HomeMy Public PortalAboutOrdinance No. 1053-06 05-23-2006 • ORDINANCE NO. 1053-06 AN ORDINANCE CANVASSING THE RETURNS AND DECLARING THE RESULTS OF THE GENERAL ELECTION OF CITY COUNCIL FOR MAYOR AND PLACES 2 AND 4 HELD SATURDAY, MAY 13, 2006, AND THE SPECIAL ELECTION TO DETERMINE THE ALLOCATION OF SALES TAX COLLECTED FOR ECONOMIC DEVELOPMENT PURPOSES HELD ON SATURDAY, MAY 13, 2006. WHEREAS, the general election of 2006 was held in the City of Richland Hills, Texas on the 13T" day of May 2006, for the purpose of electing persons to the positions of City Council for Mayor and Places 2 and 4, as provided by the City Charter; and WHEREAS, a special election was held in the City of Richland Hills, Texas on the 13th day of May 2006, to determine the allocation of sales tax collected for economic development purposes; and WHEREAS, it is hereby found and determined that notice of the election was duly given in the form, manner and time required by law, and said election was in all respects legally held and conducted in accordance with applicable laws of the State of Texas and the proceedings governing • the holding of such elections; and WHEREAS, such canvass shows the following results: Mayor Number of Votes David L. Ragan 585 Nelda S. Stroder 337 City Council, Place 2 Number of Votes Kenney Davis 392 Douglas Bell 507 City Council, Place 4 Number of Votes Don Acker 607 Proposition 1 - Should a restriction on expenditures of funds raised by the existing one-eighth of one percent sales and use tax within the city for the Richland Hills Development Corporation, an economic development • corporation created pursuant to Section 4B of the Development Corporation Act of 1979, Article 5190.6, Vernon's Texas Civil Statutes, as amended, providing that "expenditures of the proceeds for economic development, • parks and park facilities shall be limited to one and one-halfpercent (1-1/2%) of annual proceeds collected" be removed, to permit the proceeds thereof to be used and applied in any manner and purpose authorized by Section 4B of the Act, including but not limited to projects for the promotion of professional and amateur athletics and sports including stadiums, ball parks, auditoriums, projects related to entertainment, convention, tourist, and exhibition facilities, amphitheaters, concert halls, and public parks, park facilities and events, open space improvements, primary job training facilities for use by institutions of higher education, research and development facilities, regional or national corporate headquarters facilities, museums and related stores, restaurant, concession, and automobile parking facilities, related area transportation facilities, and related roads, streets, and water and sewer facilities, recycling facilities, and projects to promote new or expanded business enterprises that create or retain primary jobs, and public safety facilities, streets and roads, drainage, and related improvements, demolition of existing structures, development and expansion of affordable housing, and targeted infrastructure and any other improvements, expenditures, or facilities that are related to any of the above projects and any other project that the board determines will promote new or expanded business enterprises that create or retain primary jobs, and the maintenance and operations expenses for any of the above described projects. • YES 505 NO 290 Number of votes by which the proposition passed: 215 THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RICHLAND HILLS, TEXAS: SECTION 1. RECITALS FOUND TRUE All of the recitals contained in the preamble of this ordinance are found to be true and are adopted as findings of fact and a part of this City Council's judgment. • SECTION 2. • ELECTION CANVASSED AND DECLARED EFFECTIVE It is further found and determined that the results of the election are as canvassed and tabulated in the preamble hereof and in Exhibit "A" attached hereto. The City Council further finds the following: GENERAL ELECTION David L. Ragan has been elected as Mayor Douglas Bell has been elected to City Council, Place 2 Don Acker has been elected to City Council, Place 4 SPECIAL ELECTION A majority of the resident qualified voters at said election have voted in favor of the proposition. SECTION 3. CITY SECRETARY TO RECORD ELECTION RESULTS • The City Secretary is hereby authorized and directed to make the appropriate entries of information appearing in the tabulation of precinct results shown in Exhibit "A" attached hereto in the election register maintained by the City in accordance with provisions of Section 67.006 of the Election Code. SECTION 4. CITY STAFF TO TAKE NECESSARY ACTIONS TO GIVE EFFECT The City Manager, City Secretary, and City Attorney are hereby authorized and instructed to take all actions necessary to give effect to this resolution and the election, as provided by law. SECTION 5.
