MAYOR AND CITY CLERK TO EXECUTE A CONTRACT WITH THE COLE COUNTY
GROUP HOMES BOARD FOR THE DEVELOPMENTALLY DISABLED FOR WHEELCHAIR

' . BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS;
Section 1. The Mayor and Clerk are hereby authorized and
f directed to execute a contract with the Cole County Group Homes
Board for the Developmentally Disabled for wheelchair lift-
' equipped bus service.

Section 2_ The written lease shall be substantially the

same in form and content as that contract attached hereto as
"r Exhibit "A. "
`= Section 3. This Ordinance shall be in full force and

hereinafter called the "Board". _}
WITNESSETH:
WHEREAS
, the Board has requested the city to extend its Handi- {
Wheels service hours.
NOW, THEREFORE, the Parties to this contract agree to the
following: t�.

Service, The city agrees to provide, one wheelchair ,
lift-equipped bus and driver to transport individuals having an
approved Handi-Wheels application on file with the City, between ?`
the hours of 5: 30 p.m. and 8: 00 p.m. , Monday through h .n

holidays) when regular route transit system services are provided. }

2. Routes and Schedules. Routing and scheduling shall by

3 . Fare. The fare for this service will be $1.00 per trip

with the City,
' y, and an additional $1. 00 per trip when an attendant

is necessary.
r .. 4. _Payment. The Board agrees to pay twenty-five percent
(25%) of the "City Cost,,. Said cost will be calculated at the

rate of $20. 00 per hour service is provided. The city will bill
the Board and Board agrees to pay the City on a monthly basis. The
total amount of this contract shall not exceed Fifteen Hundred
Dollars ($1,500. 00) .
5. Term. The term of this contract will be for the period
December 4, 1989 through June 1. .1990.
6. Termination. This contract may be terminated by either
party by giving ten (10)�? ( ) da s Y written notice.
SSS 7. Liability. In no event shall the Cole County Group Homes
Board for the Developmentally Disabled, be liable to the City, or
any person, partnership, corporation, or other entity for special,

indirect, or consequential damages, except those caused by Cole

?' negligence, or arising out of or in any way connected with a breach

:1 8. Indemnity. The City shall defend, indemnify, and hold the
Cole County Group Homes Board for the Developmentally Disabled
harmless from and against all claims, losses, and liabilities
f` arising out of personal injuries, including death, and damage to
property which are caused by the City arising out of or in any way
connected with this agreement. City further agrees to defend,
indemnify, and hold the Cole County Group Homes Board for the
Developmentally Disabled, harmless from and against any claims,
losses and liabilities arising out of this agreement.
