AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING
ACQUISITION OF CERTAIN PROPERTY FOR USE IN CONJUNCTION WITH THE
kr. OBTAINING OF AVIGATION EASEMENTS AND PROPERTY FOR PURPOSES OF
RIGHT-OF-WAY AND IMPROVEMENTS TO THE JEFFERSON CITY MEMORIAL
AIRPORT, INCLUDING THE USE Or THE POWER OF EMINENT DOMAIN.
WHEREAS, The City Council of the City of Jefferson, Missouri, ,Yk`J`'
has adopted a plan for the acquisition of certain properties
hereinafter legally described, for avigation easement purposes for aa`
improvements to the Jefferson City Memorial airport, and for the
payment for the same.
k NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF

JEFFERSON, MISSOURI, AS FOLLOWS:
Section 1. That it is hereby determined that improvements be
made to the Jefferson City Memorial Airport for the purpose of
improving safety and convenience of the public in a manner
necessary nd convenient for
y public use.
Section 2 . That it is hereby determined that it is necessaryT
and desirable that the City Council shall acquire title to and
P ossession of the following described real
property which said real
property is necessary, required and needed for right of way and °
avigation easement for the Jefferson City Memorial Airport and ,rtc .
lying wholly within the limits of the City of Jefferson in the
County of Callaway
y to wit.
Commencing at the northwest corner of said New Madrid Survey ° l ; ;
#2638, said point also being the corner common to section 9, r
10, 15 and 16; thence South 04 degrees 28 minutes 07 seconds
y. East, along the west line of Section 15, 862 . 0 feet; thence
North 84 degrees 16 minutes 53 seconds East, 1941.7 feet to
` a southwest corner of the above mentioned tract in Book 267,
FF, Page 543, and the point of "Beginning", thence North 84
degrees 14 minutes 52 seconds East, along the south line of
said tract, 928.76 feet; thence North 64 degrees 14 minutes <:r
00 seconds West, along a line which runs parallel with and 750
feet from the center line of Runway 12-30, 1562.22 feet to the
west line of said tract; thence South 04 degrees 28 minutes
f 07 seconds East, parallel with the west line of Section 15,
and along the west line of said tract, 452.38 feet to a
southwest corner thereof; thence South 50 degrees 20 minutes
07 seconds East, along the southerly line of said tract, `
550. 88 feet to the point of "Beginning", containing 10.89
acres subject to all easements and restrictions of record.

section 3. That the Director of Transportation and the City
Counselor, be and hereby are authorized, empowered and directed
to negotiate for and in behalf of said City Council with the owner
x or owners of the hereinabove described real property for the
purchase thereof by said City.
Ssection 4 o In the event that the said City is unable to agree
with the owners of said property as to the compensation to be paid
therefor, then title to and possession of said real property
legally described in c ion 2. of this Ordinance shall be acquired
by the City Council through condemnation, and the Director of
" Transportation and City Counselor, as representatives for the City
Council, are hereby authorized, empowered and directed to institute

proceedings in any court of competent jurisdiction to acquire title
' to and possession of said property and for said City in accordance
with . the eminent domain laws of the State of Missouri, and
specifically Section 82.240 RSMo and to provide for managing,
controlling and policing the same.
Section 5, This Ordinance shall take effect and be in full
force from and after its passage.
