WOODMAN ORDINANCE NO. 11578 ANT ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, ESTABLISHING MINIMUM REGULATIONS GOVERNING THE DESIGN, CONSTRUCTION, ALTERATION, ENLARGEMENT, REPAIR, DEMOLITION, REMOVAL, MAINTENANCE AND USE OF ALL BUILDINGS AND STRUCTURES;PROVIDING FOR THE ISSUANCE OF PERMITS,COLLECTION OF FEES AND CONTRACTOR ' LICENSES, MAKING OF INSPECTIONS; PROVIDING PENALTIES FOR THE VIOLATION THEREOF;TO BE KNOWN AS THE BUILDING CODE; REPEALING ORDINANCE 11201; REPEALING SECTION 8-18, OF THE CODE OF THE CITY OF JEFFERSON, MISSOURI AND ENACTING 7 SECTIONS IN LIEU THEREOF. BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI AS FOLLOWS: Section 1. Adoption of Building Code ' That a certain document, three (3) copies of which are on file in the office of City Clerk, of the City of Jefferson being marked and designated as "The BOLA 4 National Building Code, Eleventh Edition, 1990" as published by the Building Officials and Code Administrators International, Inc., be hereby adopted as the Building Code of the City of Jefferson in the State of Missouri, for the control of buildings and structures as herein provided. Each and all of the regulations, a provisions, penalties, conditions and-terms of said BOCA National Building Code, are hereby referred to, adopted and made a part thereof as if fully set out in this ordinance, with the additions,insertions, deletions and changes, if any, prescribed in Section 3 of this Ordinance. Section 2. Inconsistent Ordinance Repealed Ordinance number 11201, of the City of Jefferson, Missouri, entitled "The. Building Code of the City of Jefferson", is hereby repealed. Section tion 3. Additions. Insertions and Changes The following additions, insertions, deletions and changes are made to the BOCA National Building Code/1990 otherwise referred to herein as the Building Code of the City of Jefferson: (1) Section 100.1: Insert the words "City of Jefferson" as E name of jurisdiction. y�la: s, e� , Fi t ;rc,{f t1� b9 4t s+{Yt gqo`����rct ++.•S'"t�? 'a.. ..,1 I w iyb � �y ,Wa t+' (2) Section 108.1: Add the following sentences: '> Drawings shall bear the embossed seal of the architect and/or Engineer and his signature on the first sheet of a set of drawings. The seal may be reproduced in a legible manner on all other sheets submitted. All work shall be submitted in accordance with Chapter 327, RSMO 1986. (3) Section 109.0 Delete Sections 109.1-109.5.1 and insert the following in its place: r Section 109.1 BUILDING OFFICIAL The department of building inspection known as the Department of Planning and Code Enforcement is hereby continued and the executive official in charge thereof shall ' be known as the Director of Planning and Code Enforcement. Wherever the words building official appear in this code, it shall be held to mean the director of Planning and Code Enforcement or his designee. f. Section 109.2 APPOINTMENT The director of Planning and Code Enforcement shall be appointed and removed as provided by ordinance. Section 109.3 ORGANIZATION The director of Planning and Code Enforcement shall recommend to the City Council the employment of building {' inspectors in sufficient numbers to assure enforcement of the building code. Section 109.4 DEPUTY The director of Planning and Code Enforcement may designate the supervisor of building regulations as deputy, r who shall exercise all the powers of the director during the temporary absence of disability of the building official. Should any person, firm or corporation commit a second offense by starting work without permit after so doing on a previous occasion, he shall pay three times the customary fee in order to obtain the necessary permit. Any offense shall subject the offender to prosecution under section 117.4. In the event any person firm or corporation fails to obtain the necessary permit(s) within 5 days after being notified in writing to do so by the Code official, he shall pay in addition to the usual fee or increased penalty as provided above the sum of $5.00 for each day in excess of the aforesaid 5 days that transpire prior to his obtaining the necessary permit. The payment of any or F several of the above stated penalty fees shall not relieve any person, firm or corporation from fully complying with the requirements of this code hi the execution of the work nor from any other penalties prescribed herein. (5) Section 117.4 Delete this section and insert in lieu thereof the following: VIOLATION PENALTIES: 'w Any person who shall violate a provision of this Code or shall fail to comply with any of the requirements thereof or who shall erect, construct, alter or repair a building or structure in violation of an r' approved plan or directive of the building official, or of a permit or certificate issued under the provisions of this code, shall be punished by a fine of not more than $500. or by imprisonment not exceeding 180 days, or both such fine and imprisonment. Each day that a violation continues shall be deemed a separate offense. r (6) Section 118.2 Delete this section and insert in lieu thereof the following: UNLAWFUL CONTINUANCE: Any person-who shall continue any work in or about the structure after having been served with a stop work order, except such work as that person is directed to perform to remove a violation or unsafe conditions, shall be liable to a fine of not less than $25.00 or more than $500. (9) Section 124.0 Delete this section and insert in lieu thereof the following: MEANS OF APPEAL: Any owner, agent or other person shall have the right to appeal a decision of the code official refusing to grant a modification to the provisions of this code covering the manner of construction or materials to be used in the erection, alteration or repair of a building or structure. An application for appeal shall be based on a claim that the true intent of this code or the rules legally adopted thereunder have been incorrectly interpreted, the provisions of this code do not fully apply, or an equivalent form of construction can be used. The appeal shall be to the circuit court of Cole County as established in Article 536 of the Revised Statutes of Missouri. (10) Section 1113.1, insert the following exception, 4. Building's less than 10,000 sq. ft. in area (Ref. RsMo Bill No. 539) (11) Section 3106.0 Add the following section: 3106.3 ALTERNATIVE EXTERIOR ENVELOPE: r' In use groups R-2, R-3, and R-4 as an alternative to complying with • Section 3102.1, the following table may be used as minimum insulation requirements expressed in values for the insulating material(s). This standard applies to the insulation only, not the overall assembly.
