AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, RELINQUISHING
A CERTAIN SANITARY SEWER EASEMENT ON PROPERTY LOCATED AT VON
HOFFMAN PRESS, INC.

WHEREAS, by an easement recorded in Book 335, Page 258, Cole County Recorder
' of Deeds Office, a sanitary sewer easement was granted to the City of Jefferson, a
Municipal Corporation, to excavate within, install, construct, maintain and repair
structures for the routing and conveyance of sewer water in, under and through the
lot, tracts or parcels of land described in Section 1; and
WHEREAS, the Council of the City of Jefferson has determined that this easement
is no longer necessary for public use; '
f BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI
AS FOLLOWS:

Section 1. The Council finds that the following described easement is surplus
property of the City and is no longer needed f or any public purpose:
All that part of a sanitary sewer easement in Section 2, Township 44 North,
Range 12 West, in the City of Jefferson, County of Cole, State of Missouri,
recorded in Book 335, Page 258 of the Cole County Recorder's Office, said

A 20 foot wide strip of land across a part of Fractional Section 2,Township 44
North, Range 12 West, in the City of Jefferson, County of Cole, Missouri, the
centerline of said strip being more particularly described as follows:
From the southwest corner of said Fractional Section 2; thence N86°01'46"E,
along the Section Line, 1363.18 feet to the southwest corner of the Southeast
Quarter of the Southwest Quarter of said Fractional Section 2; thence
N86°06'19"E, along the Section Line, 1370.17 feet, to the southwest corner of
the Southeast Quarter of said Fractional Section 2; thence N86°59'11"E, along
the Section Line, 1358.23 feet to the southerly extension of the westerly line
of NORMAN PLAZA SUBDIVISION, as per plat of record in Plat Book 11,

necessary legal document relinquishing all of the City's interest in the tract of ground
described in Section 1.
Section 4. This ordinance shall be in full force and effect from and after the
date of its passage and approval.

Party of the Second Part that such improvements do not interfere
with or otherwise violate the easement rights granted hereunder,
and Party of the Second Part shall indemnify, defend and hold
harmless Pa rt y of the First Part and be responsible for any
damage to such improvements installed by Party of the First Part
arising out of the exercise or enjoyment of the easement rights
nd granted hereunder.
' PARTY OF THE SECOND PART or its assignee will be responsible
for any damage to crops, trees, shrubbery, fences, improvements,
and the land itself, resulting directly from the activities
authorized under this easement, either by repairing the damage or
' by making a cash settlement with the owner.
