CITY OF JEFFERSON,
{ DISCONTINUING THE
RIGHT-OF-WAY FOR A PORTION OF A TWENTY FOOT
k WIDE ALLEY BETWEEN MISSOURI BOULEVARD AND WALNUT STREET.
WHEREAS,it has been shown to the Council of the City of Jefferson, Missouri, r;
that the owners of land adjacent to and abutting upon a portion of a twenty foot wide °F
alley between Missouri Boulevard and Walnut Street in the City,have petitioned the
City Council to vacate right-of-way; and
a WHEREAS, it has further been shown that it would not inconvenience the
public or the citizens of the City to discontinue a portion of the right-of-way of a ; .

for public use as described in Section 1 of this Ordinance; and
WHEREAS it has further been shown that it would not inconvenience the
public or the citizens of the City to discontinue a portion of the right-of--way for public :.'" ?ti>
use as described in Section 1 of this Ordinance, subject to a reservation in the City
of an easement in that portion vacated for the maintenance, repair, location and
relocation of all sanitary sewer, surface water sewer or public utility facilities now
existing or hereafter to be constructed within said right-of-way.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF
JEFFERSON, MISSOURI AS FOLLOWS:
Section 1. The Council of the City of Jefferson, Missouri, hereby declares it '
necessary, reasonable and proper to discontinue as a right-of-way a portion of a
twenty foot wide alley between Missouri and Walnut Street and forever vacate the
following described right-of-way in said City:
Part of the twenty(20)foot wide alley between Inlots 772, 773, 775, 776,
and 777, and across part of the Northwest Quarter of Section 7,
Township 44, Range 12, of the City of Jefferson, County of Cole,
Missouri, being more particularly described as follows:
BEGINNING at the most easterly corner of Inlot 775; thence
N47°36'20'W along the northeasterly line of said Inlot 775, 72.70 feet
to a point 44.00 feet left of or South of the center of Missouri Boulevard
as per plans of Job No. 5-U-54-258B of the Missouri State Highway
Department; thence leaving the northeasterly line of said Inlot 775 and
Northeasterly on a curve to the left having a radius of 553.06 feet, a
Aft distance of 20.10 feet (Chord Bearing = N48°02'15"E, Chord = 20.10
feet) to the southwesterly line of the westerly extension of the southerly
line of Inlot 772; thence S47°36'20"E, along the southwesterly line of
said westerly extension and along the southerly lines of said Inlots 772
and 773, 187.51

S47 04345"W, 3.77 feet to the Northeasterly Line of said Inlot 777;
thence leaving said Northerly f•said Inlots 7a77 and 7767128 58 feet to
along the Northeasterly Lines o
the POINT OF BEGINNING.
Containing in all, 3,852.94 square feet (0.088 acres).
Section 2. All of that portion of the above vacated property is hereby retained
as a perpetual easement or right-of--way for the construction, all public
s relocation and operation of sanitary sewers, surf ace water
utility facilities, and no permanent buildings or structures the Citye located within or
upon said easement without the prior written consent
Section 3. The statutory right of reversion in the owners of the abutting
property is hereby confirmed, as is provided by the laws of the State of Missouri, and
the Mayor and the Clerk of the City are hereby authorized to execute all necessary
instruments required to confirm the reversionary rights of the owners of property
abutting on the area vacated, as described in Section 1 of this Ordinance, in the
right-of-way vacated.
