WHEREAS, the City Council is considering changes to its Special Flood Hazard Area regulations; and WHEREAS, the City Council, while it is considering changes to its Special Flood Hazard F Q, Area, wishes to prevent, the construction, repair or alteration of any structure in the Special Flood Hazard Area and the accompanying costs, which might not comply with the am ended regulations; and WHEREAS, the City Council has determined that a temporary prohibition on the issuance of building permits on structures in the Special Flood Hazard Area is necessary to preserve the public peace, property, health, safety and morals. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ` JEFFERSON, MISSOURI AS FOLLOWS: ° Section 1. No permit shall be issued for the construction, repair or alteration of any structure in the City of Jefferson which lies in a designated Special Flood Hazard Area. Section 2. For good cause shown, the Planning and Code Enforcement Department may waive the above moratorium on an individual building permit. When requesting a waiver, it shall be the applicant's responsibility to show good cause, which shall include but ` not be limited to evidence that the structure for which the building' g permit is sought suffered ' flood damage less than 20 percent of its pre-flood fair market value. In granting a waiver, the Planning and Code Enforcement Department may impose such conditions as may be x�? necessary to insure that the waiver will not violate the intended purpose of the moratorium. Section 3. This Ordinance shall be in full force and effect from and after its passage t until December 7, 1993, or until the Council passes an ordinance changing the Special Flood Hazard Area regulations, whichever occurs first.
