AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING THE
CODE OF THE CITY OF JEFFERSON, MISSOURI, BY AMENDING CHAPTER 2
AS IT PERTAINS TO ADMINISTRATION.
BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI,
F AS FOLLOWS:
Section 1. The Code of the City of Jefferson, Missouri, is hereby amended by
' amending Article VIII, Planning and Code Enforcement Department, of Chapter 2 to '
k read as follows:

Sec. 2-322. Appointment of director.
The director of planning and code enforcement shall be
recommended for appointment by the city administrator to the
mayor subject to approval of the city council^.
Sec. 2-323. Qualifications of director.
: The director of planning and code enforcement shall be a
F. graduate from an accredited four-year college or university with
C z major course work in public or business administration, civil
engineering, planning, architecture, or related field. The
director shall have thorough experience in the field of
management, or any equivalent combination of education and
j' experience that provides the necessary p knoevledge,abilities,and
skills for the job. The director shall be generally informed on
' good engineering practice in respect to the design and
construction of buildings, the basic principles of planning as it
relates to community development and the fundamentals of
i zoning administration.
Section 2. The Code of the City of Jefferson, Missouri, is hereby amended by
amending Article IX, Public Works Department, of Chapter 2 to read as follows:

Sec. 2-337. Director, divisions, etc.
The public works department shall be staffed with the
director and other personnel according to the personnel
authorization of the budget as approved by the city council.
The following divisions of the public works department are
hereby established:
A. Street;
B. Wastewater;
C. Central maintenance division;
D. Transit division;
E. Parking division;
F. Airport division;
G. Engineering division.
Sec. 2-333. Appointment of director.
The director of public worlds shall be recommended for
appointment by the city administrator to the mayor subject to
approval of the city council. °

' Sec. 2-339. Qualifications of director.
The director of public works shall be a graduate civil
engineer, licensed as a Professional Engineer by the State of
Missouri, or have the ability to be licensed within six months of
appointment. The director shall have thorough experience in
the field of management, or any equivalent combination of
education and experience that provides the necessary
knowledge, abilities, and skills for the job.
Sec. 2-340. Functions of director.
A. The director shall supervise and coordinate the work
and operation of the street division,the wastewater division,the
parking division, the airport division, the transit division; the
central maintenance division, the engineering division, and
employees working for these divisions, and shall supervise and
coordinate taxicab franchises.

B. The director shall perform such other duties relating
to public works as directed by the city administrator.

C. The director shall supervise and coordinate the work
X and operation of any port authority or pier commission which
may hereafter be established by the city.
{ Section 3. The Code of the City of Jefferson, Missouri, is hereby amended by a
deleting Article XIII, Transportation Department, of Chapter 2 in its entirety.

Section 4. The following sections of the Code of the City of Jefferson, Missouri, d
f . are amended in conjunction with the reorganization plan to read as follows:
A. Section 19-41 of Chapter 19;Motor Vehicles and Traffic, of the Code of 6
the City of Jefferson, Missouri, is amended to read as follows:
Sec. 19-41. Traffic accident studies.
Whenever the accidents at any particular location become
numerous, the traffic division shall cooperate with the transportation '
y and traffic commission and director of public works in conducting '.
studies of such accidents and determining remedial measures. '
B. Section 22-27.A of Chapter 22, Parking, Stopping and Standing of the
r Code of the City of Jefferson, Missouri, is amended to read as follows:
Sec. 22-27. Loading zones.
a
A. Any person desiring a loading zone on the roadways
in the city shall file a written application with the department
of public works on a form provided by that department. The
director of public works shall review the application. If the
director approves the application, an appropriate ordinance
shall be drafted and forwarded to the city council for their
action. If the director denies the application, the applicant may
within fifteen (15) days files a request for review with the
transportation and traffic commission. Applicants shall be
notified in writing of the action of the city council. If the
application is denied, the filing fee shall be refunded. If it is
granted, the applicant shall pay all additional fees due under
subsection B of this section within fifteen (15) days of the date
of the notice of the granting of this application.
I C. Section 32-180 of Chapter 32 of the Code of the City of Jefferson,
Missouri, is amended to read as follows:

Sec. 32-180. Records.
The director of public works shall see that an accurate and
complete record of all permits issued, indexed by street
locations, and all original applications for permits to construct,
alter or relate a driveway or to cut and remove any curbs are
kept and maintained.
D. Article II of Chapter 34, Department of Transportation, of the Code of
the City of Jefferson, Missoun", is deleted -and Sections 34-11 through 34-15 are
repealed in their entireties.
E. Section 34-27.E of Chapter 34 of the Code of the City of Jefferson,
Missouri, is amended to read as follows:
E. Transfers on the transit system are free subject to the
rules established by the director of public works.
F. Section 34-27.G of Chapter 34 of the Code of the Cit y of Jefferson,
Missouri, is amended to read as follows:
G. During the off-peak hours,the demand-responsive bus may
be used for subscription service by the handicapped and
senior citizens as defined in this section. The general fare
rate shall apply to the subscription service. Senior golden
passes can be used for this service. "Subscription service"
shall be defined as a trip to or from a specified destination
within the city limits. The specified destinations will be
established by the city. The director of public works
shall establish necessary rules and regulations to
implement the service.
G. Section 34-29 of Chapter 34 of the Code of the City of Jefferson,
Missouri, is amended to read as follows:
A. Generally. Special routes may be established by the director
of public works when drivers and vehicles are available, at a charge
of one dollar fifty cents ($1.50) per route mile with a minimum charge
of forty dollars ($40.00) per day.
B. Shuttle routes. The fare for the special shuttle routes which
may be established by the director of public works upon availability
of drivers and vehicles shall be fifteen cents ($0.15) per one-way trip.
H. Section 34-43 of Chapter 34 of the Code of the City of Jefferson,
Missouri, is amended to read as follows:

Sec. 34-43. Airport division fund.
There is hereby established a fund in the city treasury to be
known as the airport division fund. All money in the airport division
fund as of June 15, 1981, shall be expended only for capital t,:k
improvements and acquisitions, grant matches, or major repairs as `5
approved in the airport division budget. All revenues derived from the
operation of the airport shall be used to pay operating expenses of the
airport, and all interest earned on credit balances of the airport division
fund shall likewise be used to pay operating expenses of the airports
The finance director shall provide a monthly statement of the fund's *�
t revenues, expenditures, and balance to the mayor, city council, city

administrator and the director of public works. '
I. Section 34-44 of Chapter 34 of the Code of the City of Jefferson,
'Missouri, is amended to read as follows:

Any person desiring to enter into any business or provide any
commercial g mercial services at the airport shall make application in writing to

the director of public works for permission to provide such commercial

service, or to lease any property, or conduct any business on the airport, t
agreeing that if he is authorized by the city to provide commercial
scheduled or nonscheduled airline service, to provide fixed base
operation, to lease any property on the airport, or to conduct any
business on the airport he will meet the following g qualifications:
A. That such person is insured, and will continue to be
insured, and will provide the city, through the director f

public works, with evidence of such insurance against
public liability and property damage in the following

1. For injury or death to one person: two hundred fifty
thousand dollars ($250,000.00).
2. For injury or death to two (2) or more persons in one
accident: five hundred thousand dollars

3. For aggregate damage to property: five hundred
thousand dollars ($600,000.00).
B. That in the case of those persons offering commercial
scheduled airlines service, such persons must be authorized
by a certificate of convenience and necessity issued by the

Missouri, is amended to read as follows:

All fees and charges for commercial or other use of the airport,for
P the occupancy of buildings owned by the city on the airport and for all
services that are rendered at the airport, shall be determined and fixed "

and charges determined by the council. The following fees shall

Plans for proposed construction shall be submitted to the director of
public works who shall secure the approval of the director of planning
and code enforcement of such plans prior to any construction. A I
hangars and buildings shall be of permanent type construct-ion.
B. Any person desiring to erect a building on the airport will
be permitted to do so under a contract or lease negotiated with the
director of public works for the necessary land space, at rates to be
subject to the approval of the council and the mayor.
L. Section 34-62 of Chapter 34 of the Code of the City of Jefferson,
Missouri, is amended to read as follows:
Sec. 34-62. Inspections.
A. The director of public works is hereby authorized and
directed to maintain a continuous taxicab safety program regarding all
taxicabs operated within the city. All cabs shall be inspected annually,
within thirty (30) days prior to the issuance 'of an annual license
therefor, and at such other times as the director may deem necessary.
At least five (5) days' notice shall be given to the owner of any taxicab
.ry to be inspected, prior to the date of inspection, advising the place and sY
fi the time of inspection. The director may designate any competent
mechanic to make the inspection. Any taxicab certified to be unsafe by
the mechanic chosen by the director shall not be operated again until
such vehicle has been rendered mechanically safe upon reinspection by
the director of transportation's mechanic.
B. For the annual inspection mentioned in subsection (A) of
this section, the director of public works shall charge and receive the
sum of five dollars ($5.00) for each taxicab to be inspected, such fee to

be paid by the owner thereof at the time of the inspection. Only one
inspection. fee per taxicab shall be payable each year.
M. Section 34-80 of Chapter 34 of the Code of the City of Jefferson,

See. 34.80. Required.
K" It shall be unlawful for any person to engage in the operation of
a taxicab business, unless such person shall have first obtained from the
city a certificate of convenience and necessity authorizing the holder
thereof to operate a taxicab business;provided, that all persons engaged
in the operation of a taxicab business on December 2, 1980, shall be
presumed to be in an operation which promotes the public convenience
and necessity of the residents of this city, and that any person so

N. Section 34-81 of Chapter 34 of the Code of the City of Jefferson,

Sec. 34.81. Application generally.
Any person not engaged in the business of taxicab business on
December 2, 1980, who desires to obtain a certificate of convenience and
necessity to engage in the operation of a taxicab business shall file a y
tt written application with the director of public works. The application
' : .:. shall state whether the applicant is an individual, partnership,
association or corporation, list the business name and address of the
applicant, the fictitious name, if any, of the applicant, a complete z
description of all vehicles owned by the applicant, which in no event
..:r;. shall be fewer than three (3) four-door vehicles to be used exclusively in
the taxicab operation, proposed to be used by the applicant, a financial t
statement of the applicant and the reason the applicant believes that
the public convenience and necessity of the residents of this city will be <'

promoted if the application is granted and a certificate of convenience ±z•
and necessity is issued. t '

O. Section 34-82 of Chapter 34 of the Code of the City of Jefferson,
__ . Missouri is amended to read as follows:
+' Sec. 8482. Public hearing on application.

A. Upon receipt of an application to obtain a certificate of
ay=r convenience and necessity, the director of public works shall set such
application for a public hearing, after first having given ten (10) days'
notice of the time and place of such hearing to all certified taxicab
companies operating within the city at the time that the application was
` filed with the director.
� ? B. The director of public works shall cause evidence to be
taken at such hearing on the application for a certificate of convenience
and necessity. The applicant and all holders of certificates outstanding
at the time of the hearing shall be given an opportunity to present all
relevant and material evidence bearing on the issue of whether the
public convenience and necessity of the citizens of the city requires the
certification of the applicant to engage in the operation of a taxicab
business. The director of public works, in determining such issue,
should consider, among others, the following factors:

convenience and necessity at the time of the hearing
and the total number of taxicabs being operated by
the holders of these certificates.
2. The ability of the holders of certificates of
convenience and necessity to increase or augment
the number of taxicabs being presently operated.
3. The effect . that the issuance of an additional
certificate might have on the holders of certificates
of convenience and necessity theretofore issued and
presently outstanding.
1 4. The effect that the issuance of a certificate might
have on existing street traffic, the safety of the
public using the streets of the city and traffic
congestion.
5. The number of vehicles owned and proposed for use
by the applicant.
' 6. The financial responsibility of the applicant.
7. The moral and business qualifications of the
.t applicant.

8. The ability of the general public to obtain good and
efficient taxicab service at the time of the hearing
r from presently existing certified taxicab companies.
xf P. Section 34-83 of Chapter 34 of the Code of the City of Jefferson,
Missouri, is amended to read as follows:
Sec. 34-83. Issuance or denial.
After having given all persons appearing at the hearing required
by section 34-92 an opportunity to be heard, the director of public
works shall issue its recommendation, in writing, as to whether the
certificate of convenience and necessity requested by the applicant
should be granted or denied. The director may issue such decision at
the close of the hearing or take the matter under advisement for a
period of not longer than thirty(30) days. The applicant and all present
certified taxicab companies appearing at the hearing shall be notified,
in writing, of the decision of the director of public works. This
E decision shall be final, and no appeal shall be allowed therefrom.

Q. Section 34-84.A of Chapter 34 of the Code of the City of Jefferson,
Missouri, is amended to read as follows:

A. Every holder of a certificate of convenience and necessity
} to conduct the operations of a taxicab business within the city shall at

in such taxicab business by the holder of the certificate of convenient

and necessity, in the minimum amounts of ten thousand dollars
,µ ($10,000.00) for injury or death to any one person, twenty thousand

dollars ($20,000.00)for injuries or deaths from any one accident and ten
thousand dollars ($10,000.00) property damage for any one accident.

R. Section 34-85 of Chapter 34 of the Code of the City of Jefferson,
Missouri, is amended to read as follows:
Sec. 34-85. Transfer.
A certificate of convenience and necessity for a taxicab business
shall not be transferred or assigned,
q � the proposed transferee shall first file their proposed transferor and
,point application with the
director of public works of the city seeking the approval and
permission of such director to make such transfer. If the director finds
that the transferee is properly qualified to conduct a taxicab business,
the director shall approve such transfer application, and it shall not
be necessary for the transferee to prove public convenience and

necessity.
S. Section 34-86 of Chapter 34 of the Code of the City of Jefferson,
Missouri, is amended to read as follows:
Sec. 34-86. Revocation.
Upon notice and hearing, the director of public works may
revoke a certificate of convenience and necessity, for the failure of a
certificate holder to show adequate cause why the certificate of
convenience and necessity should not be revoked for any of the following
reasons:
A. Failure to conduct the taxicab business for a period of
thirty (30) days or longer..
B. Violation of this Code or any ordinances of the city or
statutes of the state.

U. Section 34-126 of Chapter 34 of the Code of the City of Jefferson,

On or before the first day of July of each year each holder of a
taxicab driver's permit shall apply to the director of public works for
`a an annual renewal of such permit and pay a renewal fee of five dollars
($5.00). The director shall then issue a taxicab driver's permit
authorizing the holder thereof to operate a taxicab within the city until
June 30 of the subsequent year if the applicant, at the time renewal of
the permit is sought, holds a currently effective taxicab driver's permit
previously approved; which permit has not been revoked or suspended.

(b), any taxicab driver is found to be mentally, physically or morally

for any reason stated in subsection (a), or if a complaint shall be filed

the director shall set a day for the hearing on the revocation of the

the permit to operate a taxicab within the city should not be revoked.

be imposed for any violation of this section.
