RE: Compost Materials
Dear Mr. Toft:
Enclosed are copies of the Compost material processing contract between the Missouri Highway
} and Transportation Department and the City of Jefferson. Please have both copies executed
by the appropriate persons and return one copy to my office for filing.
In addition to Items previously noted In the agreement, the City requests that the Department

maintain a fifty (50') foot separation between 4ts processing area and the active area of the
` compost faciilty.
The Department should recognize the openness of the compost facility'and acknowledge that
the material left at the site may contain noxious weeds such as poison ivy and sumac and other
material not necessarily suitable for processing into mulch. The Department will be responsible
for ascertaining and advising the personnel Involved on its behalf of the character of this
material and any risks associated with the processin g Into mulch.
If you have questions or need additional Information, please feel free to call my office at 634-
6447. Again, many thanks for your cooperation In working with the City to alleviate our
yardwaste problems.

CONTRACT
This agreement,made and entered into by and between the Missouri Highway
and Transportation Department, hereinafter called "Department" and the City of
Jefferson, Missouri, a municipal corporation, hereinafter called;'City".
WHEREAS, the City currently maintains a compost facility located at Hyde
Park Road, within the City of Jefferson;
WHEREAS, it would be to the benefit of the City to dispose of some or all of

the materials which have beech deposited at the compost facility;

WHEREAS, it would be to the benefit of the Department to have a readily
available source of mulch; and
,WHEREAS, the Department has a chipper at its disposal.
WITNESSETH:
In consideration of the mutual covenants contained herein,to be faithfully kept
and performed by the parties hereto, it is agreed as follows:
I. The City will allow access to its compost facility to the Department and
will allow the Department to process compost materials into mulch.
2. Any mulch processed by the Department shall become the property of
the Department.
3. Nothing in this agreement shall require the Department to process any
specific amount of compost materials.
4. The Department may use Missouri Highway and Transportation
Department ("MHTD") personnel or any other personnel, including, but not limited
to, persons currently incarcerated in the Missouri Division of Adult Institutions in
order to process said materials.

S. The City shall be responsible for any injuries to persons and/or damages
to property which may occur at its compost facility as a result of City negligence.
