execute an amendment to Section 7.13(H) of the Franchise Agreement to read as 1h ;

(30) days prior to a scheduled periodic review and evaluation session, Company shall
r conduct a written poll of the programming and service preferences [of at least •

five (25) percent] of the subscribers within the City. Each poll shall be
done in a manner approved by City and conducted so as to provide statistically
reliable measurements of subscriber preferences for: ,
a 1) Programming and services offered by Company at the time the poll is
conducted, and

subscribers but not offered by Company at the time the poll is conducted.
