ORDINANCE NO. 11653
AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING
THE MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT WITH THE
RECYCLING COMPANY FOR THE DISPOSAL OF NEWSPRINT.
BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI,
AS FOLLOWS:
Section 1. The Mayor and City Clerk are hereby authorized and directed to
execute an agreement with The Recycling Company for the Disposal of Newsprint.
Section 2. The agreement shall be substantially the same in form and content
as that agreement attached hereto as Exhibit A.
Section 3. This Ordinance shall be in full force and effect from and after the
date of its passage and approval.

RECYCLING AGREEMENT FOR NEWSPRINT
THIS AGREEMENT made and entered this �day of 1991, by and
a a between.the City of Jefferson, Missouri, a municipal corporation,hereinafter referred
to as "City,” and The Recycling Center, hereinafter referred to as "Contractor."
WHEREAS, City is desirous of offering to its citizens the opportunity to recycle
newsprint; and
WHEREAS, Contractor is willing to enter into this Agreement with respect to
his employment and services upon the terms and conditions herein set forth,
x� NOW, 'THEREFORE, be it agreed as follows: . �
1. Scope of Services. The scope of services for recycling of newsprint shall consist ,
of the following: ;�}

a. Contractor shall provide newsprint collection for recycling services as
defined herein for City residents.
b. Contractor shall provide a container at each of five Fire Stations for

i drop off by citizens of newsprint. t.
C. Containers at the Fire Stations are to be no larger than six (6) yards, 5�
complete with lid and locking mechanism.

d. Contractor is to provide once a week pickup of the containers.
' Additional pick ups shall be made following a twenty-four hour notice
by the City.

2. Ideritification of Rec clin Container. Each recycling container shall have a

sign clearly visible to the public, stating the following: the rLarne,

the hours during which the facility is open to the public.
3. Hours of Operation. Recycling facilities are permitted to operate during the
following hours:
a. Facilities or portions of facilities not contained within a building:
° 8:00 a.m. to 4:00 p.m, on Saturdays and Sundays.

4. Sanitation. The area surrounding receptacles for temporary storage: of

newsprint shall be maintained in a clean and sanitary manner at all times. No • ) �
recyclable materials, waste material, processing material or other material shall be
allowed to accumulate around any receptacle or to overflow from any receptacle.
".a. Materials delivered to a recycling facility shall be handled in such a manner
as to prevent wind-blown materials.
The operator of a recycling facility shall not dump, deposit or store newsprint

on the ground outside the facility at any time, or allow any other person to do so.
5. Storage. Receptacles shall be appropriately designed and constructed to handle
the types of recycled materials stored therein. Containers must be made of rodent- +
roof material such as metal or plastic and of sufficient strength to bear the weight
of stored materials without cracking or breaking and to resist puncturing by the

Receptacle construction and placement must pose no danger to the public, e hgtn;,:
especially children, in normal use. Receptacles shall be free of jagged edges, sharp

protrusions or any other feature that may inflict injury on a person using or passing <•ra
by the receptacle.
Receptacles shall be designed and placed so as to be topple-proof at full load

Storage within buildings must comply with building and fire codes. t
6. Records and Reports. The Contractor shall maintain records of the facility's
f activities, including:
The amount in tons of newsprint received under the provisions of this contract
each month.
7. Landfill Prohibition. Newsprint collected pursuant to this agreement shall not
be taken to a landfill.
3. Contract Period. This contract shall be in effect beginning November 1, 1991,
and continuing for a period of six months. If at the end of the six month period,
neither party has requested the contract be terminated as set out in Section 14 of this
contract, the contract shall continue on a month-to-month basis until either party has

9. Contract Amount. The amount of the contract shall be market price and shall

10. Payment. Payment shall be made on a monthly basis to Contractor by City

upon submission of an itemized monthly invoice, properly signed and submitted, with

report per Section 6, in duplicate, to the Finance Director, 320 E. McCarty Street, ,
Jefferson City, Missouri, 65101.

11. Indemnity. Contractor agrees to indemnify and hold harmless the City for any ,
and all damages, injuries, actions, costs, attorney's fees and other expenses '
whatsoever arising out of the performance of said work whether the property or .'z:..
persons damaged are the servants and employees of the Contractor or third parties `
in no manner connected with said work. Contractor also agrees to accept liability for
any damages done to property belonging to the City of Jefferson. '
12. Insurance. Contractor agrees to obtain and maintain throughout the term of

N; A. Workmen's Compensation Insurance for all of its employees to be
engaged in work under this contract. elr.'-
B. Contractor's Public Liability Insurance in an amount not less than
$1,000,000 for all claims arising out of a single occurrence and$100,000
for any one person in a single accident or occurrence, except for those
claims governed by the provisions of the Missouri Workmen's
Compensation Law, Chapter 287, RSMo., and Contractor's Property
Damage Insurance in an amount not less than $1,000,000 for all claims
< ' arising out of a single accident or occurrence and $100,000 for any one
i;. person in a single accident or occurrence.
C. Automobile Liability Insurance in an amount not less than $1,000,000 '
., for all claims arising out of a single accident or occurrence and $100,000 '
for any one person in a single accident or occurrence.
�^ D. Subcontracts - In case any or all of this work is sublet, the Contractor
' shall require the Subcontractor to procure and maintain all insurance
required in Subparagraphs (a), (b), and (c) hereof and in like amounts.
E. The Certificates of Insurance furnished to the City showing proof of

that coverage under such policies shall not be canceled or materially
' changed until at least fifteen days prior written notice has been given
to the City.
13. Failure to Perform. Should Contractor fail to provide services as set forth
pursuant to this contract, or fail to meet any of the contract provisions, this contract
.' may be canceled at the sole option of the City upon giving thirty (30) days written
