ORDINANCE NO. 11540
AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, REPEALING
ORDINANCE 11526 AMENDING THE CODE OF THE CITY OF JEFFERSON,
MISSOURI, BY AMENDING CHAPTER 35 ME—ZO-N-ING CODE) AND ENACTING A
NEW ORDINANCE IN LIEU THEREOF.
BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS
FOLLOWS:
Sectioj2 1. Ordinance 11526 of the City of Jefferson,
Missouri, amending Chapter 35 (The Zoning Cod as it pertains to
substance abuse treatment facilities is hereby repealed.
Section 2. The Code of the City of Jefferson, Missouri, is
hereby amended by amending of Chapter 35 (The Zoning Code) as
follows:
a) Section 35-3, Definitions, shall be amended by the
addition of the following:
Substance Abuse Treatment Facility - Outpatient. Structures
and land used for the treatment of alcohol or other drug abuse
where neither meals nor lodging is provided.
Substance--Abuse Treatment Facility - InDatie t Residential.
Structures and land used for the treatment of alcohol or other
drug abuse where one or more patients are provided with care,
meals and lodging.
b) Section 35-20, District Regulations, shall be amended by
the addition of the following:
(6) RA-2 Residential District
conditional Uses:
Substance Abuse Treatment Facility Outpatient and
Substance Abuse Treatment Facility - Inpatient
Residential, both of which meet all of the following
conditions:
The exterior appearance of the facility shall be in
reasonable conformance with the exterior appearance
of other structures in the immediate vicinity.
2 . A substance abuse treatment facility - outpatient
shall not be located closer than 400 feet to any
other substance abuse treatment facility

outpatient.
Conditions as authorized by Section 35-80(h) (4) a.2 . may
also be imposed by the Board of Adjustment.
(7) C-O Office Commercial District
Permissive Uses:
c. Medical and dental office, clinic, and substance abuse
treatment facility - outpatient.

Residential meeting all conditions specified for
Conditional Use i. of the RA-2 District (Section 35-

b. Substance Abuse Treatment Facility - Inpatient
Residential located less than 200 feet from any
` residential zoning district and any existing residential
use.
Y Section 35-71, PUD - Planned Unit Development District,
Subsection (a) (2) shall read as follows:
(2) Permissive Uses - Land and buildings in a Planned Unit
Development District may be used for residential uses,
Group Home for the Handicapped meeting all of the
conditions specified in Section 35-20(a) (3) Permissive f
Uses e. , Substance Abuse Treatment Facility - Inpatient
Residential, for any permissive use in the C-1 District, t
and any other commercial use which in the opinion of the r
Commission are ordinarily accepted as shopping center
uses.

C) Section 35-60, Off-Street Parking Requirements, shall be
amended by the addition of the following: ,
(24) Substance Abuse Treatment Facility - Inpatient
Residential; one space for each three beds. }

} (25) Substance Abuse Treatment Facility - Outpatient; one

space for every 200 square feet of building area.
Section This Ordinance shall be in full force and effect
from and after the date of its passage and approval .
