AN ORDINANCE AMENDING LYNWOOD MUNICIPAL CODE SECTION 25-70-14 RELATING TO DEVELOPMENT STANDARDS FOR OFF-SITE OUTDOOR ADVERTISING DISPLAYS IN THE CITY OF LYNWOOD Comments: On November 8, 2016, at a duly noticed public hearing, the Planning commission did not take action on this item and continued it to their regularly scheduled meeting on December 13, 2016. (DCE) Recommendation: Table the item and direct staff to re -advertise the public hearing notice for a future yet to be determined City Council meeting after such time that the Planning Commission takes action and provide a recommendation to the City Council regarding the proposed Ordinance. CONSENT CALENDAR All matters listed under the Consent Calendar will be acted upon by one motion affirming the action recommended on the agenda. MINUTES OF PREVIOUS MEETINGS: Regular Meeting — October 18, 2016 Special Meeting — October 18, 2016 Special Meeting — November 1, 2016 10. APPROVAL OF THE WARRANT REGISTER Comments: City of Lynwood warrant register dated November 15, 2016 FY 2016-2017. (FIN) Recommendation: Staff recommends that the City Council approve the warrant register. 11. PROJECT ACCEPTANCE — LYNWOOD CITY PARK OUTDOOR FITNESS ZONE PROJECT, ACCOUNT NO. 1011.60.705 Comments On February 11, 2016, the Notice Inviting Informal Bids was advertised. On March 3, 2016, the City of Lynwood awarded a contract to F.S. Contractors, Inc. through informal bidding process, in the amount of $78,600 for the Lynwood City Park — Outdoor Fitness Zone Project. The City Manager approved two contract change orders for the amounts of $1,085 and $6,625.08. All construction work on the project is now complete. The final construction cost for this project is $86,313.08. The Lynwood City Park — Outdoor Fitness Zone Project was funded by a grant from the Los Angeles County Regional Park and Open Space District and is now ready for acceptance by the City Council. (PW) Recommendation: Staff recommends that the City Council consider the attached resolution entitled, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD ACCEPTING THE LYNWOOD CITY PARK OUTDOOR FITNESS ZONE PROJECT, AS BEING COMPLETE AND AUTHORIZING THE DIRECTOR OF PUBLIC WORKS/CITY ENGINEER TO PROCESS THE RECORDATION OF THE NOTICE OF COMPLETION'. 12. REDWOOD AVENUE AND WALNUT AVENUE STREET IMPROVEMENT PROJECT, PROJECT NO. 4011.68.017 Comments On June 7, 2016, the City Council awarded the Redwood Avenue and Walnut Avenue Construction Contract to COPP Contracting, Inc. The project was partially funded by Measure R Bond and the Community Development Block Grant. The construction of Redwood Avenue and Walnut Avenue is complete and ready for acceptance by the City Council. (PW) Recommendation: Staff recommends that the City Council adopt the attached resolution entitled, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD ACCEPTING THE REDWOOD AVENUE AND WALNUT AVENUE STREET IMPROVEMENT PROJECT, PROJECT NO. 4011.68.017 AS COMPLETE; AND AUTHORIZING THE CITY ENGINEER TO PROCESS THE RECORDATION OF THE NOTICE OF COMPLETION'. 13. VACATION OF CARLIN AVENUE AT OLANDA STREET, OLANDA STREET AND VIRGINIA STREET, STREET IMPROVEMENT PROJECT, PROJECT NO. 4011.68.017 Comments: Staff has received numerous complaints from affected residents regarding unsafe left turns, speeders, cruising and performing doughnuts at the intersection of Carlin Avenue and Olanda Street in the City of Lynwood. Engineering staff has conducted several site visits and inspected the specified intersection. (PW) Recommendation: Staff recommends that the City Council adopt the attached resolution entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD, DECLARING ITS INTENTION TO VACATE SECTION OF CARLIN AVENUE AT OLANDA STREET AND FIXING THE TIME AND PLACE FOR HEARING PROTESTS AND OBJECTIONS, AS DECEMBER 6, 2016, AND PROCEED WITH THE TRAFFIC CALMING MEASURES WITH LANDSCAPED MEDIAN AND RAISED MEDIAN ISLANDS AS PART OF OLANDA STREET AND VIRGINIA STREET, STREET IMPROVEMENT PROJECT, PROJECT NUMBER 4011.68.017". fiC�NI1 tf�i1397-18UAW169=1Y.9; • � Comments Ms. Sheila Gibson filed a claim on September 28, 2016 for an incident which occurred on August 17, 2016. Ms. Gibson states that as she was driving on Josephine Street between Atlantic and Harris, when she drove over a pothole which damaged the two front tires of her 2004 Lexus. She is claiming $160 for the replacement of the tires. (HR) Recommendation After conducting a thorough review of information pertaining to the allegations of the claim, staff has determined that the City has met all criteria that provides immunity in its entirety to the City. Based on the findings, staff recommends that the City Council reject the claim of Sheila Gibson and direct staff to send a standard letter of rejection, in which the claimant will be advised of the rights afforded after the rejection letter is served. iF�yI1f�3i]7itL\��il_[H�9�'��i�llt�Y�7►[H_\:L'�L�S� Comments On September 26, 2016, Mr. Carrillo filed a claim alleging property damage due to a tree branch that fell on his vehicle on September 11, 2016. The vehicle (2003 Jeep Grand Cherokee) was parked in front of the address of 3250 Virginia Avenue in Lynwood, CA. The claimant is seeking his collision deductible of $500. (HR) Recommendation: After conducting a thorough review of information pertaining to the allegations of the claim, staff has determined that the City has met all criteria that provides immunity in its entirety to the City. Based on the findings, staff recommends that the City Council reject the claim of Wilson Carrillo and direct staff to send a standard letter of rejection, in which the claimant will be advised of the rights afforded after the rejection letter is served. 16. CLAIM FOR DAMAGES BY MARIA BARAJAS Comments On September 26, 2016, Ms. Barajas filed a claim for damages alleging property damage due to a tree branch that fell on her vehicle (1997 Honda Passport) on July 20, 2016. The vehicle was parked in front of 4152 Shirley Avenue in Lynwood, CA. The vehicle was deemed a total loss. Its ACV is valued at $1,122.42. (HR) Recommendation After conducting a thorough review of information pertaining to the allegations of the claim, staff has determined that the City has met all criteria that provides immunity in its entirety to the City. Based on the findings, staff recommends that the City Council reject the claim of Maria Barajas and direct staff to send a standard letter of rejection, in which the claimant will be advised of the rights afforded after the rejection letter is served. NEW/OLD BUSINESS 17. PROPOSED URGENCY ORDINANCE RESCINDING THE TEMPORARY INTERIM MORATORIUM ON THE APPLICATION OF THE CURRENT DEVELOPMENT STANDARDS ON THE ACCEPTANCE OF APPLICATIONS FOR THE INSTALLATION, ERECTION, CONSTRUCTION, REPLACEMENT, MODIFICATION, OR IMPROVEMENT OF STATIC OR CHANGING ELECTRONIC, DIGITAL, OR CHANGEABLE MESSAGE BILLBOARDS IN ALL ZONING DISTRICTS Comments On May 17, 2016 the City Council adopted an Urgency Ordinance (Ordinance No. 1680) imposing a 45 -day moratorium on new billboards in the City of Lynwood. On June 21, 2016, the moratorium was extended to December 31, 2016 (Ordinance No. 1684). The purpose of the moratorium was to allow time for staff to prepare revisions to the City Sign Ordinance to address the issue of billboards and off -premises promotional signs. Nonetheless, staff has researched and considered development standards for billboards during this time period, and may proceed with its analysis independent of any moratorium, so as not to impede any City business. The Planning Commission currently has a vacancy, another Commissioner cannot participate in any proceeding involving a sign ordinance, because of potential conflict issues. Therefore there is no certainty as to when the full Planning Commission may consider any proposed sign ordinance in the near future. (CA) Recommendation: 1. Waive reading, read by title only and adopt an urgency ordinance to rescind the temporary moratorium on the application of the current development standards on the establishment and operation of off-site signs and digital billboards. 2. CALL TO ORDER The City Council of the City of Lynwood met in a regular meeting in the Council Chambers, 11330 Bullis Road, Lynwood, CA on the above date at 6:09 p.m. Mayor Hernandez presiding. Item #2. CERTIFICATION OF AGENDA POSTING BY CITY CLERK City Clerk Quinonez announced the agenda had been duly posted in accordance with the Brown Act. Item #3. ROLL CALL OF COUNCIL PRESENT: COUNCIL MEMBERS ALATORRE, SANTILLAN-BEAS, SOLACHE AND MAYOR HERNANDEZ ABSENT: Mayor Pro Tem Castro (Excused absence). STAFF PRESENT: City Manager Beltran, City Attorney Garcia, City Clerk Quinonez, Executive Assistant to City Clerk Betancur and City Treasurer Camacho. PRESENTATIONS/PROCLAMATIONS • Organization of the Month — Lynwood Public Library Angel Nicholas, Library Manager thanked the City Council for the award; commented that the Library had began offering passport services • Sheriff Captain Carter- Update on Law Enforcement Issues Lieutenant Chavez spoke about the upcoming community survey, which will be conducted on December 3`d, reported on the haunted house event and encouraged the community to participate 1 City Council Member Reporting on Meetings Attended Council Member Solache reported having attended the ribbon -cutting ceremony for the bus shelter project, commented that residents would soon see new bus shelters throughout; thanked the Sheriffs office for honoring the late Lucy Gomez by having officers serve as pall -bearers. Council Member Alatorre stated that he had attended the gateway cities Council of Governments meeting where there was a substantial discussion on Measure M; he spoke against Measure M due to the improper distribution of projects and funding. Mayor Hernandez also spoke about having attended the bus shelter ribbon -cutting as well as the ground -breaking ceremony for the new city hall annex. Item #7. CITY OF LYNWOOD AS THE SUCCESSOR AGENCY TO THE LYNWOOD REDEVELOPMENT AGENCY time MOTION: It was moved by Council Member Solache, seconded by Council Member Alatorre to recess to the City of Lynwood as the Successor Agency to the Lynwood Redevelopment Agency at 6:29 p.m. Motion carried by unanimous consent. The City Council recessed to the Successor Agency meeting at 6:29 p.m. The City Council reconvened to the regular City Council meeting at 6:30 p.m. PUBLIC ORAL COMMUNICATIONS (Regarding Agenda Items Only) NONE NON -AGENDA PUBLIC ORAL COMMUNICATIONS Harry Gibbens spoke about the armory property stating that the property would be helpful to the city; suggested that the City could make an offer to buy the property for a dollar; stated that this property would be used to complement the city Hall annex or that perhaps have the state donate it to the city. Mr. Gibbens also spoke against the cannabis proposal due to the impact on the community in general in particular children and youth. Ya City Manager Beltran stated that the City was currently exploring options on such property. Joanna Kelly spoke about the previous meetings and how we should be respectful to one another; stated that she was in favor of free speech; spoke about how close Lynwood was to bankruptcy and urged residents to support Measure PS and RD and to think about what the City could accomplish with the penny tax; encouraged people to look at the penny tax and get informed. CITY COUNCIL ORAL AND WRITTEN COMMUNICATIONS Council Member Alatorre made brief comments relative to the election and emphasized how important it was for everyone to vote; that he fully supports Measure PS and Measure RD; however; that he was against most of the other measures on the ballot. Council Member Solache also commented on the issue of Measure PS and Measure RD and urged citizens to support it. Council Member Santillan-Beas spoke briefly about the community's sadness on the passing of long-time resident Lucy Avalos who had been a great supporter of the City and did a lot for the community; spoke about the importance of voting on local issues because the majority of local decisions are made at the local level. Mayor Hernandez stated that he concurred with the comments made earlier by one of the residents relative to mutual respect and the decorum of both the public and those elected when presiding at the Council meeting; he further commented that respect needed to come from both sides; that just as community members often remind the Council not to act like those officials in other cities; the Council too does not want residents to act like the folks in those cities either as it relates to respect or the lack of. Elias Saikaly, Senior Public Works Manager SUBJECT: Project Acceptance Lynwood City Park Outdoor Fitness Zone Project Account No. 1011.60.705 Recommendation: Staff recommends that the City Council consider the attached resolution entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD ACCEPTING THE LYNWOOD CITY PARK OUTDOOR FITNESS ZONE PROJECT, AS BEING COMPLETE AND AUTHORIZING THE DIRECTOR OF PUBLIC WORKS/CITY ENGINEER TO PROCESS THE RECORDATION OF THE NOTICE OF COMPLETION". Background: In August 2012, the City Council approved the acceptance of grant funds from Los Angeles County Regional Park and Open Space District in the amount of $160,000 for the construction of the Lynwood City Park Outdoor Fitness Zone Project. On February 11, 2016, the Public Works Department placed a Notice Informal Inviting Bids for the construction of the Fitness Zone project. Accordingly, on March 3, 2016, the City awarded a contract to F.S. Contractors, Inc., in the amount of $78,600 for the construction of the Lynwood City Park — Outdoor Fitness Zone Project. The City Manager approved two contract change orders for the amounts of $1,085 and $6,625.08. All construction work on the project is now complete. The final construction cost for this project is $86,313.08. The Lynwood City Park — Outdoor Fitness Zone Project is now ready for acceptance by the City Council. ITEM 11 Discussion & Analysis: The construction on the Lynwood City Park — Outdoor Fitness Zone started on July 11, 2016 and was completed on August 23, 2016. Staff conducted the final inspection on August 23, 2016 and found that all work was completed in accordance with the project plans and specifications. As such the Committee has allocated $239,000 for the Redwood Avenue; from state Street to peach Street and Walnut Avenue; from Spruce Avenue to Birch Street. This project entails the rehabilitation of the street pavement, damaged curbs and gutters, driveway approaches, sidewalks, wheelchair ramps, pavement striping and signs. 3ENDA ITEM IZ The construction on Redwood Avenue; from State Street to Peach Street, and Walnut Avenue; from Birch Street to Bullis Road, started on June 27, 2016 and it was completed on August 11, 2016. Staff conducted the final inspection on August 29, 2016 and found that all work is complete in accordance with the project plans and specifications and it is now ready for acceptance by the City Council. Fiscal Impact: During the course of the construction, it was necessary to lower the existing street grade and minimize the crown and the cross fall on Redwood Avenue. In addition, the City requested to replace most of the water valve covers and to remove and construct new sidewalks and drive approaches. Background: Staff has received numerous complaints from affected residents regarding unsafe left turns, speeders, cruising and performing doughnuts at the intersection of Carlin Avenue and Olanda Street in the City of Lynwood. Olanda Street from Gibson Street to Carlin Avenue and Virginia Street; from Bullis Road to Thorson Avenue, Street Improvement Project is listed in the FY 2015-16 Capital Improvement Program Public Works Engineering staff has conducted several site visits and inspected the specified intersection and has reported the followings; 1. Carlin Avenue at Olanda is 72 feet wide and ends at an alley in Compton that is 20 feet wide; our typical standard residential streets are 40 feet wide. ITEM 0 2. Tire marks are evidence of numerous doughnuts at the intersection of Carlin Avenue and Olanda Street. 3. Due to the extreme width of Carlin Avenue, staff has witnessed many unsafe left turns from Olanda Street onto Carlin Avenue northbound. 4. Currently, there is only one Stop Sign at Carlin Avenue traveling southbound. Therefore, traffic traveling eastbound on Olanda has tendency to speed through the intersection. Given the above, the City requested a Special Study for a proposed Traffic Calming measure and Street Vacation from Infrastructure Engineers, a consulting engineering firm. Discussion & Analysis: The consulting engineering firm has presented to the City with a suggested traffic calming design measure which includes the construction of a new landscaped Median Island on Carlin Avenue, with a City monument sign, and raised median islands along Olanda Street (see attached photo). Also, the consulting engineering firm has provided the City with an option of vacating sections of Carlin Avenue at the City of Compton alley which includes all required Legal Description for both sides of the street at its most southerly end at Olanda Street (see Legal Description data sheet). Vacating these unnecessary portions of the right-of-way will narrow the roadway, and collectively, with all of the proposed improvements, help prevent vehicular "doughnuts" from occurring at this intersection, and promote safer turns. It will also reduce the City's long-term street maintenance costs and provide additional land for the neighboring properties to enjoy. Staff is recommending to proceed with the traffic calming measures by diverging the width of Carlin Avenue from 72 feet wide to 20 feet wide at its most southerly end at the City of Compton alley way. Fiscal Impact: There is no significant cost for the street vacation except for their recordation with the County Recorder's office; which should be around $200. Background: Ms. Sheila Gibson filed a claim on September 28, 2016 for an incident which occurred on August 17, 2016. Ms. Gibson states that as she was driving on Josephine Street between Atlantic and Harris, when she drove over a pothole which damaged the two front tires of her 2004 Lexus. She is claiming $160.00 for the replacement of the tires. Discussion & Analysis: Liability is doubtful in this matter. An inspection of the loss location by the City's Department of Public Works revealed that potholes were repaired on April 7, 2016. The City may argue that this incident took place in an area where many vehicles travel through daily. The claimant is the only person to have filed a claim as a result of the alleged pothole. Other than the potholes which were repaired in April 7, 2016, the City received no prior complaints regarding the area and it is unknown how long the alleged pothole may have been in existence. The claimant must prove that the City had actual notice which is actual knowledge or a report, that a defect exists but takes no corrective measures before the accident occurs. The issue is whether the City had constructive notice of the pothole in time to correct it. To prove that there was constructive notice, the claimant must prove that the City knew of the dangerous condition by a reasonable inspection system which would reveal the dangerous condition. In determining whether an inspection system is reasonable, the City may co side AGENDA practicality and cost of the system and balance those factors against the likelihoo an0iiEM seriousness of the potential danger if no such system existed. If the City of Lynwood did not detect the dangerous condition, it ("City") may consider whether it used reasonable care in maintaining and operating the system. In our experience the Public Works acts promptly when notified of a potential situation. There are no prior indications that the tree was diseased or weakened. Prior to this date the City received no complaints regarding the tree. Pursuant to Government Code Section 835 the claimant must establish that the tree posed a dangerous condition at the time of the incident. Garcia, City Attorney SUBJECT: Proposed Urgency Ordinance rescinding the temporary interim moratorium on the application of the current development standards on the acceptance of applications for the installation, erection, construction, replacement, modification, or improvement of static or changing electronic, digital, or changeable message billboards in all zoning districts. Alternatives: 1. Waive reading, read by title only and adopt an urgency ordinance to rescind the temporary moratorium on the application of the current development standards on the establishment and operation of off-site signs and digital billboards. 2. Take no action and allow the moratorium to lapse on December 31, 2016 Background: On May 17, 2016 the City Council adopted an Urgency Ordinance (Ordinance No. 1680) imposing a 45 -day moratorium on new billboards in the City of Lynwood. On June 21, 2016, the moratorium was extended to December 31, 2016 (Ordinance No. 1684). The purpose of the moratorium was to allow time for staff to prepare revisions to the City Sign Ordinance to address the issue of billboards and off - premises promotional signs. Nonetheless, staff has researched and considered development standards for billboards during this time period, and may proceed with its analysis independent of any moratorium, so as not to impede any City business. The Planning Commission currently has a vacancy, another Commissioner cannot participate in any proceeding involving a sign ordinance, because of potential conflict issues. Therefore there is no certainty as to when the full Planning Commission may consider any proposed sign ordinance in the near future. CC Report- Billboards 1 Ordinance - Moratorium Rescission ITEM /1 Discussion & Analysis: City staff has spent approximately seven and one-half months reviewing the City's Municipal Code to determine how to properly regulate billboards and billboard structures. The city had adopted an Interim Ordinance under Government Code Section 65858 to prohibit any use that may be in conflict with any contemplated zoning proposal. On May 17, 2016, the City Council passed Ordinance No. 1680, establishing a forty-five (45) day moratorium on the acceptance of applications for the installation, erection, construction, replacement, modification, or improvement of static or changing electronic, digital, or changeable message billboards within any zoning district in the City, and then extended this moratorium to December 31, 2016. City Staff can continue to monitor any detrimental effects of electronic message center signs, including light pollution, maintenance problems, and decreasing property values that may result from an overconcentration of electronic message center signs. The City currently has regulations to address how the City should regulate electronic message center signs. The City wishes to ensure that any new and current electronic message center and off-site signs continue to contribute to the economic well-being of the City while avoiding problems that could arise from oversaturation or lack of planning in a particular area. At a future date, the City Staff may propose draft regulations to achieve desirable and appropriate municipal sign regulation. A city may adopt an Interim Ordinance under Government Code Section 65858 that prohibits any use that may be in conflict with a contemplated zoning proposal that the legislative body, Planning Commission, or Planning Division is considering, studying, or intending to study within a reasonable time. The ordinance must be passed by a four-fifths (4/5) majority vote of the City Council and would be effective immediate thereafter. The moratorium did afford City Staff time to research and assess development standards, areas that are appropriate for new billboard signs in the City, and to consider solutions to problems that are commonly associated with billboard signs. Nonetheless, at this point, Staff may continue with this research independent of a moratorium. The current moratorium may be rescinded then to permit the consideration of applications and any requested building permit. CC Report- Billboards 2 Ordinance - Moratorium Rescission ENVIRONMENTAL: The adoption of the ordinance rescinding the moratorium is exempt from CEQA for two different reasons. First, pursuant to CEQA Guidelines 15061 (b)(3) the ordinance is exempt from CEQA because it can be seen that rescinding this ban will not have a negative impact on the environment. Next, the rescission of the moratorium is not a project as defined under Section 15378 of the CEQA Guidelines because it has no potential for resulting in physical change in the environment, directly or ultimately. SUBSEQUENT ACTION(S): City staff will continue to research the most optimal means to regulate, establish, and operate electronic message center signs in the City, which may require further action by the City Council at a future date. WHEREAS, until the existing moratorium expires on December 31, 2016, or is rescinded earlier by action of the City Council, the development standards currently in place cannot be applied to any new applicant and to existing signs: THE CITY COUNCIL OF THE CITY OF LYNWOOD HEREBY ORDAINS AS FOLLOWS: CC Report -Billboards 4 Ordinance- Moratorium Rescission Section 1. Recitals Made Findings. The above recitals are hereby declared to be true and correct findings of the City Council of the City. Section 2. Rescission of Moratorium. In accordance with Government Code section 65858(a), this Urgency Ordinance rescinds the moratorium imposed by Ordinance No. 1684, prohibiting the establishment and operation of new billboard signs and billboard structures within the city's boundaries. After the effective date of this Ordinance, the City may use the current development standards and regulations to control the issuance of permits or licenses for all off- site signs, off-site electronic billboard signs and billboard structures within the boundaries of the City. Section 3. California Environmental Quality Act ("CEQA"). Pursuant to Section 15001 of the CEQA Guidelines, the Ordinance is exempt from CEQA based on the following: (1) This Ordinance is not a project within the meaning of Section 15378 of the State CEQA Guidelines because it has no potential for resulting in a direct or indirect physical change in the environment. (2) This Ordinance is not subject to CEQA under the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment. For the reason set forth in subparagraph (1), above, it can be seen with certainty that there is no possibility that this Ordinance will have a significant effect on the environment. Section 4. Severability. If any provision or clause of this ordinance or the application thereof to any person or circumstances is held to be unconstitutional or otherwise invalid by any court of competent jurisdiction, such invalidity shall not affect other provisions or clauses or applications of this ordinance that can be implemented without the invalid provision, clause, or application; and to this end, the provisions of this ordinance are declared to be severable. Section 5. Effective Date and Duration. This Ordinance shall become effective upon adoption if passed and adopted by at least four-fifths (4/5) vote of the City Council. Section 6. Certification. ANSWER: Yes. The City may remove from the meeting any speaker who actually disrupts or impedes a meeting. DISCUSSION: In the case entitled Dowd v. City of Los Angeles, Case No. CV 09-06731 DDP (SSx) (C.D. Cal. Aug. 7, 2013), Matt Dowd and David "Zuma Dogg" Saltsburg challenged the constitutionality of Los Angeles's Rules of Decorum, after they were banned from the city meetings because, in part, of their use of some profanity directed at the council presiding official. Dowd and Saltsburg challenged the application of the Rules of Decorum, prevailed in court, and were awarded one dollar each in nominal damages. The court ruled that the Rules of Decorum are constitutional only when there is an actual disruption beyond a per se breach of the Rules. Prior courts which have considered rules of decorum have ruled that once opened, meetings are regarded as public forums. "albeit limited ones." White v. City of Norwalk, 900 F.2d 1421, 1425 (9th Cir. 1990). "A council can regulate not only the time, place, and manner of speech in a limited public forum, but also the content of speech - as long as content -based regulations are viewpoint neutral and enforced that way." Norse v. City of Santa Cruz, 629 F.3d 966, 975 (9th Cir. 2010). Nonetheless, rules of decorum are constitutional if they "only permit[] a presiding officer to eject an attendee for actually disturbing or impeding a meeting." Acosta v. City of Costa Mesa, 718 F.3d 800, 811 (2013) (quoting Norse, 629 F.3d at 976). LYNWOOD'S RULES OF DECORUM: The City's Ordinance 2-1.5 "Rules of Decorum for City Council Meetings" provides the following rules for the efficient and fair conduct of meetings: • .Each person who addresses the City Council shall do so in an orderly manner and shall not make impertinent or profane remarks. • Any person who utters loud, threatening or abusive language, or who engages in any other disorderly conduct at any City Council meeting shall be subject to removal or ejection from the City Council meeting. • No person in the audience at a City Council meeting shall engage in disorderly or boisterous conduct, including whistling, stamping of feet or other acts which disturb, disrupt or otherwise impede the orderly conduct of any City Council meeting. • No person shall address the City Council without first being recognized by the presiding officer. • Persons addressing the City Council shall observe the following procedures: o Each person shall step to the podium provided for the use of the public and shall state his or her name and address; the organization, if any, which is represented; and if during the first "public oral communications" portion of the meeting, the agenda item desired to be discussed. o During the first "public oral communications" portion of the meeting, any subject discussed which the city council determines is not relevant to an agenda item shall be concluded. o Each person addressing a specific city council agenda item shall confine his or her remarks to such agenda item. o The remarks of each person addressing nonagenda items shall be limited to three (3) minutes, unless additional time is granted by the presiding officer. o All remarks shall be addressed to the city council as a whole and not to any single member thereof, unless in response to a question from such member o No question may be asked of a member of the city council or of the city staff without permission from the presiding officer. THE CITY HAS AN INTEREST IN THE SMOOTH FUNCTION OF MEETINGS The City of Lynwood has an interest in the smooth function and timeliness of the process of City Council Meetings. The power to determine when a disruption has occurred has been placed in the hands of the moderator. Norwalk, 900 F.2d at 1426 ("The role of a moderator involves a great deal of discretion.") Well-settled law gives great discretion to presiding officers in enforcing reasonable rules for the orderly conduct of meetings. Kindt v. Santa Monica Rent Control Board, 67 F.3d 266, 269 (9th Cir. 1995). Council "does not violate the first amendment when it restricts public speakers to the subject at hand," and a chair of a meeting may stop a speaker "if his speech becomes irrelevant or repetitious." Kindt, 67 F.3d at 270 (quoting White, 900 F.2d at 1425). Courts have upheld reasonable, content -neutral restrictions on speech in limited public forums include restricting comments to the subject matter pertinent to the agency, confining meetings to specified subject matter, and limiting the speaking time for public comment. Baca v. Moreno Valley Unified School Dist., 936 F.Supp. 719, 729 (C.D. Cal. 1996). Permissible restrictions of that sort also further the agency's "legitimate interest in conducting efficient, orderly meetings." For example, the Library Commission could properly limit public comment on each agenda item at a meeting of the commission to two minutes per speaker, instead of the three minutes normally allotted to each speaker. Chaffee v. San Francisco Public Library Com., 134 Cal App 4th 109 (2005). Similarly, a legislative body of local agency may prohibit members of public, who speak during time permitted on agenda for public expression, from commenting on matters that are not within subject matter jurisdiction of legislative body. 78 Ops. Cal. Atty. Gen. 224. "A speaker may disrupt a Council meeting by speaking too long, by being unduly repetitious, or by extended discussion of irrelevancies. The meeting is disrupted because the Council is prevented from accomplishing its business in a reasonably efficient manner." White, 900 F.2d at 1426. In the White case, a citizen wasejected from city council meetings for refusing to stop talking after council members ruled him out of order for being unduly repetitive. The court noted concerns about the efficient administration of municipal business, and concluded that: "[A] City Council meeting is still ... a governmental process with a governmental purpose. The Council has an agenda to be addressed and dealt with." White, 900 F.2d at 1426. Another court decided that the mayor and city officials did not violate a citizen's First Amendment rights by ejecting him from two municipal meetings—one in which he paraded around the city council chambers in protest and another in which he silently gave a Nazi -style salute. Norse v. City of Santa Cruz, 586 F.3d 697 (9th Cir. 2009). CONCLUSION: Overall, the courts have held that certain content -based restrictions, such as those limiting public comment to the agenda item at hand, prohibitions against boisterous conduct that disrupts meetings, do not violate the First Amendment and that speakers can be cut off for being repetitious, irrelevant, or disruptive as long as they are not targeted because officials disagree with their views.
