ORDINANCE
AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING
ACQUISITION OF CERTAIN PROPERTY FOR USE IN CONJUNCTION WITH THE
OBTAINING OF PROPERTY FOR PURPOSES OF IMPROVEMENTS TO WASHINGTON °`
PARK, INCLUDING THE USE OF THE POWER OF EMINENT DOMAIN.

WHEREAS, The Parks & Recreation Commission, through the
Council of the City of Jefferson, Missouri, is desirous of
acquiring certain property for improvements to and expansion of z
Washington Park and desirous of paying for the same.

c NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OFD , <rT,;.:
JEFFERSON MISSOURI AS FOLLOWS:
Section 1. That it is hereby determined that improvements to
and expansion of the Washington Park be made for the purpose of �`; 7 ;,
F- improving safety and convenience of the public in a manner :F>?w `, ,,;r•.,,'.,.
necessary and convenient for public use.
Section 2 . That it is hereby determined that it is necessary
and desirable that the City Council shall acquire title to and
possession of the following described real property which said real }' ytla
` property is necessary, required and needed for said improvements � 1
and lying wholly within the limits of the City of Jefferson, in the a
County of Cole to wit:

Parts of lots #12 , #13, and #14 of Washington Park addition, sj
City of Jefferson, Missouri, beginning at the southeast corner ;,,;';
lot #12, west 2.00 feet; thence north 60 feet; thence northeast :3
210 feet; thence south 130 feet to the point of beginning. a`
Section 3 . That the Director of the Parks & Recreation
Commission and the City Counselor, be and hereby are authorized,
empowered and directed to negotiate for and in behalf of said City
Council with the owner or owners of the hereinabove described real T
t property for the purchase thereof by said City.

Section 4 . In the event that the said City is unable to agree RA
with the owners of said property as to the compensation to be paid
therefor, then title to and possession of said real property
legally described in Section 2 . of this Ordinance shall be acquired
by the City Council through condemnation, and the Director of the {`
Parks & Recreation Commission and City Counselor, as
representatives for the City Council, are hereby authorized,
empowered and directed to institute proceedings in any court of
i competent jurisdiction to acquire title to and possession of said
property and for said City in accordance with the eminent domain
` laws of the State of Missouri, and specifically Section 82.240 RSMo
and to provide for managing, controlling and policing the same.
