ORDINANCE NO.
AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, DECLARING CERTAIN
PROPERTY TO BE SURPLUS, AUTHORIZING ITS CONVEYANCE TO THE MISSOURI
HIGHWAY AND TRANSPORTATION DEPARTMENT IN EXCHANGE FOR REAL ESTATE
NEEDED FOR THE CONSTRUCTION OF A STORM WATER DRAINAGE AND
AUTHORIZING THE EXECUTION OF NECESSARY DOCUMENTS CONNECTED
THEREWITH.
BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI,
AS FOLLOWS:
Section 1. The City of Jefferson, Missouri, finds that a
portion of Washington Park, as described in Attachment "A", is
presently undeveloped open space park land and there are no present
plans for higher level development and that the property is not
essential to the integrity and continuing use of Washington Park,
and that exchanging the property for other land has mutual benefits
to both the City and State.
Section 2. The Mayor and City Clerk are hereby authorized to
convey the property described in Section 1 to the Missouri Highway
and Transportation Department in exchange for the .following real
estate hereinafter described for the purpose of construction of a
storm water drainage project. The property to be acquired is

Book 190, page 518, of the Cole County Recorder's Office,
being situated in the Southeast Quarter of the Northeast
Quarter of Section 24, Township 44 North, Range 12 West, in
the City of Jefferson, County of Cole; Missouri, being more
particularly described as follows:
BEGINNING at the Southeast corner of the Southeast Quarter of
the Northeast Quarter of said Section 24; thence N04 018113 11E
along the East Line of said Section 24, 460.00 feet; thence
leaving the East Line of said Section 24 on a bearing of
S32°15'21"W, 290.00 feet; thence S29 0 23143 11E, 245.00 feet to
the POINT OF BEGINNING.
AND;
A tract of land which is a portion of the tract described in
Book 190, page 518, of the Cole County Recorder's Office,
being situated in the Southeast Quarter of the Northeast
Quarter of Section 24, Township 44 North, Range 12 West, in
the City of Jefferson, County of Cole, Missouri, being more
particularly described as follows:
From the Southeast corner of the Southeast Quarter of the
Northeast Quarter of said Section 24; thence N86 040148 11W along
the South Line of the Southeast Quarter of the Northeast
Quarter of said Section 24, 676.78 feet to the Southeast
corner of a tract as described in Book 158, Page 94, of the
Cole County Recorder's Office, thence NO3°33 '55"E along the
® East Line of said tract, 222.82 feet to the Northeast corner
thereof; thence N86 0 47126 11W along the North Line of said tract
in Book 158, Page 94, 186.95 feet to the POINT OF BEGINNING
for this description; thence continuing N86°47 '26"W along said
North Line, 240. 00 feet; thence leaving said North Line on a
bearing of N10 017126 11W, 70. 00 feet; thence N20 0 42134 11E, 90.00
feet; thence N01 047126 11W, 190.00 feet; thence N30 017126 11W,

Section 3. The City of Jefferson, Missouri, shall also
receive from the State Highway and Transportation Department an
access easement for the real estate described in Section 2. Said
access easement shall be described as follows:
An ingress and egress easement across a part of a tract as
described in Book 190, page 518, of the Cole County Recorder's
Office, said easement being situated in the Southeast Quarter
of the Northeast Quarter of Section 24, Township 44 North,
Range 12 West, in the City of Jefferson, County of Cole,
Missouri; said easement being more particularly described as
follows:

to the left having a radius of 85.00 feet, an arc distance of

Section A. The City of Jefferson, Missouri, shall also
received from the State Highway and Transportation Department a
temporary construction easement for the real estate described in
Section 2. Said construction easement shall be described as
follows:

office, said easement being situated in the Southeast Quarter
of the Northeast Quarter of Section 24, Township 44 North,
Range 12 West, in the City of Jefferson, County of Cole,

BEGINNING at the Southeast corner of the Southeast Quarter of
the Northeast Quarter of said Section 24; thence N86 040148"
along the South Line of the Southeast Quarter of the Northeast
Quarter of said Section 24, 23.77 feet; thence leaving said
South Line on a bearing of N29 023143 11W, 244. 09 feet; thence
N32 015121 11E, 339. 62 feet to the East Line of said Section 24;
thence SO4 018113 11W along the East Line of said Section 24,
42.67 feet; thence leaving the East Line of said Section 24

Section 5. The Missouri Highway and Transportation
Department shall also pay to the City of Jefferson, Missouri, as
consideration an amount of money equal to the difference between
the appraisal value of the property described in Section 1 and
Section 2.
Section 6. The Mayor and City Clerk are hereby authorized to
execute any and all documents necessary to carry out the
transactions herein authorized.
Section 7. This ordinance shall be in full force and effect
from and after its passage and approval.

Description of land located in Washington Park
Part of the E 1/2 of the NE 1/4 of the SW 1/4 of Section 12,
T 44, R 12, in the City of Jefferson, Missouri, described as
follows:
From a concrete monument the center of said Section 12; thence
N 87°02 '13" W, 487.50 feet; thence S 2 026143" W, 24 feet (said
point also the south line of roadway acquired by deed, Book
305, Page 802 Office of the Recorder of Deeds, Cole County
Missouri) the point of beginning of this description; thence
S 2°16'43"W, 628.53 feet to concrete monument; thence S
86°30'13"E, 231.22 feet to concrete monument; thence N
2035'811E, approximately 533.4 feet to a point that intercepts
south line of roadway acquired by deed, Book 305, Page 802
Office of the Recorder of Deeds, Cole County Missouri; thence
westerly along south line of roadway to the point of
beginning.
The westerly and southerly lines of the above described property is
along the boundary of the property conveyed to the City of Jefferson,
Missouri, by deed of record in Book 134 page 379 Cole County Recorder's
Office.
