AN ORDINANCE OF THE CITY OF RICHLAND HILLS, TEXAS
AMENDING PROVISIONS OF CHAPTER 10 OF THE CITY CODE
RELATING TO THE POWERS AND RESPONSIBILITIES OF ALL
ADVISORY BOARDS; CLARIFYING PROCEDURES FOR MINUTES
AND MEETINGS OF SUCH BOARDS; PROVIDING THAT THIS
ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES;
PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR
PUBLICATION AS REQUIRED BY LAW; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the City of Richland Hills is a home rule city acting under its charter
adopted by the electorate pursuant to Article XI, Section 5 of the Texas Constitution and Chapter
9 of the Local Government Code; and
WHEREAS, the City Council of the City deems it advisable and necessary to amend
Chapter 10 of the City Code relating to the powers and responsibilities of all advisory boards;
and clarifying procedures for minutes and meetings of such boards;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF RICHLAND HILLS, TEXAS:
• SECTION 1.
ADDITION OF SECTION 10-1 REGARDING ADOPTION OF RULES OF
PROCEDURE, POSTING, AND OPEN MEETINGS
Section 10-1 of Article I of Chapter 10 of the Richland Hills City Code is hereby added, and
shall provide as follows:
(b) Rules of Procedure, Posting, Open Meetings and Minutes. Every
Board created pursuant to this Chapter shall adopt such rules of procedure as
deemed advisable by the Board not inconsistent with the City Charter or the
provisions of this Chapter to govern its business. In the absence of a governing
rule, the Board shall abide by the most recent edition of Robert's Rules of Order.
The agenda for all meetings shall be posted at least seventy-two (72) hours prior
to any meeting at the place where City Council agendas are customarily posted,
and all meetings shall be open to the public, except that to the extent, if any, any
such Board is subject to the Texas Open Meetings Act or other applicable law
relating to open meetings and is authorized to convene in executive session under
such law, such Board shall be entitled to consider only the portion of such agenda
in executive session as is permitted by such law. Each Board shall keep and shall
promptly approve minutes of all meetings, and shall designate a Secretary or
authorize another officer or member to keep minutes, and file such minutes with

• the City Secretary promptly following the approval of such minutes by the Board.
SECTION 2.
PROVISIONS CUMULATIVE
This ordinance shall be cumulative of all provisions of ordinances and of the Code of
Ordinances of the City of Richland Hills, Texas, as amended, except where the provisions of this
ordinance are in direct conflict with the provisions of such ordinances and such Code, in which
event the conflicting provisions of such ordinances and such Code are hereby repealed.
SECTION 3.
PROVISIONS SEVERABLE
It is hereby declared to be the intention of the City Council that the phrases, clauses,
sentences, paragraphs, and sections of this ordinance are severable, and if any phrase, clause
sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid
judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not
affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this
ordinance, since the same would have been enacted by the City Council without the
incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph
or section.
• SECTION 4.
PUBLICATION
The City Secretary of the City of Richland Hills is hereby directed to publish this
ordinance to the extent required by law.
SECTION 5.
EFFECTIVE DATE
This ordinance shall be in full force and effect from and after its passage and publication
as required by law, and it is so ordained.
