AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING

H THE MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT WITH
JEFFERSON CITY NEW CAR DEALERS ASSOCIATION FOR A PORTION OF THE u
° '. JEFFERSON CITY MEMORIAL AIRPORT.
BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI,
AS FOLLOWS:
Section 1. The Mayor and City Clerk are hereby authorized and directed to
execute an agreement with Jefferson City New Car Dealers Association for a portion
of the Jefferson City Airport.
Section 2. The agreement shall be substantially the same in form and content as " T

that agreement attached hereto as Exhibit A.
Section 3. This Ordinance shall be in full force and effect from and after the date
f of its passage and approval.

3 . The Dealers have examined and know the condition of said

maintain the premises during the term of this lease, at its own

premises to the City in good condition and repair. The Dealers

agree that in maintaining said premises in good repair, it shall §$
not use the services of the City or any City employee. The Dealers
further agree that they shall not use the services of the City or

to continue operation of the airport as needed in the sole
judgement of the City.
5. The Dealers shall not assign this lease nor shall it

(b) Operate said sale in violation of State or City law,
(c) Sell or provide any alcoholic beverage to any person on
said premises. ,'•�
7 . The Dealers shall follow all Airport Rules and
Regulations. �'
r; 8. The Dealers, for itself, its representatives, successors A,
in interest, and assigns, as a part of the consideration hereof, '
'• does hereby covenant and agree that in the event temporary
facilities are constructed or operated on the said property

described in this Lease, the Dealers shall maintain and operate
such facilities and services in compliance with all other 2;
requirements imposed pursuant to 49 CFR Part 21, Nondiscriminationa ;
in Federally Assisted Programs of the Department of Transportation,
}r . and as said Regulations may be amended.
9 . The Dealers, for itself, its personal representatives, t1.,
successors in interest, and assigns, as a part of the consideration
hereof, does hereby covenant and agree that: '
(a) no person on the grounds of race, color, or national .a..
origin shall be excluded from participation in, denied
the benefits of, or be otherwise subjected to r;
M4; discrimination in the use of said facilities . '
10. Dealers agree to indemnify, and hold harmless the City �!
i l its agents and employees from any and all claims, demands, and
actions arising from the use of the land described herein.
11 . It is understood and agreed that the rights granted by
' this agreement will not be exercised in such a way as to interfere
with or adversely affect the use, operation, maintenance of
development of the airport.
12 . Dealers agree to obtain and maintain through the term of
this contract

(a) Workmen's Compensation Insurance for all its employees to
be engaged in work under this contract.
(b) Owner's Protective Liability Insurance - The Dealers
shall also obtain at their own expense and deliver to the
City an Owner's Protective Liability Insurance Policy
naming the City of Jefferson as the insured, in an amount
e>; not less than $1,000, 000 for all claims arising out of a
single accident or occurrence and $100, 000 for any one
{ person in a single accident or occurrence, except for
those claims governed by the provisions of the Missouri
`fl Workmen's Compensation Law, Chapter 287 RSMo. No policy,

accident or occurrence and $100,000 for an
