ORDINANCE NO. 11535
AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE
MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT WITH STEVEN C. CARVER
FOR CONSULTING SERVICES IN THE CAPITAL CITY WATER COMPANY RATE
CASE.

BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS
' FOLLOWS:
Section 1. The Mayor and City Clerk are hereby authorized and
directed to execute an agreement with Steven C. Carver for
consulting services in the Capital City Water Company rate case.
The amount of the contract shall not exceed $6,635. 00.
Section 2. The agreement shall be substantially the same in
form and content as that agreement attached hereto as Exhibit A.
Section 3. This Ordinance shall be in full force and effect
from and after the date of its passage and approval .

ACCOUNTING CONSULTING SERVICES

r THIS AGREEMENT made and entered this 11 f't day of
1991, by and between the City of Jefferson, Missouri' a mun ipal
corporation, hereinafter referred to as 01City, 91 and Steven C.
Carver, hereinafter referred to as "Consultant. "
WHEREAS, the City of Jefferson, Missouri, is desirous of
obtaining the services of an Accountant for assistance in the
Capital City Water Company (CCWC) rate case; and
' WHEREAS, Consultant is willing to enter into this Agreement
with respect to his employment and services upon the terms and 7
conditions herein set forth,
t` NOW, THEREFORE, be it agreed as follows:
1. Scope of Services. The following services shall be provided
by the Consultant in conjunction with the City's participation in
Case No. WR-90-118: {
1. Review of pre-existing record evidence in the instant
preceding.

2. Examination of CCCW responses to discovery and testimony filed
by other parties on this issue. ;
' 3. Drafting of additional discovery for submission by Jefferson
City.
4.
Preparation of direct or rebuttal testimony for filing with
the Commission.
5. Assistance in developing cross-examination.
6. Attendance at hearings to be held at the Commission's offices
in Jefferson City.
2. Contract Period. This contract shall be in effect from
February 1, 1991 through June 1, 1991. With the consent of both
parties, the contract may be extended for an additional period of ,
up to six months.
3. Contract Amount. The amount of the contract shall not exceed
Six Thousand Six Hundred Thirty-five Dollars ($6, 635. 00) .
4 . Payment. . Payment shall be made to Consultant by City upon
submission of an itemized statement following completion of the
project.
5. Indemnity. Consultant agrees to indemnify and hold harmless
the City for any and all damages, injuries, actions, costs,
attorneys fees and other expenses whatsoever arising out of the

performance of said work whether the property or persons damaged
5 are the servants and employees of the Consultant or third parties
in no manner connected with said work.

7. Failure to Perform. Should Consultant fail to provide
services as set forth pursuant to this contract, or fail to meet
any of the contract provisions, this contract may be canceled at
the sole option of the City upon giving five (5) days written
notice to Consultant.
S. Cancellation. This contract shall be subject to cancellation
by the City at any time following fifteen (:15) days notice.
9. Notices. All notices, consents, authorizations, requests and
statements hereunder shall be deemed to have been ro p erl
delivered by and or mailed by first class United Stateslvmail,
Postage prepaid, if to the City at 320 E. McCarty, Jefferson City,
Missouri 65101, and if to the Consultant to 740 N. Blue Parkway,
Suite 204 Lee 's Summit, MO 64063.
IN WITNESS WHEREOF the parties hereto have set their hands and
seals on the day and year first above written.
