AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, VACATING AND : ` "'`
DISCONTINUING A PORTION OF A PUBLIC ALLEY.
WHEREAS, it has been shown to the Council of the City of

that the owner of land adjacent to and

abutting upon the east/west alley between Bolivar and Harrison .a;
south of West McCarty Street in the City, has petitioned then ::"' ?t•,k
Council to vacate right-of-way as a public alley; andsll

WHEREAS it has further been shown that it would not
inconvenience the public or the citizens of the City to discontinue
as a right-of-way for a public alley such alley as described in
Section 1 of this Ordinance, subject to a reservation in the City
of an easement in that portion vacated for the maintenance, repair,
location and relocation of all sanitary sewer, surface water sewer t -}
or public utility facilities now existing or hereafter to be `;,.-`,<}'' '
constructed within said right-of-way:
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF ':;_ �( vs

Section 1. The Council of the City of Jefferson Missouri �r Sul
hereby declares it necessary, reasonable and proper to discontinue r
as a right-of-way fora public alley and forever vacate the
.F following described alley in said City, subject to the reservation
.: in the City of an easement mentioned in Section 2 of thisr?`� ,`

r Part of a 20 ft. east-west alley lying south of and ;
immediately adjacent to Inlot No. 542 and the westerly `,
to part of Inlot 543 and northerly of and immediately
adjacent to Inlot No. 546 and the westerly portion of
Inlot No. 547, in the City of Jefferson, Missouri, more
particularly described as follows: -;
Beginning at the southwesterly corner of said Inlot No.
542; thence easterly along the southerly line of Inlots
. Nos. 542 and 543, 157.55 feet; thence southerly parallel a
with Bolivar Street, 20 feet, to the northerly line of
said Inlot No. 547 ; thence westerly along the northerly
lines of Inlots Nos. 547 and 546 to the northwesterly 3
corner of said Inlot No. 546; thence northerly along the ,;•
easterly line of Bolivar Street to the beginning point '
of this description.
Section 2 . All of that portion of the above vacated property
is hereby retained as a perpetual easement of right-of-way for the
construction, maintenance, repair, relocation and operation of
sanitary sewers, surface water drainage, and all public utility
f� facilities, and no permanent buildings or structures shall be
located within or upon said easement without the prior written

Section 3 . The statutory right of reversion in the owners of
the abutting property is hereby confirmed, subject to the easement

expressly reserved in Section 2 of this Ordinance, as is provided
by the "laws of the State of Missouri, and upon the request of any
of said owners, the Mayor and the Clerk of the City are hereby
authorized to execute all necessary instruments required to confirm
r the reversionary rights of any requesting owner abutting on the
area vacated, as described in Section 1 of this ordinance, in the
right-of-way vacated.
Section 4 . This ordinance shall be in full force and effect
from and after the date of its passage and approval.
