AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING
PRESENTATION TO THE VOTERS OF THE CITY OF JEFFERSON AN ;x.
AMENDMENT TO ORDINANCE 11610 TO ALLOW FOR OPEN BURNING.
BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, :

.;Y Section 1. Subject to voter approval as herein provided, Ordinance 11610 is
amended as follows;
A. Section 301.2.1 of Ordinance 11610 is amended to read as follows:
Open burning of leaves, grass clippings, tree limbs and vegetation grown
on a property is permitted during the calendar periods and time-of-day
restrictions set forth in Sections 301.2.2.
B. Section 301.2 of Ordinance 11610 is amended to read as follows:

Allowable burning: Open burning shall be allowed without prior `
notification to the code official for: recreational fires, paper and
cardboard, fires used for the preparation of food, highway safety flares,
smudge pots and similar occupational needs, and fires used for training fire
. enforcement personnel. Papers and cardboard are to be burned in a
suitable metal container with covered top such as wire mesh or metal rack r
l., to prevent burning papers from blowing away.
C. Section 301.2.2 of Ordinance 11610 is deleted and a new section
enacted in lieu thereof which shall read as follows:

F-301.2.2 Periods and time allowed: Open burning of leaves, grass
clippings, tree limbs, vegetation grown on a property, paper and cardboard
is permitted on any calendar date during daylight hours.
D. Section 301.2.4, subsection (1) of Ordinance 11610 shall be amended
to read as follows:
1. Fires may be located anywhere on the property.

Section 2. The amendment as set forth in Section 1 shall be submitted to
the qualified voters of the City of Jefferson, Missouri, for their approval, at the
General Election to be held on the Seventh day of April, 1992, at the places 7
designated by the Election Authority for said General Election and the ballot shall
be in substantially the following form:

Shall Ordinance 11610 of the City of Jefferson, Missouri, be amended as provided
in Ordinance No, passed and approved by the Council of the City n

If you are in favor of the question, place an "X" in the box opposite "Yes". If you
are opposed to the question, place an "X" in the box opposite "No". "
Section 3. The City Clerk shall prepare and execute the form of the Notice
of said Election and shall transmit the same to the Election Authority for the City
of Jefferson, Missouri, and request said election be conduced by law.
Section 4. If a majority of the qualified voters voting at said election shall
vote in favor of the approval of this ordinance, then the same shall be binding in
full force and effect from and after such approval.
x Section 5. If any section, subsection, sentence, clause, phrase, or portion of
this ordinance is for any reason held invalid or unconstitutional by any court of
competent jurisdiction, such portion shall be deemed a separate, distinct and
independent provision, as such holding shall not affect the validity of the
remaining portion thereof.
Section 6. This ordinance shall be in full force and effect from and after its
passage and approval.
