ORDINANCE NO. 11763
AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING
THE MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT WITH PUBLIC
WATER SUPPLY DISTRICT NO. I OF CALLAWAY COUNTY, MISSOURI.

BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI,
AS FOLLOWS:
Section 1. The Mayor and City Clerk are hereby authorized and directed to
Ti' execute an agreement with Public Water Supply District No. 1 of Callaway County,
Missouri, to provide water services to the City's water system. The amount expended
for the contract shall be $60.00 per month as a base charge plus $1.50 for each 1,000
gallons of water used.
Section 2. The agreement shall be substantially the same in form and content

-Y Section 3. This Ordinance shall be in full force and effect from and after the
date of its passage and approval.

WATER USER AGREEMENT

This Agreement, made and entered into this SO v4f-(lay of
1992, by and between Public Water Supply District No. I of Callaway County,
Missouri, hereinafter known as "District" and the City of Jefferson, Missouri,
hereinafter known as the "City";
WITNESSETH: sA
WHEREAS, the City desires to purchase and the District desires to furnish to
the City, water services for the area of the City formerly incorporated as the City of
Cedar City, from a line supplying water to ABB Power T & D Company, Inc., f/k/a
ABB Transmission Holdings, Inc., a Delaware corporation, formerly known as the
Westinghouse Electric Corporation, pursuant to agreement thereto dated June 24
1971;
NOW, WHEREFORE, for the consideration of the mutual covenants herein
contained, the parties agree as follows:
1. District agrees to furnish water to City's six-inch meter installation at
the rate of Sixty Dollars ($60.00) per month, a base charge as established by the
Board of Directors, plus One Dollar And Fifty Cents ($1.50) per each one thousand
(1,000) gallons used, as a standby service.
2. City agrees to obtain written permission for such connection from ABB
Power T & D Company, Inc. and furnish an executed copy of same to the District.
3. City shall receive such water on the basis of need, however, such need
shall be secondary to that of ABB Power T & D Company, which shall be primary.
City understands and agrees that it will not receive water, regardless of need, when

upstream pressure on the system with ABB Power T & D Company, Inc., is less than
yu one hundred five (106) pounds per square inch (p.s.i.).
4. City agrees to arrange and permit access to system by District or its
agents for purposes of maintenance, inspection and repairs; and, to obtain necessary
easements therefor. JL
5. City agrees to install its connections in accordance with the plans and
specifications, a copy of which is attached to this agreement and incorporated herein wu
as if more fully set forth; and, said installation shall be the responsibility of and paid
for by City.
6. All apparatus within the meter vault shall be installed by the City, •
which shall maintain everything therein, except the meter itself which shall be
maintained by the District. The service line to the meter vault shall be installed and
maintained by the City.
7. The twelve-inch gate valve and interconnect provided by the plans and
specifications must be performed on a weekend selected by ABB Power T & D

Transmission Company, Inc., in order not to interfere with ABB's plant operations.
8. City further agrees as follows:
a. To pay $25.00 as a water m.eter deposit, the meter deposit and
guarantee will be refundable upon application when service is discontinued.
b. To pay charges for the water service connection from the time

service is made available by the District, and pay for additional water used at the
rate set out in the rate schedule adopted by the Board of Directors. Any changes

made in the minimum monthly water charge and rate schedule by the Board of.t

Directors of the District shall become a part of this agreement as though fully set out f

C. When the Rules and Regulations of the District provide that water
users will read their own water meters and remit payments without notice, water .,
users will read their own water meters on the first day of each month, or the earliest
date thereafter, and remit the payment of the months water bill not later than the ;} '
' 15th day of the month. Bills not paid on the 15th day of the month shall be subject h` r

d. A water user is responsible for reading the meter and submitting n!;

in readings or incorrect readings have been submitted a service charge will be billed

A water user will be responsible for and hold the district harmless from
all damage from any cause whatsoever to meter, pit, ring,lid and apparatuses beyond

normal wear, except that occasioned by district employees. The user will be charged

a service charge plus materials and labor for repairs.
e. If after water service is made available the same is discontinued
or disconnected for any purpose, pursuant to the By-laws and the Rules and
Regulations of the District reconnection shall be upon the e conditions set out in the
By-laws and the Rule and Regulations of the District.

f. The laws of the State of Missouri, the By-laws of the District and
the Rules and Regulations of the District, as presently existing, and as may be
amended from time to time, are made a part of this agreement as though fully set out

g. Water District employees may enter water user's property at any
time to inspect, and repair meter and equipment.
9. This Agreement may be terminated by either party upon ninety (90)
days written notice to the other by Certified U. S. Mail, Return Receipt Requested.

to provide a standby water supply to the North Jefferson City

City) water system by means of an interconnect to the Callaway County Public
Water Supply District Number 1 for Jefferson City, Missouri were submitted by
Chandra L. Russell, City Engineer, Jefferson City, Missouri on Jul'I.e 25, 1992.
Please make reference to Review Number 3593-92 when submitting documents
pertinent to this proposal.
In an effort to further expedite our permit review process, these plane and
specifications will be carefully reviewed as soon as possible by our contracted
PRIVATR CONSULTANT. Our consultant will process the plans and specifications and A
.. discuss possible changes or necessary additions to the submittal with your engi-
nears.
Regulations provide that our approval of the project must be secured in writing.
before construction work is started. This approval is your assurance that the
proposed work complies with requirements of this Division.
The city will receive copies of our report and approval of plans and specifica-
tions for the proposed work, and this report will serve as your authorization to
award contracts and begin construction.
