ORDINANCE NO. 11967
AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, RELINQUISHING
A UTILITY EASEMENT WHICH WAS RETAINED WHEN AN ALLEY IN THE 100
BLOCK OF WEST ASHLEY WAS VACATED.
WHEREAS, it has been shown to the Council of the City of Jefferson, Missouri, that
the owners of land adjacent to and abutting upon a former alley in the 100 block of
West Ashley Street have petitioned the City Council to vacate the utility easement;
and y
WHEREAS, it has further been shown that it would not inconvenience the public or
the citizens of the City to discontinue the utility easement as described in Section 1
of this Ordinance; and
WHEREAS, Ordinance 11839 vacated and discontinued the public use of the property
described in Section 1 of this Ordinance, but retained a perpetual easement for
maintenance; repair, location, relocation and operation of sanitary sewer, surface
water drainage and all public utility facilities; ,
!. NOW, THEREFORE, '
BE IT ENACTED BY THE COUNCIL OF THE CITY OF
JEFFERSON, MISSOURI, AS FOLLOWS:
Section I. The Council finds that the following described easements are
surplus property of the City and are no longer needed for any public purpose:
A portion of a north-south alley being 13.88 feet wide lying between West
Ashley Street and Atchison Street, Washington Street, and Jefferson Street;
being part of a subdivision of Inlots 969 through 976 in the City of Jefferson
County of Cole, Missouri and being more particularly described as follows:
All that portion of a 13.88 foot wide alley bounded on the east by Lot No.'s 5
though 8 and on the west by Lot No. 12 of W. C. Curry's Subdivision
of record in Plat Book 1, Page 11, Cole County Recorder's Office. ' per plat
E Section 2. The easements described in Section 1 are hereby relinquished, and
the City does hereby release and abandon whatever interest it has in the easements.
AN Section 3. The Mayor and City Clerk are hereby authorized to execute any
necessary legal documents relinquishing all of the City's interest in the tract of
t ground described in Section 1.
