FOR GRADING, SEEDING, STORM DRAINAGE, SITE PREPARATION FOR A 1,000 FOOT RUNWAY EXTENSION WITH PARALLEL TAXIWAY FOR R/W 12/30 AT THE JEFFERSON CITY MEMORIAL AIRPORT. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. The Mayor and Clerk are hereby authorized and directed to execute a contract with Twehous Excavating Company, Inc. for the grading, seeding, storm drainage, site preparation for a 1,000 foot runway extension with parallel taxiway for R/W 12/30 at the Jefferson City Memorial Airport for the sum of $214,031.52. Section 2. The contract shall be substantially the same in form and content as that contract attached hereto as Exhibit A. :section 3. Memorial Airport Project No. 3-29-0036-02 + THIS -AGREEMENT, made and a tered into this day of ricUi, 19M by and between the City of Jefferson, Missouri , Party of the First Part, hereinafter referred to as the "Owner", and Party of the Second Part, hereinafter re rre to as the "Contractor", for the construction of grading a NNW-SSE runrday safety area 600' X 20001 , at the Jefferson City Memorial Airport. a WITNESSETH: ARTICLE 1 . It is hereby mutually agreed that for and in consider- , ation of the payments as provided for herein to the Contractor by the ! Owner, the said Contractor shall furnish all labor, equipment, and material and shall perform all work necessary to complete the improve- '• ! cents in a good and substantial manner, ready for use, and in strict !� accordance with this contract., a copy of which is filed pursuant to law in the office of the legal representative of the Owner. ARTICLE 2. It is hereby further agreed that in consideration of the faithful performance of the work by the Contractor, the Owner shall pay the Contractor the compensation due him by reason of said faithful performance of the work, at stated intervals and in the amount certified by the Engineer, in accordance with the provisions of this , Contract. ARTICLE 3. It is hereby further agreed that, at the completion of the work andits acceptance by the Owner, all sums .due the Contractor ' by reason of his faithful performance of the work, taking into consider- j ation additions to or deductions from the contract price by reason of , "Force Account" work authorized under this contract in accordance with the provisions of this contract, will be paid the Contractor by the Owner after said completion and acceptance. ARTICLE 4. It is hereby further agreed that any reference herein to the"Contract" shall include all "Contract Documents" as the same are listed and described in Paragraph 1.02 of the Special Conditions issued in connection with the City of Jefferson Memorial Airport. The undersigned further agrees that if awarded the contract, he WIT commence the work within ten (10) calendar days after the receipt of a notice to proceed and that he will complete the work within sixty (60) working days after the receipt of notice to proceed. No work may be done when the temperature is below 40 degrees, except at the discretion of the engineer. An extension of time may be allowed when extra or additional work is ordered by the engineer. A working day is defined as any day on which the major portion of the work may proceed for not less than six hours during the normal working day (Saturdays and Sundays not included). ARTICLE 6. To satisfy Clean Air and Water Pollution Control Requirements on all Construction Contracts and Subcontracts exceeding $100,000, Contractors and Subcontractors agree: 1. That any facility to be used in the performance of the contract or to benefit from the contract is not listed on the Environmental Protection Agency (EPA) List of Violating facilities., 2. To comply with all the requirements of Section 114 of the Clean Air Act and Section 308 of the Federal Water Pollution Control Act and all regulations issued thereunder. 3. That as a condition for award of a contract he shall notify the awarding official of the receipt of any communication from the EPA indicating that a facility to be utilized for performance of or benefit from the contract is under consideration to be listed on the EPA List of Violating Facilities. 4. To include or cause to be included in any contract or subcontract which exceeds $100,000 the aforementioned criteria and requirements. ARTICLE 7. As an evidence of good faith in submitting this proposal , the undersigned encloses a certified check or bid bond in the amount of $2 52 which, in case he refuses or fails to accept an award and o enter into a contract and file the required bonds within the prescribed time, s.hallbe forfeited to the City of Jefferson, Missouri as liquidated damages. ARTICLE 8• By entering into this contract, the contractor certifies that neither it (nor he or she) nor any person or firm who has an interest in the contractor's firm is a persons or firm ineligible to be awarded Government contracts by virtue of section 3(a) of the Davis-Bacon Act or 29 CFR 5. 12(a)(1 ). No part of this contract shall be subcontracted to any person or firm ineligible for award of a Government contract by virtue of section 3(a) of the Davis-Bacon Act or 29 CFR 5. 12(a)(1 ). ARTICLE 9. The undersigned hereby declares that the only parties interested in this proposal are named herein, that this proposal is made without collusion with any other person, firm, or corporation, that no member of the Council , officer or agent of the City of Jefferson, Missouri is directly or indirectly financially interested in this bid.
