AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING
THE MAYOR AND CITY CLERK TO EXECUTE A CONTRACT WITH GOOCH
ELECTRIC FOR ELECTRICAL ADDITIONS AND ALTERATIONS AT THE JOHN
G. CHRISTY MUNICIPAL BUILDING.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
Section 1. The Mayor and Clerk are hereby authorized and
directed to execute a contract with Gooch Electric for electrical
additions and alterations at the John G. Christy Municipal Building
for the sum of $2,067.00.
Section 2. The contract shall be substantially the same in form
and content as that contract attached hereto as Exhibit A.
Section 3. This Ordinance shall be in full force and effect from
and after the date of its passage and approval.

FOR
THE CITY OF JEFFERSON, MISSOURI
This contract is entered into this � u day of �-
2.983, by and between the City of Jefferson, Missouri, hereinafter
called the City, and Gooch Electric , hereinafter
called the Contractor.
WHEREAS, the City Council of the City of Jefferson, Missouri,
did on the (�� day of I, ', 19-63 , award to the
Contractor the contract for Additional Offices for Parks and
Recreation at the John G. Christy Municipal Building.
NOW, THEREFORE, for and in consideration of the awarding of
this contract and the work thereunder by the City to the Contractor,

the said Contractor does hereby contract and agree to do and perform
said work, above specified and referred to and to accept payment
therefor in the following manner:
Lump sum of $2 ,067. 00 upon completion
NOW, BY THESE PRESENTS, it is agreed and understood by the
parties hereto, and this contract is entered into subject to all
existing ordinances, plans and specifications for such work on
file in the office of the City Clerk, and which shall be considered
a part and parcel of this contract; that all questions arising as
to the proper performance of this contract of such work in accordance
with the plans and specifications therefor, and estimates thereof,
shall be decided by the Director of Planning and Code Enforcement,
® of the City of Jefferson, Missouri, or by such competent persons

appointed by the Mayor and the City Council of the City of Jefferson
to supervise and superintend said, work in the place of and instead
of such Director of Planning and Code Enforcement; that in the
case of improper workmanship, the City of Jefferson reserves the
right at any time to suspend, re-let or order an entire reconstruction
of the work; that the Contractor agrees to commence work on or be-
fore a date to be specified in a written "Notice to Proceed" and to
fully complete the project work covered by the Contract within
thirty (30) consecutive working days after the date established in
the Notice to Proceed. The City reserves the right at any time
to suspend, re-let or order an entire reconstruction of the work
awarded and to declare the contract forfeited; but that such suspen-
sion, re-letting or reconstruction or forfeiture shall not affect
the right of the City to recover all damages and penalties accuring
or due it by reason of the Contractor' s non-compliance with this
contract. Liquidated damages of fifty ($50. 00) dollars per day will
be assessed against the Contractor for each day the work covered
by the Contract remains incomplete following the completion date or
extension thereof.
The Contractor agrees to pay all classes and crafts of labor
used in the performance of this contract the prevailing hourly
rate of wages as determined by the Department of Labor and Industrial
Relations and Second Party acknowledges that he knows the prevailing
hourly rate of wages for all classes and crafts of labor to be
used in the performance of this contract because he has obtained the
prevailing hourly rate of wages from the contents of Special Wage
Determination No. 3-026-100, in which the rate of wages are set
forth.

The Contractor further agrees that he will keep an accurate
record showing the names and occupation of all workmen employed
by them in connection with the work to be performed under the terms
of this contract, which record shall show the actual wages paid to
each of said workmen in connection with the work to be performed
under the terms of this contract, and agrees further that the
aforementioned accurate record shall be available and open at all
reasonable hours for the inspection by the Director of Planning and
Code Enforcement or any other authorized employee of the City of
Jefferson, Missouri. In compliance with -the Prevailing Wage Law,
as amended in Section 290. 210 and 290. 340 inclusive, Revised Statutes
of Missouri, 1969, effective October 13, 1969, not less than the
prevailing hourly rate of wages in the Jefferson City area shall be
paid to all workmen performing work under this contract, Section
290. 250. The Contractor shall forfeit to the City ten ($10. 00)
dollars for each workman, employee, for each calendar day, or portion
thereof, such workman is paid less than the stipulated rates for
\ any work done under this contract, by him or by subcontractors
under him, Section 290. 250.
The Contractor agrees to completely indemnify and hold harmless
the City for any and all damages, injuries, actions, costs, attorney' s
fees and all other expenses whatsoever arising out of the performance
of said 'work whether the property or persons damages are the
servants and employees of the Contractor, or third parties in no
manner connected with said work. All interlineations, corrections,
deletions and changes herein have been made prior to the execution
of this contract.

Contractor shall procure and maintain during the life of this contract:
a. Workman's Compensation Insurance for all of its employees to be
engaged in work under this contract.
b. Contractor's Public Liability Insurance in the amount not less
than $800,UM for all claims arising our of a single occurence
and $100,000 for any one person in a single accident or occur-
rence, except for those claims governed by the provisions of the
Missouri Workman's Compensation Law, Chapter 287, RSMo. , and
Contractor's Property Damage Insurance in an amount not less
than $800,000 for all claims arising out a single occurrence
and $100,000 for any one person in a single accident or
occurrence.
c. Automobile Liability Insurance in an amount not less than
$800.,000 for all claims arising out of a single occurrence and
$100,000 for any one person in a single accident or occurrence.
d. Owner's Protective Liability Insurance. The Contractor shall
also obtain at its own expense and deliver to the City an
Owner's Protective Liability Insurance Policy naming the City of
Jefferson as the insured in an amount not less thafi $800,000
for all claims arising our of a single occurrence and $100,000
for any one person in a single accident or occurrence. No policy
will be accepted which excludes liability for damage to under-
ground structures or by reason of blasting, explosion or
collapse
e. The Certifications of Insurance furnished to the City showing
proof of compliance with these insurance requirements shall
contain a provision that coverage under such policies shall not
be cancelled or materially changes until at least (15) fifteen
days prior written notice has been given to the City.
IN WHITNESS WHEREOF, the parties have hereunto set their hands

1) An allowance of $50.00 was provided for a seal
spot, per 7 of attached addendum #2. Accrual
cost for this fixture is $83. 00. The contractor
is requesting an addition to the contract for
the difference in price for this fixture per
attached proposal.
An allowance of $200.00 was provided for 4 planter
lights per No. 8 of attached addendum No. 2.
Accrual cost for these fixtures is $380.00.
The contractor is requesting an addition to
the contract for the difference in price for
these fixtures, per attached proposal.
2 ) I have requested the contractor to figure a
price to install two flourescent fixtures in
Storage Room 102, to provide additional light
in dark areas of this room. These fixtures
were removed with the addition of the office
area for Parks and Recreation. The contractor
will install these fixtures per attached pro-
posal.
ADDENDUM NO. 2

(1) Range Outlet, Lunch Room #215 - Delete the word flush from
the second sentence and insert the word surface in its place.
As a clarification of this circuit it shall be a 40 amp circuit
in a 3/4" conduit with two #8 and one #10 THHW.
Include in Item #3
(2) Receptacle, Council Chambers, Room #201 - As discussed at the
walk-through, provide wire mold under council table to center
of table, provide a junction or extension box at this location.
Feed new receptacle down and out through wood structure to center
of kick plate on the front side of the council table.
(3) As discussed at the walk-through and not included in the original
specifications, add Item #8.
Add one r..eceptale in short wall in Room #137. Feed new receptacle
from existing receptacle on the opposite side of this wall.

(4) Add the .following Item #9 - Relocate IBM Copier II machine
receptacle from Room #132 to Plan Room #127. Use the existing
circuit, breaker and receptacle. Pick circuit up above ceiling
in Room #127 and drop straight down inside of wall at this
location. The copy machine shall be located directly below
Panel LB located in Room #127.
(5) As an addition to Item #2, the Contractor has the option to
provide two (2) Keene MPH2G6D2U4 fixtures, with two 40 watt
R.S.U. lamps, recessed mounting and low energy ballasts.
(6) Three-way switch, Council Chambers, Room #201 - Additional
information: Wire three-way switch into dimmer Module #2.
Wiring diagram will be provided for connections to this
i module to the successful bidder.
(7) Seal Spotlight, Council Chambers, Room #201 - Delete last two
sentences from this item. Insert the following: Provide
new dimmer switch at same location as existing dimmer switches
to control spotlight. Fixture type has not been selected.
However, an allowance of fifty ($50. 00) dollars shall be included
in the bid for this fixture. Fixture type to be recessed. Figure
all wiring, ceiling cutting and all work to accommodate this
fixture. The allowance shall be adjusted plus or minus in a
change order, if necessary. The successful bidder shall show
proof of actual cost for the fixture selected from which
adjustments will be made, if required.
4 (8) Planter Lights, Room #133 - Fixture type has not been selected. An
allowance of two hundred ($200. 00) dollars shall be included in the
® bid for these fixtures. There will be four (4) fixtures of this type.
The Contractor shall furnish all other materials and labor to complete
this item.
