ACQUISITION OF CERTAIN PROPERTY FOR USE IN CONJUNCTION WITH `

THE JEFFERSON STREET PARKING GARAGE INCLUDING THE USE OF THE :r

t WHEREAS, The Council of the City of Jefferson, Missouri, has adopted a plan
t for the acquisition of certain properties hereinafter legally described, for street and
utility purposes, and for the payment for the same.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF
JEFFERSON, MISSOURI, AS FOLLOWS:
u Section 1. That it is hereby determined that improvements be made to
+ Jefferson Street Parking Garage for the purpose of improving safety and convenience

of the public.
;F. ;{v Section 2. That it is hereby determined that it is necessary and desirable that
. the City Council shall acquire title to and possession of the following described real
property which said real property is necessary, required and needed for right of way
and utility easement for the Jefferson Street Parking Garage and lying wholly within
' the limits of the City of Jefferson, in the County of Cole, to wit:
Part of Inlot No. 336, in the City of Jefferson, Missouri, more

particularly described as follows: from a point on the southerly line of
said Inlot, which is 50 feet, more or less, westerly of the southeasterly
corner of said Inlot No. 336, and is also the southeasterly corner of a
%� tract willed by Mary B. Heinrichs, deceased to the City of Jefferson,
Missouri, by Will of Record in Book 138, Page 104, Cole County
Recorder's Office; thence northerly along the easterly line of said tract
96'9" to the point of beginning for this description; thence continuing
northerly along the same line, 102 feet, to the northerly line of said
Inlot; thence westerly along the said northerly line, 20'8", more or less,
to the northeasterly corner of a tract conveyed to Frederick and Allen
Lietzke, by Warranty Deed of Record in Book 251, Page 936, Cole
County Recorder's Office;thence southerly along the easterly line of said
Leitzke tract, 102 feet; thence easterly, and at right angles, 20'8", more
or less, to point of beginning.

Section 3. That the Director of Transportation and the City Co
hereby are authorized, empowered and directed to negotiate for and in behalf of said
City Council with the owner or owners of the hereinabove described real property for
the purchase thereof by said City.
Section 4. In the event that the said City is unable to agree with the owners
of said property as to the compensation to be paid therefor, then title to and
possession of said real property legally described in Section 2 of this Ordinance shall
be acquired by the City Council through condemnation, and the Director of
Transportation and City Counselor, as representatives for the City Council, are
hereby authorized, empowered and directed to institute proceedings in any court of
competent jurisdiction to acquire title to and possession of said property and for said
City in accordance with the eminent domain laws of the State of Missouri, and
specifically Section 82.240 RSMo and to provide for managing, controlling and
• policing the same.
Section 5. This Ordinance shall take effect and be in full force from and after
' its passage.
