HomeMy Public PortalAboutOrdinance No. 1068-06 09-26-2006 • ORDINANCE NO. 1068-06 AN ORDINANCE AMENDING CITY OF RICHLAND HILLS ORDINANCE NO. 1024-05 AND THE FISCAL YEAR 2005-06 BUDGET FOR THE CITY OF RICHLAND HILLS, TEXAS, ADOPTED THEREBY; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AND EFFECTIVE DATE. WHEREAS, the City Council of the City of Richland Hills, Texas, adopted Ordinance No. 1024-05 on September 13, 2005, approving and adopting a municipal budget for the City of Richland Hills, Texas, for fiscal year 2005-06; and WHEREAS, changed conditions and circumstances which could not have been foreseen through the use of reasonable and diligent thought and attention resulted in the adoption of Ordinance No. 1034-05 on November 17, 2005; Ordinance No. 1044-06 on January 24, 2006; Ordinance No. 1051-06 on April 11, 2006 and Ordinance No. 1060-06 on August 8, 2006 amending the budget adopted by Ordinance No. 1024-05; and WHEREAS, a public hearing on the following amendment to the fiscal year 2005-06 budget contemplated has been held as required by law. • NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF RICHLAND HILLS, TEXAS: I. That Section VI of said Ordinance No. 1024-05 as amended be amended appropriating $278,833 from the 1998 Certificate Obligations Interest and Sinking Fund for the repayment of wastewater works long term debt principal and interest. II. That Section VIII of said Ordinance No. 1024-05 as amended be amended appropriating $66,925 out of the 2005 Contractual- Obligations Interest and Sinking Fund for the repayment of general long-term debt principal and interest. III. That Section IX of said Ordinance No. 1024-05 as amended be amended appropriating $61,445 out of the 2005 Contractual Obligations Expense Fund for purchase of capital equipment. • • Iv. That Section XII of said Ordinance No. 1024-05 as amended be amended appropriating $81,332 out of the Road and Street Improvement Fund for capital outlays in conjunction with street improvements. V. That Section XIV of said Ordinance No. 1024-05 as amended be amended appropriating $293,905 out of Oil and Gas Fund for capital outlays including street improvements. VI. That Section XVII of said Ordinance No. 1024-05 as amended be amended appropriating $62,217 out of the Police Department Homeland Security Grant fund to procure equipment and implement program to protect city facilities from terrorism. VII. That Section XIX of said Ordinance 1024-05 as amended be amended appropriating $50,132 out of the Special Program COPS Grant to fund a school resource officer for the Police Dept. • VIII. That Section XX of said Ordinance 1024-05 as amended be amended appropriating $2,675 out of the Law Enforcement Acquisition Fund to purchase police department equipment. IX. That Section XXIV of said Ordinance No. 1024-05 as amended be amended appropriating $14,972 out of the Library Donation Fund for the purchase of capital equipment and assets X. That Section XXV-A be created in said Ordinance No. 1024-05 as amended be amended appropriating $10,046 out of the Municipal Court Technology Fund for the purchase of equipment and assets. • • XI. That Section XXV-B be created in said Ordinance No. 1024-05 as amended be amended appropriating $17,499 out of the 1998 Certificate of Obligations Expense Fund for capital improvements to the wastewater works. XII. That Section XXV-C be created in said Ordinance No. 1024-05 as amended be amended appropriating $103,404 out of the 2002 Certificate of Obligations Expense Fund for capital improvements to the water works. XIII. That Section XXV-D be created in said Ordinance No. 1024-05 as amended be amended appropriating $114,745 out of the Crime Control and Prevention District Expense Fund for operating and capital outlays related to crime prevention activities. XIV. That Section XXV-E be created in said Ordinance No. 1024-05 as amended be amended appropriating $2,944 out of the Library Grants TIFB Expense Fund for the purchase of capital equipment and assets. • XV. Severability Clause. That it is hereby declared to the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph, or section of this ordinance shall be declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section. XVI . Saving Clause. That said Ordinance No. 1024-05 of the City of Richland Hills, Texas, shall remain in full force and effect, save and except as amended by this ordinance. • • XVII. Effective Date. This ordinance shall be in full force and effect from and after its passage. XVIII. PRESENTED, GIVEN FIRST READING AND APPROVED at a regular meeting of the Richland Hills City Council on the 26th day of September 2006 by a vote of 4 ayes, and o nays, and abstentions.
