ORDINANCE NO.
AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING CHAPTER
17, SECTION 149, DISTURBING THE PEACE: GENERALLY, OF THE CODE OF
THE CITY OF JEFFERSON, MISSOURI, BY REPEALING THE CURRENT SECTION
149 AND ENACTING A NEW SECTION IN LIEU THEREOF.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF
JEFFERSON, MISSOURI, AS FOLLOWS:
Section 1. The Code of the City of Jefferson is hereby
amended by repealing Section 17-149, Disturbing the peace:
generally, and enacting a new section in lieu thereof which shall
read as follows:
A. A person commits the offense of peace disturbance if that
person:
1. Unreasonably and knowingly disturbs or alarms
another person or persons by:
a. Loud noise;
ANIk
b. Offense and indecent language which is likely
to produce an immediate violent response from
a reasonable recipient;

C. Threatening to commit a crime against any
person if such threats are communicated in such
a fashion or under such circumstances as would
lead a reasonable person to believe that
criminal activity may be imminent or that a
substantial likelihood of such criminal conduct
exists, and such a threat is likely to produce
an immediate and violent response from a
reasonable recipient; or
d. Fighting; or
e. Creating a noxious and offensive odor.
2. Is in a public place or on private property of
another without consent and purposely causes
inconvenience to another person or persons by
unreasonably and physically obstructing:
a. Vehicular pedestrian traffic, or
b. The free ingress or egress to or from a public
or private place.
B. It shall be unlawful for any person to commit an act of
peace disturbance.
Section Z. It is hereby declared to be the intention of the
City Council that each and every part, portion and subportion of
this Ordinance shall be separate and severable from each and every
other part, portion or subportion hereof and that the City Council
intends to adopt each said part, portion or subportion separately
and independently of any other part, portion or subportion. In the
event that any part of this Ordinance shall be determined to be or
to have been unlawful or unconstitutional, the remaining parts,
portions and subportions shall be and remain in full force and
effect.
Section 3. This Ordinance shall be in full force and effect
from and after the date of its passage and approval.
