Ky BILL NO. 91-39 SPONSORED BY COUNCILMAN HAAKE _ s ORDINANCE NO. 11605 nti t AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, PROVIDING r, TERMS AND PROVISIONS OF FIRE INTERCHANGE AGREEMENTS IN r ACCORDANCE WITH CERTAIN STANDARDS HEREINAFTER SET FORTH. WHEREAS it is in the interest of the City of Jefferson to provide for certain procedures as authorized by RSMo. 320.090 (1990) which permits the City to maintain mutual aid contracts for the protection of life and property and to maintain interchange agreements with certain other cities for an indefinite period of time, .;L� adopt procedural guidelines for the mutual aid plan, and provide for notice of use ofa;, ! mutual aid to the council all as hereinafter set forth. ,� rI'p NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: t•' Y Section 1. The City hereby contracts with the cities and fire districts of Boonville, Columbia, Eldon, Fulton, Linn, Mexico, Rolla, Sedalia, Centertown Rural, : rte+ Cole County Volunteer, Taos, Eugene, Russelville, Holts Summit and Osage Beach t to maintain existing or authorize new interchange agreements. Upon passage and approval of a like ordinance by the legislative body of the other contracting cities, said contracts are hereby authorized to be in existence for an indefinite time period, . provided that the contracts include a sixty-day period for notice of cancellation by the parties. This contract shall become effective between the City of Jefferson and such other contracting cities for the interchange of services of the fire departments upon 'z the conditions and provisions hereinafter set forth. fs� `. Section 2. The fire chief is hereby authorized to send fire department apparatus and personnel by request of an agency having jurisdiction,provided service r to the City of Jefferson will be adequately maintained. The authorized response is restricted to a 65 mile radius of the City of Jefferson unless specific approval to '} exceed the 65 mile radius is received from the city administrator and the fire chief. Section 3. This contract shall take effect and be in full force commencing on ti the 1st day of August, 1991, and shall be perpetual, unless any of the contracting 7 cities gives sixty days written notice of cancellation of the contract to all other cities and fire protection districts who are party to this contract. Section 4. The consideration of the interchange of service of the fire department of each city herein contracting shall be the service given for the protection of the lives and property in such city or the service of the fire department of each city hereto and no compensation shall accrue or be paid by any of said cities x for the service of the fire department of the other of said cities. None of the said cities shall be liable to the other for failure to respond to any call by the other of such cities, or for delay or negligence or mistake ' in receiving or responding to any call, nor shall this contract be interpreted as being an agreement for the benefit of any third person. .: Section 6. In effectuating the purposes of this contract the parties hereto may maintain direct telephone lines between the fire stations of each of them to be '° Vc used exclusively for fare calls. A violation of this section shall automatically terminate this agreement as to such violating V cities. Section 10. This agreement shall not be construed to permit or require any ;rtt response by a city to a fire alarm or other report of a fire outside of the limits of said city. Section 11. The fire chief shall report any action based upon the mutual aid : �Y agreement to the city council at the city council meeting following the incident. Section 12. Upon request for mutual air assistance, the REsponding Party v will send equipment, personnel, and other resources to any ;t point within the area for which the Requesting Party normally provides services; provided, however, that response is to be ;r fAl given only when the Responding Party, in the judgment of its �4 }' fire chief or the designated representative, can reasonably furnish such assistance without imperiling the safety of the r._ . citizens served by the Responding Party. 3. The fire service organizations, parties hereto, agree not to fr" call for assistance unless it is on an emergency nature, and the circumstances exist where the Requesting party' s normal 4' resources have been significantly reduces by emergency ' responses. 4 . The authority in charge of the Responding Party shall be the d h i f b g j sole judge of extent and amount of assistance to e furnished „ under the circumstances of each particular case. It is } y' agreed that the parties shall not be liable in any way to the other, or its inhabitants or any other person, firm, or 4 , corporation for failure to give assistance requested. 5 . Provided, however, it is mutually recognized rr` that each party hereto owes its primary allegiance and services to its own citizens . Therefore, the Responding 4 Party may be recalled by its fire chief, or his desig- nated representative, if, in that officer's opinion, a need exists for the Responding Party to render services ' within' its normal service area. t' i 6 . Each party, in consideration of this Agreement to provide emergency assistance, does waive any and all claims against each other party hereto for damages or compensation for any .,. � loss, damage, P ersonal injury,� death, or any other matter oc- curring as a consequence of performance under this agreement. 7 . No parties to this agreement shall be under any obligation to 4 nt reimburse the other parties for any costs or services in- curred pursuant to rendering of or acceptance of equipment of manpower under the terms of this Agreement.
