WHEREAS, both parties agree that a spay and neuter program will advance the common goals of the parties; NOWo THEREFORE, in consideration of the mutual promises and covenants herein contained, the parties do agree as follows: 1. The City agrees to establish and administer a formal program of requiring all animals adopted from the City of Jefferson Animal Shelter to be spayed or neutered. The program shall be substantially the same as outlined below: a. Upon adoption of any animal from the Jefferson City Animal Shelter, the adopter shall pay a deposit of twenty ($20. 00) dollars. b. Adopters will take the animal to their veterinarian for rabies inoculation and the veterinarian shall bill the City. c. At the appropriate time, the adopter will take the animal to a participating veterinarian for spaying or neutering. The participating veterinarian shall bill the City allowing the following discounts: a) Female dog $10. 00 b) Male dog $ 7.50 C) Female cat $ 7.50 d) Male cat $ 5. 00 2. The Society agrees to contribute to the City sums equal to the amount of the above discounts multiplied by the number of animals spayed or neutered under the program during the period of this agreement. • 3. The City shall bill the Society for contributions as indicated in Section 2. Said billing shall be monthly with an itemized listing by type and sex, a copy of each animal release form and a copy of each veterinarian's monthly invoice. 4. Failure on the part of the Society to pay said bill within thirty (30) days of receipt shall result in an additional charge of five ($5.00) dollars, plus one percent (1%) per month. 5. The City will establish a follow-up control system to monitor the spay/neuter program. The Society will be given the opportunity to assist in the follow-up control system. At the discretion of the City, the program may be discontinued at any time, and all parties involved in the program shall be released from their obligations under the program. 6. The City shall provide to the Society records of all animals received by the Shelter and shall report their disposition. 7. This agreement shall be in full force and effect from July 1, 1989 to December 31, 1989. IN WITNESS WHER OF, the parties ha he eunto set their hands and seals this day of , 3.9�_.
