THE MAYOR AND CITY CLERK TO EXECUTE SUPPLEMENT NO. 1 TO THE
AGREEMENT WITH BUCHER, WILLIS-AND RATLIFF FOR ENGINEERING
r SERVICES FOR THE JEFFERSON CITY MEMORIAL AIRPORT IMPROVEMENTS. y
BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI,
AS FOLLOWS:
Section 1. The Mayor and City Clerk are hereby authorized and directed to {'
�tx execute Supplement No. 1 to the agreement with Bucher, Willis and Ratliff dated
August 3, 1992 for the repair and seal of runway 12-30, repair and overlay of
taxiway D and marking, shouldering, seeding and ancillary improvements at the
t Jefferson City Memorial Airport. Such agreement is subject to approval from the
Aviation Section of the Missouri Highway and Transportation Department.

Section 2. The agreement shall be substantially the same in form and content
':•<?a; as that agreement attached hereto as Exhibit A.
Section 3. This Ordinance shall be in full force and effect from and after the

This letter is to address MHTD's comments regarding our Supplement No. 1 adding construction
v;'•. services to our Original Agreement dated August 3, 1992. Our response follows Mr. Burle's

u ` letter of March 1, 1993, point by point. .
i 1. The most recent version of Standards for Construction Inspection Services dated
February 20, 1993 has been included in the Supplement.
2. The Scope of Services now reflects two (2) sets of record drawings will be provided
r{ to MHTD.

3. The Original Agreement only provides for Contract Documents for signatures. The
,Y construction services scope provides for working sets of plans and specifications for
V the contractor's field use.
Setting basic horizontal and vertical control is included in our Construction Services
scope because we generally have to locate field control monuments for the
i;. Contractor. Also,in some cases monuments have been destroyed and must be reset.
{ 4. Our laboratories are now in the process of becoming certified by the American
Association for Laboratory Accreditation. ANCO Laboratories,who we will also use,
is certified by the Army Corps of Engineers.
5. A detailed manhour/cost breakdown has been included with our supplement.
6. The State's Internal Review, Audit and Systems Division has authorized our
overhead rate to be 134.15%. This rate is now included in our supplement.
7. This itein will require your input.

We have provided you four (4) copies of the revised Supplement so that one (1) copy can be
forwarded to the State Aviation Section for review and approval prior to being executed by the
City. The other three (3) copies are for review and execution by the City. Upon execution by

3. It appears that preparing plans and specifications for use by the
contractor and setting basic horizontal and vertical control for

;�. 4. The testing laboratory used must be certified by the Army Corps of
Engineers, American Association of State Highway and Transportation
FN` Officials or the American Association for Laboratory Accreditation.

5. Please provide a detailed manhour/cost breakdown (enclosed) for this
project per AC 150/5100-14C (copy enclosed) . This will speed up review
time and help us review the proposed fee. Our participation in these

Systems division that the overhead rate should be 130.13% as opposed to

revisions necessary per these review comments. �

THIS SUPPLEMENT, made and entered into this day

BY AND BETWEEN the City of Jefferson City, Missouri,hereinafter called the"Sponsor,'
and Bucher,Willis & Ratliff,Consulting Engineers, Planners and Architects, with offices located
in Kansas City, Missouri, hereinafter called the "Consultant."
WHEREAS, on August 3, 1992, Sponsor and Consultant entered into an original
Agreement for Services for improvements to the Jefferson City Memorial Airport.
WHEREAS, the Sponsor has agreed to supplement the Consultant's original Agreement
to perform Construction Services for the airport improvements stated in the original Agreement.
NOW,THEREFORE, in consideration of these premises and the mutual covenants herein a.
contained, the parties hereto agree as follows:
SUPPLEMENT NO. I
ARTICLE I
SCOPE OF SERVICES
The Consultant,in consideration of additional payment on the part of the Sponsor,agrees
to perform the supplemental engineering services enumerated as follows:
Delete the second sentence of the second paragraph of Article I on Page 1 and 2 of the
original Agreement and replace with the following sentence:
"All services will be performed in accordance with good
engineering practice and applicable published design critgria of the
Federal Aviation Administration,primarily FAA AC 150/5300-13,
Airport Design,dated September 29, 1989, and in accordance with
"Standards for Construction Inspection Services" as per Exhibit A
attached.

The Consultant shall not proceed with the services described herein until written
authorization in the form of Notice to Proceed is received from the Sponsor.
Total compensation under the Original Agreement and this Supplement No. 1 for Item
A. Basic Services and Item B.Special Services shall not exceed the sum
of twenty-two thousand,
two hundred ninety dollars($22,290.00)unless the Scope of Services is modified by Supplement
Y .
as provided for in Article VIII, Miscellaneous Provisions, 1. Change in Scope.
For engineering services applicable to Item C, Construction Services, the Sponsor shall
compensate the Consultant on the basis of payroll cost times a factory of 2.3415 plus the fixed
payment for services rendered by principals and employees assigned to this project.
For engineering services applicable to Item C., the Consultant shall submit monthly
statements to the Sponsor for payroll costs and all other expenses incurred on the project and
shall include a pro-ratS share of the fixed payment in proportion of the statement amount to the
not-to-exceed amount.
The fixed payment to the Consultant for services as outlined in Item C., Construction
Services shall be $850.00 and the total payment to the Consultant shall not exceed $19,000.00
unless the construction contractor(s) exceeds a contract period of thirty (30) calendar days. If

the construction period exceeds thirty (30) calendar days, the Consultant can renegotiate the
fixed payment and not-t6-exceed amount. ,r
The Consultant shall have the option of using an independent laboratory and/or the
consultant's field laboratory for all material testing,mix designs and testing during construction.
A daily charge of $300.00 per day shall be charged for the field laboratory for each day the

laboratory is used on the project. This charge does not include the cost of personnel working r`
in the laboratory. The procedure for laboratory testing shall be determined at the time of
construction and the availability of the Consultant's field laboratory. A daily charge of$30.00 E.

The travel on, or off the job, required of Bucher, Willis & Ratliff personnel will be
compensated at the rate of $0.25/mile. It is intended that, under normal working conditions,
the Resident Engineer/Inspector will reside in the Jefferson City, Missouri. Travel expenses and ,
labor will be charged for trips to and from the Bucher, Willis & Ratliff Kansas City office. r

project described in the basic portion of this document. The Engineer will be required to furnish material,
provide qualified personnel and equipment;perform required tests;and submit the reports described
( .; herein. The purpose of these inspection services is to assure that the project is being constructed in .,

A. The Engineer shall be responsible to ensure that a facility suitable for use as a field office and
laboratory is provided for hi the contract specifications.

;y A. The Project Engineer shall be a�Professional Engineer, licensed in the state where construction takes
place(or a reciprocal state),and shall leave overall responsibility for inspection��f the project and provide
assurance to the owner that the construction is in accordance with the approved plans and specifications. -
Ile engineer shall be on the project site at the beginning of any critical operations and shall supervise all
additional inspection personnel (Critical operations shall be specifically defined in the Construction
Inspection Program CIP.) The engineer shall have authority to make decisions regarding the project.

inspection reports,etc)shall always be signed by the Project Engineer. Documents sliall also be signed by
the appropriate inspector if the Project Engineer is not on site to observe operations. Unless otherwise

B. During construction gperations which require inspection or testing.either the Project Engineer or,a

A. The main laboratory furnishing testing services for the project shall be tested for proficiency by an
, acceptable accreditation program. Acceptance of laboratory accreditation programs must come from the

frequency inspections and proficiency testing required to retain accreditation shall be as

required by the AASHTO Accreditation Program. The laboratory shall only be required to have
accreditation for tests required in the project.
B. Testing functions occurring in the field such as density testing, material sampling, or specimen
preparation may be performed by accredited laboratory personnel or other qualified personnel. The
minimum qualifications for Field Testing Personnel are outlined under Part VII. For areas not covered
under Part VII,field testing personnel shall have as a minimum,one year of experience with the
appropriate material and construction methods.

E. Report of Test Results to the Contractor:
The Contractor shall be verbally notified of the test results immediately after the tests have been
completed. The information shall include the results of the tests and any payment deductions due to
substandard construction materials. In no case shall the Contractor be verbally notified later than 4
working hours after the test results have been completed. Additional written notification shall be provided
to the Contractor within 7 days after the tests have been completed.
F. Retesting:
The testing laboratory shall provide written notification to the Sponsor and the Contractor of additional
costs incurred from retesting of failed materials,additional quality tests,and additional mix designs.
