AN ORDINANCE AMENDING CHAPTER 90 OF THE CITY CODE, AS
AMENDED, THE COMPREHENSIVE ZONING ORDINANCE OF THE
CITY OF RICHLAND HILLS, BY CREATING A NEW ZONING
DISTRICT, SPECIFICALLY, THE C-3 MULTI-STORY GENERAL
COMMERCIAL ZONING DISTRICT, ESTABLISHING THE
PERMITTED USES IN SUCH DISTRICT AND THE REGULATIONS
GOVERNING SUCH DISTRICT; RENUMBERING CERTAIN OTHER
SECTIONS WITHOUT SUBSTANTIVE CHANGE; PROVIDING THAT
THIS ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES;
PROVIDING A PENALTY CLAUSE; PROVIDING A SAVINGS CLAUSE;
PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR
PUBLICATION IN THE OFFICIAL NEWSPAPER; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the City of Richland Hills is a home rule city acting under its charter
adopted by the electorate pursuant to Article XI, Section 5 of the Texas Constitution and Chapter
9 of the Local Government Code; and
WHEREAS, pursuant to Chapter 211 of the Local Government Code, the City has
adopted a comprehensive zoning ordinance, codified as Chapter 90 of the City Code, and a
• comprehensive zoning map, regulating the location and use of buildings, other structures and
land for business, industrial, residential or other purposes, and providing for a method to amend
said ordinance and map for the purpose of promoting the public health, safety, morals and
general welfare, all in accordance with a comprehensive plan; and
WHEREAS, the City Council wishes to establish a new zoning district to permit multi-
story commercial development in high-traffic corridors, and to establish permitted uses and
regulations for such district, in order to encourage and permit regional commercial development
in such high-traffic corridors;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF RICHLAND HILLS, TEXAS:
SECTION 1.
AMENDMENT OF SECTION 90-4 TO ADD DEFINITION
OF STRUCTURED PARKING FACILITY
Section 90-4(b) of Article I of Chapter 90 of the Richland Hills City Code, as amended, is
hereby amended by the addition of the following definition:
• Structured parking facility means any facility constructed above grade which
provides or contains facilities for the parking or storage of automobiles or other
vehicles.
The remainder of Section 90-4(b) shall remain unchanged.
SECTION 2.
RENUMBERING OF SECTIONS
The following sections of Chapter 90 are renumbered as provided herein:
Section 90-239 is renumbered as Section 90-240;
Section 90-240 is renumbered as Section 90-241; and
Section 90-241 is renumbered as Section 90-242.
No substantive changes are intended by this renumbering.
SECTION 3.
AMENDMENT OF SECTION 90-239 TO CREATE NEW
C-3 MULTI-STORY GENERAL ZONING DISTRICT
• Anew Section 90-239 of Division 2 of Article VIII of Chapter 90 of the City Code, as
amended, is added to provide as follows:
Sec. 90-239. C-3 multi-story general commercial buildings
The C-3 multi-story general commercial district is established to accommodate those uses
that are of city-wide and regional significance. Within this district are permitted retail, service
and office uses characteristic of retailing and wholesaling markets. This district is intended to
accommodate commercial activities that cannot be accommodated in the C-1 restricted
commercial or C-2 general commercial district.
(1) Permitted uses. Uses permitted in the C-3 district shall be in accordance with the
listed uses in the table set forth in section 90-201.
(2) Area, yard, Izeight and lot coverage. The requirements regulating the minimum lot
size, minimum yard sizes (front, side and rear), maximum building height (stories and feet) and
maximum percent of lot coverage by buildings, as pertains to the C-3district, shall conform with
the provisions provided in the following table:

(3) Lot frontage and depth. There are no lot frontage and depth requirements in the
C-3 district, except where a nonresidential use abuts a residential lot, then the requirement shall
be the same as the adjoining residential zone.
(4) Site plan review. Any lot or tract in the C-3 district upon which is proposed either
a structure or structures thirty-five (35) feet or more in height or a building or buildings totaling
six thousand (6,000) square feet or greater, in the aggregate, will require site plan approval.
(5) Outside storage. No outside storage shall be permitted in the C-3 district, except
as provided in section 90-201.
(6) Height. Maxilnuln building height within the C-3 district shall be the lesser of
ninety (90) feet or six (6) stories.
(7) Masonry. In this district, masonry shall be a surface made of brick, natural stone,
any engineered insulated finish system, stucco, decorative concrete masonry units, and any other
masonry materials approved and constructed in accordance with the applicable building code,
which is attached to an outside wall. The following percentage masonry requirements shall
apply in the C-3 district: On a one story structure:100 percent of the front facade; 85 percent of
sides; and 60 percent of a rear surface not open to public view; on a structure with two or more

• stories: 100 percent on all sides. The area of doors and windows shall not be included when
calculating the exterior surface.
(8) Public service streets. Before a parcel of land which abuts acontrolled-access
highway is zoned as a C-3 district, the city council shall determine whether or not the public
welfare requires the present or future establishments of a public service street along such
highway. If it is found that a public service street is required, such public service street shall be
placed on the official zoning map of the city.
(9) Automobile parizi~zg spaces. Parking space regulations in the C-3 district shall be
as set forth in article IX, division 3 of this chapter.
(10) Screening. Screening requirements in the C-3 district shall be as set forth in article
IX, division 4 of this chapter.
(11) Landscaping. Landscaping requirements for this zoning district shall be governed
by this Chapter and Chapter 48, Landscaping, of this Code.
(12) Sidewalks. Any portion of a lot adjacent to a public right-of--way shall be
developed with a sidewalk six (6) feet in width adjacent tot such public right-of--way.

AMENDMENT OF SECTION 90-201 TO AMEND LAND USE TABLE
The Land Use Table contained in Section 90-201 of Article VII of Chapter 90 of the City
Code, as amended, is hereby amended to provide as follows:

SECTION 4.
AMENDMENT OF SECTION 90-202 TO ADD SPECIAL CONDITION
REGARDING HOTEL STRUCTURED PARKING FACILITIES
Section 90-202 of Article VII of Chapter 90 of the Richland Hills City Code, as amended,
is hereby amended by the addition of the following paragraphs:
0o Any structured parking facility constructed on the site of or adjacent to a hotel and
which is intended primarily to provide parking for such hotel facility shall be no
more than three stories above grade in height, and no more than 35 feet in height.
pp Permitted in the C-3 General Multi-Story Commercial zoning district only when
contained in a hotel facility, with no exterior signage.
The remainder of Section 90-202 shall remain unchanged.
SECTION 5.
ORDINANCE CUMULATIVE
• This Ordinance shall be cumulative of all other Ordinances of the City of Richland Hills
affecting zoning and land use, as amended, and shall not repeal any of the provisions of such
ordinances except in those instances where provisions of such ordinances are in direct conflict
with the provisions of this ordinance.
SECTION 6.
PENALTY
Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to
comply with or who resists the enforcement of any of the provisions of this ordinance shall be
` fined not more than Two Thousand Dollars ($2,000.00) for each offense. Each day that a
violation is permitted to exist shall constitute a separate offense. In addition, any person, firm or
corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the
enforcement of any of the provisions of this ordinance maybe subjected to such civil penalties as
authorized by law.
SECTION 7.
RESERVATION OF RIGHTS AND REMEDIES FOR ACCRUED VIOLATIONS
All rights or remedies of the City are expressly saved as to any and all violations of
Chapter 90, as amended, or any other ordinance affecting zoning and land use that have accrued
at the time of the effective date of this Ordinance and as to such accrued violations and all

• pending litigation, both civil and criminal, same shall not be affected by this Ordinance but may
be prosecuted until final disposition by the Courts.
SECTION 8.
SEVERABILITY
It is hereby declared to be the intention of the City Council that the phrases, clauses,
sentences, paragraphs, and sections of this ordinance are severable, and if any phrase, clause,
sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid
judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not
affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this
ordinance, since the same would have been enacted by the City Council without the
incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph
or section.
SECTION 9.
PUBLICATION
The City Secretary is hereby directed to publish in the official newspaper of the City the
caption, penalty clause, publication clause, and effective date clause of this ordinance as required
by law.
• SECTION 10.
EFFECTIVE DATE
This ordinance shall be in full force and effect from and after its passage and publication
as required bylaw, and it is so ordained.
