ORDINANCE NO. 11893 }
AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, RELINQUISHING A
UTILITY EASEMENT WHICH WAS RETAINED WHEN AN ALLEY RIGHT-OF-WAY
RUNNING EAST FOLLOWING STADIUM BOULEVARD AND THEN SOUTH AWAY
FROM STADIUM BOULEVARD WAS VACATED.

WHEREAS, it has been shown to the Council of the City of Jefferson, Missouri,
that the owners of land adjacent to and abutting upon a former alley running
approximately 152.8 feet east following Stadium Boulevard and then 169.7 feet south
away from Stadium Boulevard have petitioned the City Council to vacate the utility
easement; and
WHEREAS, it has further been shown that it would not inconvenience the public r;?
' or the citizens of the City to discontinue the utility easement as describe:d in Section 1
of this Ordinance; and
WHEREAS, Ordinance No. 11480 vacated and discontinued the right-of--way for
public use on the property described in Section 1 of this Ordinance, but retained a
i perpetual easement for the maintenance, repair, location, relocation and operation of
sanitary sewer, surface water drainage and all public utility facilities;
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF
JEFFERSON, MISSOURI, AS FOLLOWS:
t Section 1. The Council of the City of Jefferson, Missouri, hereby declares it
necessary, reasonable and proper to discontinue and forever relinquish the easement
retained by Ordinance 11480 described as follows:
An easement for utility,purposes encompassing all that part of Morris'Subdivision
of the East half of Outlot No. 86 in the City of Jefferson, County of Cole, Missouri,
as per plat of record in Plat Book 3, Page 5, Cole County Recorder's Office and
=' being more particularly described as follows:
Being all that part of a 10 foot wide east-west alley lying between the southerly
line of lot no's. 121 through 125 including a portion of lot no. 126 and the
northerly line of lot no. 136, of Morris Subdivision described above.

Also, all that part of a 10 foot wide north-south alley lying between the easterly
line of lot no's. 136 through 140 and the westerly line of lot no. 141, of Morris

Subdivision, per plat of record in Plat Book 3, Page 5, Cole County Recorder's
Office.
Section 2. The easement described in Section 1 is hereby relinquished, and the
' City does hereby release and abandon whatever interest it has in the easement.
Section 3. The Mayor and City Clerk are hereby authorized to execute any
necessary legal documents relinquishing all of the City's interest in the tract of ground
described in Section 1.
Section 4, This Ordinance shall take effect and be in full force from and after its
passage.
