• AN ORDINANCE AMENDING CITY OF RICHLAND HILLS ORDINANCE NO. 1024-05
AND THE FISCAL YEAR 2005-06 BUDGET FOR THE CITY OF RICHLAND HILLS,
TEXAS, ADOPTED THEREBY; PROVIDING A SEVERABILITY CLAUSE; AND
PROVIDING AND EFFECTIVE DATE.
WHEREAS, the City Council of the City of Richland Hills, Texas, adopted
Ordinance No. 1024-05 on September 13, 2005, approving and adopting a municipal
budget for the City of Richland Hills, Texas, for fiscal year 2005-06; and
WHEREAS, changed conditions and circumstances which could not have been
foreseen through the use of reasonable and diligent thought and attention resulted in
the adoption of Ordinance No. 1034-05 on November 17, 2005; Ordinance No. 1044-06
on January 24, 2006 and Ordinance No. 1051-06 on April 11, 2006 amending the
budget adopted by Ordinance No. 1024-05; and
WHEREAS, a public hearing on the following amendment to the fiscal year
2005-06 budget contemplated has been held as required by law.
NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF RICHLAND HILLS, TEXAS:
• That Section II of said Ordinance No. 1024-05, be amended to increase the
General Fund appropriation from $4,254,026 to $4,374,335 with such increase
allocated and appropriated as follows:
I.
$119,621 such sum for the funding of acquisition of properties located at 6724
Baker Boulevard and 3280 Diana Drive and
$688 such sum for the painting of property located at 6724 Baker Boulevard.
II.
That Section III of said Ordinance No. 1024-05, be amended to increase the
Enterprise Fund appropriation from $2,921,814 to $3,042,122 with such increase
allocated and appropriated as follows:

• $688 such sum for the painting of property located at 6724 Baker Boulevard.
Iv.
• Severability Clause. That it is hereby declared to the intention of the City
Council that the sections, paragraphs, sentences, clauses and phrases of this
ordinance are severable, and if any phrase, clause, sentence, paragraph, or section of
this ordinance shall be declared invalid or unconstitutional by the valid judgment or
decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall
not affect any of the remaining phrases, clauses, sentences, paragraphs and sections
of this ordinance, since the same would have been enacted by the City Council without
the incorporation in this ordinance of any such invalid or unconstitutional phrase,
clause, sentence, paragraph or section.
V.
Saving Clause. That said Ordinance No. 1024-05 of the City of Richland Hills,
Texas, shall remain in full force and effect, save and except as amended by this
ordinance.
VI.
Effective Date. This ordinance shall be in full force and effect from and after its
passage.
VII.
• PRESENTED, GIVEN FIRST READING AND APPROVED at a regular meeting
of the Richland Hills City Council on the 8th day of August 2006 by a vote of 4
ayes, and o nays, and o abstentions.
