AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING CHAPTER
KIV OF THE CODE OF THE CITY OF JEFFERSON MISSOURI BY THE ADDITION
OF A NEW ARTICLE IV ENTITLED CLEAN AIR IN PUBLIC PLACES, REGULATING
SMOKING IN CERTAIN AREAS OPEN TO THE PUBLIC AND CERTAIN WORK
PLACES ; REQUIRING POSTING OF NO SMOKING SIGNS; PROVIDING FOR
ENFORCEMENT AND ESTABLISHING PENALTIES FOR VIOLATIONS; AND , � ';';,?i„'"•`
PROVIDING FOR AN EFFECTIVE DATE NINETY DAYS AFTER PASSAGE AND FOR
A VIOLATION AND PENALTY EFFECTIVE DATE SIX MONTHS AFTER PASSAGE.
WHEREAS, The Council of the City of Jefferson, Missouri, hereby
finds that the effect of smoke generated by smoking of cigarettes, ;rd',,'•' r
cigars, pipes, and similar articles poses a danger to the health,
safety and well-being of persons who do not smoke; and
WHEREAS, The Council of the City of Jefferson City, Missouri,
hereby further finds that the Surgeon General 's 1984 and 1986
reports on smoking hazards links higher levels of involuntary smoke
exposure to reduced breathing ability in passive smokers and other
?: health dangers, and therefore further buttresses the need to
provide protection to nonsmokers in p°zblic settings;
BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI,
AS FOLLOWS:
Section 1 . Chapter 14 of the Code of the City of Jefferson,
Missouri, is hereby amended by the addition of Article IV, Clean
Air in Public Places, which shall read as follows:
Sec. 14-40. Declaration of Policy.
It is the intent and purpose of this ordinance to

restrictions on smoking within the City of Jefferson.
Sec. 14-41. Exemptions. 4fitir � r:
The restrictions of this Article shall not apply to any of the
following:
(a) Areas which are specifically designated as smoking ` [°

ordinance or by regulations of another agency jurisdiction.

Sec. 14-43. Designation of smoking areas.
(a) When not otherwise provided by law, limited smoking
permitted areas may be designated by the proprietors or person in
charge of the places listed in the ordinance and any owner or
person in charge of an establishment may designate the facility as
a non-smoking area in its entirety.
(b) Where smoking permitted areas are designated, existing
physical barriers and functioning ventilation systems may be used
to minimize the effects of smoke in adjacent non-smoking areas.
This provision shall not be construed to require fixed structural
or other physical modifications in providing these areas or to
require operation of any existing heating, ventilating and air
conditioning system in any manner which decreases its energy
efficiency and/or increases its electrical demand, nor shall this
provision be construed to require installation of new or additional :•
heating, ventilating or air conditioning systems.
Sec. 14-44. Posting of signs. {;
The owner, operator, manager managerl proprietor or other person
having control of a place governed by this Ordinance shall
` prominently and conspicuously post were applicable and at major ` ;.
entrances "SMOKING IS PROHIBITED EXCEPT IN DESIGNATED AREAS" or
the international "NO SMOKING" symbol consisting of a pictorial ;.Y*;i x;
representation of a burning cigarette enclosed in a red circle with
a bar across it in every place where smoking is regulated by this
Ordinance. Such signs shall be protected from tampering, damage, ..;;ef... 4
removal or concealment.
Sec. 14-45. Inspection and Enforcement.

by it and shall guide owners, operators and managers in their
compliance. � r '
b The owner, operator, manager, or person in charge of the
facility shall enforce this article by requesting compliance ` : '}
verbally or prohibiting employees from smoking except in designated
areas, post appropriate signs, provide appropriate smoke-free
areas, and permit the Director of the Planning and Code Enforcement { r
Department entrance to the facility to determine compliance with
this Article`

Sec. 14-42. Regulation of smoking.
No person shall smoke or carry a lighted cigar, cigarette,
pipe or any other form of smoking object or device in the following
places unless they are in designated smoking areas as provided in
Section 14-41.

Enforcement Department shall be authorized to serve official
notices of violations of this Article.
Sea. 14-46. Venalty.

Every person convicted of a violation of any section of this
Article shall be punished by a fine of not less than twenty-five
' dollars ($25.00) nor more than fifty dollars ($50. 00) .
Section 2 . This Ordinance shall be in full force and effect '
from and after ninety.` y (90) days after the date of its passage and
approval and provided that no penalty shall be assessed under this
ordinance until one hundred eighty -a`
