The Mayor and City Clerk are hereby authorized and directed to execute an agreement with C & C Lawn Care for cemetery maintenance in Fairview and Woodland Cemeteries. The amount of the contract shall not exceed $5, 635.80. ' Section 2 . The agreement shall be substantially the same in form and content as that agreement attached hereto as Exhibit A. <s Section 3 . H . 19QV, by and between the City of Jefferson, Missouri, _X mu cipal corporation, hereinafter referred to as ,City, " and C&C Lawn Care, hereinafter referred to as ,Contractor. " s WHEREAS, City is desirous of obtaining maintenance services z for specified cemeteries; and WHEREAS, Contractor is willing to enter into this Agreement �,.t ., . with respect to his employment and services upon the terms and conditions herein set forth, # ` NOW, THEREFORE, be it agreed as follows: ` ' Scope of Services. The scope of services for cemetery maintenance shall consist of the following: 1. Mow the grass and vegetation as often as needed to keep , ,; . .: k vegetation less than four (4) inches in height. �fti.. s" 2 . Trim grass and vegetation on both sides of the cemetery wall .`tt and maintain the wall free from the entanglement of vines and other vegetation. fir, 3 . Trim grass and vegetation around all grave markers, , headstones, and other appurtenances of the cemetery. ri? c 4 . Trim and care for shrubbery. 5. Maintain all areas free of litter and unsightly debris. Remove leaves from cemetery grounds as needed. 6. Maintain headstones and section markers in proper alignment and position. ` 7 . Maintain fences, gates and storage buildings in good condition with materials provided by the City for repairs. ; ' 8 . Remove and dispose of grave decorations as needed or requested, but not to exceed four (4) times per year. r ;. 9. Level and reseed sunken grass areas as needed or requested by the CIty. Y 10. Provide fertilizer, grass seed, (Bluegrass and Manhattan II perennial rye mixed 50/50) 1 and insecticide approved by the . ' City to maintain growth and healthy condition of vegetation. 11. This contract shall be in effect from May 11 1990, through April 30, 1991. With the consent of both parties, this contract may be be extended for one additional year. 3 . Contract Amount. The amount of the contract shall be Five Thousand Six Hundred Thirty-five dollars and eighty cents ($5, 635. 80) . 4 . Payment. Payment shall be made to Contractor by City upon submission of an itemized statement following completion of the project. ,16' 5. Indemnity. Contractor agrees to indemnify and hold harmless the City for any and all damages, injuries, actions, costs, attorney's fees and other expenses whatsoever arising out of the performance of said work whether the property or persons damaged are the servants and employees of the Contractor or third parties t. in no manner connected with said work. 6. Insurance. Contractor agrees to obtain and maintain throughout the term of this contract A. Workmen's Compensation Insurance for all of its employees to be engaged in work under this contract. B. Contractor' s Public Liability Insurance in an amount not less than $1, 000, 000 for all claims arising out of a N-) single occurrence and $100, 000 for any one person in a single accident or occurrence, except for those claims governed by the provisions of the Missouri Workmen's Compensation Law, Chapter 287, RSMo. , and Contractor' s Property Damage Insurance in an amount not less than $1, 000, 000 for all claims arising out of a single accident or occurrence and $100, 000 for any one person in a single accident or occurrence. C. Automobile Liability Insurance in an amount not less than $1, 000, 000 for all claims arising out of a single accident or occurrence and $100, 000 for any one person r. in a single accident or occurrence. D. Subcontracts - In case any or all of this work is sublet, the Contractor shall require the Subcontractor to procure and maintain all insurance required in Subparagraphs (a) , (b) , and (c) hereof and in like amounts. E. Failure to Perform. Should Contractor fail to provide QD services as set forth pursuant to this contract, or fail to meet any of the contract provisions, this contract may be cancelled at the sole option of the City upon giving five (5) days written notice to Contractor. 8. Cancellation. This contract shall be subject to cancellation by the City at any time following fifteen (15) days notice. 9. Notices. All notices, consents, authorizations, requests and statements hereunder shall be deemed to have been properly given if delivered by and or mailed by first class United States mail, postage prepaid, if to the City at 320 E. McCarty, Jefferson City, Missouri 65101 and if to the Contractor to 4705 Charlane Drip-e,Jefferson City: Missouri 65109 .
