ORDINANCE NO. 11703
AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, VACATING AND
r DISCONTINUING THE RIGHT-OF-WAY FOR A PORTION OF BUENA VISTA AND
x ELIZABETH STREET.

WHEREAS,it has been shown to the Council of the City of Jefferson, Missouri,
= that the owners of land adjacent to and abutting upon Buena Vista and Elizabeth
Street in the City, have petitioned the City Council to vacate right-of-way; and
Y' WHEREAS, it has further been shown that it would not inconvenience the
public or the citizens of the City to discontinue a portion of the right-of-way of^F4^
for public use as described in Section 1 of this Ordinance; and
WHEREAS, it has further been shown that it would not inconvenience the x
public or the citizens of the City to discontinue a portion of the right-of-way for public
use as described in Section 1 of this Ordinance, subject to a reservation in the City
of an easement in that portion vacated for the maintenance, repair, location and
relocation of all sanitary sewer, surface water sewer or public utility facilities now
existing r hereafter to be constructed within said right-of-way.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF
'1. JEFFERSON, MISSOURI, AS FOLLOWS:
Section 1. The Council of the City of Jefferson, Missouri, hereby declares it
necessary, reasonable and proper to discontinue as a right-of-way a portion of Buena
Vista and Elizabeth Street and forever vacate the following described right-of-way in
said City:
F All that portion of Buena Vista Street right-of-way being 30 feet wide lying ,
north of Morris Edmonds Subdivision per plat of record in Plat Boob 2, Page
24, of the Cole County Recorders Office, all being a part of the Southwest
Quarter of Section 12, Township 44, Range 12 West, in the City of Jefferson,
County of Cole, Missouri and being more particularly described as follows:
From the northwest corner of said Lot No. 14 of Morris Edmonds Subdivision
described above,thence north along the northerly extension of the westerly line
of said Lot No. 14 for a distance of 30.0 feet, to a point on the northerly right-
of-way line of a 30 foot wide dedicated street and the beginning point of this
description; thence continuing northerly in a direct line approximately 180.0
feet to the most northern limit of said right-of-way; thence deflecting 90

30.0 feet; thence deflecting 90 degrees, 00 minutes, 00 seconds, left in a

deflecting 90 degrees, 00 minutes, 00 seconds, right in an easterly direction for
a distance of 30.0 feet; thence deflecting 90 degrees, 00 minutes, 00 seconds,
left in a northerly direction for a distance of 160.0 feet; thence deflecting 90
degrees, 00 minutes, 00 seconds, left, in a westerly direction for a distance of
30.0 feet; thence deflecting 90 degrees, 00 minutes, 00 seconds, left, in a
southerly direction for a distance of 160.0 feet, to the point of beginning.
Containing approximately 0.1102 acres.
Section 2. All of that portion of the above vacated property is hereby retained
as a perpetual easement or right-of-way for the construction, maintenance, repair,
relocation and operation of sanitary sewers, surface water drainage, and all public
utility facilities, and no permanent buildings or structures shall be located within or
! upon said easement without the prier written consent of the City.
Section 3. The statutory right of reversion in the owners of the abutting
property is hereby confirmed, as is provided by the laws of the State of Missouri, and
the Mayor and the Clerk of the City are hereby authorized to execute all necessary
instruments required to confirm the reversionary rights of the owners of property
abutting on the area vacated, as described in Section 1 of this ordinance,in the right-
of-way vacated.
