AS FOLLOWS:
Section 1. The Mayor and City Clerk are hereby authorized and
directed to execute an agreement with Office of Administration for
the State of Missouri for a park and ride contract.
Section 2. The agreement shall be substantially the same in

form and content as that agreement attached hereto as Exhibit A. j
Section 3. This Ordinance shall be in full force and effect
from and after the date of its passage and approval.

Jefferson Missouri, a municipal corporation, hereinafter called

the "City. "
WITNESSETH:
tia WHEREAS, the State has requested the City to provide park and
ride bus service to and from the Capital Mall parking lot and the
Jefferson City Capital complex;
NOW, THEREFORE, the Parties to this contract agree to the r
following: ~
1. Service. The City agrees to provide Park and Ride Bus
Service" to and from the Capital complex from a designated area at } a ';•,
the Capital Mall parking lot. Said services shall be rendered in
'. the morning and in the evening.
2 . Routes and Schedules. Routing and scheduling details exact
pickup locations and times will be established by written agreement
between representatives of the State and the Director of

3 Payment. The State agrees to pay the City the rate of Twenty- .z
one Dollars and Sixty Cents ($21. 60) per service hour. The City F,

shall be paid within thirty (30) days after the billing date.
4. 'term. The term of this contract will be for the period
January 29 . 1990 through May 31, 1990.

;' 5. Termination. This contract may be terminated by either
party by giving thirty (30) days' written notice.

h 6. Indemnity. The parties mutually agree to the following:
°a The parties herein shall assume any liability for all damages
or claims for damages which are the result of each party's
r negligence and which are attributable to said party. The City
does not assume or accept any liability or responsibility for
arty negligent u,.t.. or admissions of the State or the State's `

employees and agents. The State does not assume or accept any a�
' f liability or responsibility for any negligent acts or
admissions of the City or the City's employees and agents.
7. Third Party Rights. This contract is designed to establish
=, the rights, duties and obligations of the signatories hereto and
shall not give rise to any third party beneficiary rights.
