AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE
MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT WITH THE COLE COUNTY
EMERGENCY MANAGEMENT AGENCY TO PROVIDE SERVICES TO IMPROVE RESPONSE
TO DISASTERS, MAJOR EMERGENCIES, HAZARDOUS MATERIAL INCIDENTS AND
AT COMMUNITY ACTIVITIES IN THE COLE COUNTY, MISSOURI, AREA.
BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI,
AS FOLLOWS:
Section 1. The Mayor and Clerk are hereby authorized and
directed to execute an agreement with the Cole County Emergency
Management Agency to provide services to improve response to
disasters, major emergencies, hazardous material incidents and at
community activities in the Cole County, Missouri, area.
Section 2. The agreement shall be substantially the same in
form and content as that agreement attached hereto as Exhibit A.
Section 3. This Ordinance shall be in full force and effect
from and after the date of its passage and approval.

AGREEMENT
T is Agreement is entered into this day of
1989, between the City of Jefferson and the Cole
C nt Emergency Management Agency, Office of Disaster
Preparedness:
WHEREAS, the Emergency Management Agency (E.M.A. ) is a not-
for-profit agency of the Cole County Government dedicated to the
improvement of disaster preparedness programs within Cole County,
Missouri;
WHEREAS, the Emergency Management Agency will be engaging in
activities and providing services to improve response to disasters,
major emergencies, hazardous material incidents and at community
activities in the Cole County, Missouri area;
WHEREAS, the City of Jefferson is interested in the
enhancement of area-wide capabilities for emergency response to
hazardous materials incidents, floods, tornados, earthquakes and
other related man-made and natural disasters in Cole County,
Missouri, and the City of Jefferson;
WHEREAS, the parties wish to cooperate with each other in the
improvement of hazardous material and other emergency response
situations in Cole County, Missouri, and the City of Jefferson.
NOW, THEREFORE, in consideration of the mutual promises and
obligations herein, it is agreed by the City of Jefferson and the
Cole County Emergency Management Agency (E.M.A. ) , Office of
Disaster Preparedness, with the approval of the Cole County
Commission as follows:
1. The City of Jefferson hereby agrees to be a Participating
Jurisdiction, subject to the rules and regulations of the
Emergency Management Agency. The rules and regulations
of this agreement, which are attached hereto and made a
part of this agreement are subject to change from time
to time.
2. The Emergency Management Agency hereby agrees to make
its services and equipment available to the City of
Jefferson, subject to the rules and regulations of E.M.A.
3 . Either party to this agreement may terminate this
agreement upon ninety (90) days written notice to the
other party.
4. Neither E.M.A. , nor the Cole County Government will be
responsible for any losses, costs, suits, causes of
action, claims or other liability for any personal
injury, property damage or other damages caused by the
® Participating Jurisdiction or its personnel in connection
with the use of E.M.A. services and equipment under this

agreement.
5. The City of Jefferson and County of Cole shall each pay
fifty percent (50%) of the cost of operations of the
E.M.A. above any amounts received from Federal or State
grants.
f:. That the City of Jefferson shall be billed on a quarterly
basis by the Cole County Emergency Management Agency for
the use of services and equipment under this agreement.
7. That the designated persons for the coordination of
efforts will be for the county, the Sheriff of Cole
County and for the city, Chief of Police of the City of
Jefferson.
8. That the employment and supervision of all employees of
the E.M.A. shall be the responsibility of E.M.A. and the
Cole County Commission.
