Section 1. The Mayor and City Clerk are hereby authorized and

Transportation Department for the relocation of utilities in
connection with construction of newt interchange at Highway F'ifty-
r" four and Cedar City Drive. The amount of the contract shall not
exceed $12 ,426. 05.
Section 2. The agreement shall be substantially the same in
Form and content as that agreement attached hereto as Exhibit A.
. Section 3 . This Ordinance shall be in full force and effect
from and after the date of its passage and approval.

a municipal corporation existing under the laws of the State of Missouri ,

called "City" ) , and the STATE OF MISSOURI , acting by and through the MISSOURI
HIGHWAY AND TRANSPORTATION COMMISSION, (hereinafter called "Commission) ,
WITNESSETH, THAT:
WHEREAS, Commission proposes to construct and improve a section of

(6) Upon completion of the work provided for herein, City shall
remove all leftover materials and debris resulting from the work and leave 4
the right-of-way in a neat, workmanlike condition, free of holes , mounds of {'
dirt, or other objectionable material .

At all times when work is being performed by City under such
conditions as will affect traffic on the public highways, City shall t
u display warning signs , barricades, flags , light and/or flares as
circumstances may require and shall employ and use a flagman when required r
for safety of the traveling public , all in accordance with the standards , 5
set forth in the Manual on Uniform Traffic Control Devices (MUTCD).
'. r. (8) The total cost of the work required for the highway construction
is estimated to be $12,426.05. Commission's obligation toward the total
cost of the work under this contract shall be 26.94 percent thereof. It is
agreed upon completion of the work in accordance with said plans and
estimate, that Commission will promptly reimburse City in the amount
,3 of $3 ,348.67 when six copies of a statement are submitted to Commission and the
completion of the work in accordance with the plan has been verified by

(a) City's easements adjacent to the highway right-of-way,

(b) existing outer roads, i',_
(c) any nearby public roads,
(d) truck trails at and along the right-of-way lines.

Access, in emergency situations directly affecting or endangering*
traffic on the highway or public health or safety will be permitted at :t
i• such points as may be necessary to expedite said emergency repairs,
provided immediate notice is given the State Highway Patrol and ,
Commission's District Engineer.

Nothing contained herein shall give City any right of access to or
from the thruways of the highway except as set out above, nor the right to

- cut or otherwise damage the shoulders, paved thruways or medians. .�
Commission will advise City of any future improvement , reconstruction
} or maintenance planned for said highway which will necessitate an adjust-

ment to City's water line facilities. City reserves the right to claim
compensation for such adjustments affecting its waterline facilities which
' were located on private easements beyond the original 80 foot Route W
