provided however that the Engineer will visit the site
and conduct monthly construction progress meetings as ,� �°•

2. Notice to Proceed. The services of the Engineer shall com-
mence as directed in the Notice to Proceed and shall be under-
taken and completed in a sequence appropriate to their expedi-
ti,ous completion in the light of the purposes of the contract ,

but in any event, all of the services required hereunder shall be
completed within fifteen calendar months from the date of comple- ,.' � ,.'

3 Compensation. The City will pay the Engineer in accordance
with the provisions set forth below, which shall constitute full
and complete compensation for the Engineer ' s services hereunder.
Such compensation will be paid in progress payments , as set forth � ta9 'r
hereinafter . The final payment will be subject to receipt of a
requisition for payment and a statement of services rendered from
the Engineer that the Engineer fully performed with work to be
paid for in such progress payments in conformance with the con-
tract. It is expressly understood that in no event will the
total compensation and reimbursement to be paid to the Engineer ,,fi5?;,•
under the terms of this Amendment exceed the sum of $55, 000
for all services required unless specifically and mutually agreed
to in writing by both the City and Engineer. No change shall be ' '. .
made unless there is a substantial and significant difference

For the services covered by this contract the City agrees to pay .

stakes, equipment rental, non-profit salary cost
and non-profit general expense. The maximum com-
pensation encumbered under this Amendment shall be

of any sales, use or similar tax imposed by taxing

GENERAL SERVICES DURING CONSTRUCTIONf'
1. General . The following paragraphs define the duties, respon-
sibilities and limitations of authority with respect to the Engi-
neer in providing general services during construction. `
2. Bidding. The Engineer shall assist the Owner in obtaining "' 4
bids or negotiating proposals for each separate prime contract for :;,y • ;� ,
construction, materials, equipment and services; consult with and tPrz�`r
advise Owner as to the acceptability of subcontractors and others yr ;,
proposed by the prime contractor (s) for those portions of the work
as to which such acceptability is required by the bidding docu-
ments; consult with and advise Owner as to the acceptability of
substitute materials and equipment when substitution
prior to the
award of contracts is allowed by the bidding documents; and assist i .
Owner in evaluating bids or proposals and in assembling and award- ? i4y
ing contracts. b'
3. Construction Phase. The Engineer shall consult with and
advise Owner and act as his representative as provided in the Gen-
eral Conditions of the construction contract. The extent and lim- rL..r
itations of the duties, responsibilities and authority of Engineer
shall not be modified , except to the extent provided in the Engi-
neering Service Contract or except as Engineer may otherwise agree
in writing. All of Owner ' s instructions to contractor (s) will bew- 7;
issued through Engineer who will have authority to act on behalf .fit
of Owner to the extent provided in said General Conditions except
as otherwise providers in writing. ,
The Engineer shall issue all instructions of Owner to contrac-
tor (s) ; issue necessary interpretations and clarifications of the
contract documents and in connection therewith prepare change
' . ` orders as required; have authority, as Owner' s representative, to
±;*.. require special inspection or testing of the work; act as initial
interpreter of the requirements of the contract documents and
judge of the acceptability of the work thereunder and make deci-
sions on all claims of Owner and contractor (s) relating to the `
l� acceptability of the work or the interpretation of the require-
'` ': ments of the contract documents pertaining to the execution and
work;progress of the but Engineer

results of any such interpretations or decisions rendered by him

4. Site Visits. The Engineer shall make visits to the site at
intervals appropriate to the various stages of construction to
observe as an experienced and qualified design professional the
progress and quality of the executed work of contractor (s) and toY'
determine in general if such work is proceeding in accordance with

written notice to Owner and the contractor (s) that the work is
