AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI , GRANTING AN ELECTRIC UTILITY EASEMENT TO MISSOURI POWER AND LIGHT COMPANY. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. The following electric utility easement is granted to Missouri Power and Light Company: Beginning at the most Southwesterly corner of said Inlot 468; thence S 470 30' 35" E, alono, the Southwesterly Line of said Inlot, 37.47 feet; thence N 42 08' 25" E, 25.0 feet; thence N 470 30' 35" W, 31.47 feet to the Northwesterly Line of said Inlot; thence S 42 08' 25" W, along said Northwesterly Line, 25.0 feet to the point of beginning. Section 2. The Mayor and City Clerk are authorized to execute the easement 'in substantially the same form and content as the easement attached hereto as Exhibit A. Section 3. This ordinance shall be in full force and effect from and after its passage and approval. Passed Approved Prey ding Officer Mayor ATTEST: .4 tSLt.UZ�� City Clerk ELECTRIC UTILITY EASEMENT For and in consideration of the sum of One and other considerations Dollars ($ 1.00 ) , receipt of which is hereby acknowledged, the undersigned City of Jefferson Grantor(s) herein, do(es) hereby grant, convey and warrant unto MISSOURI POWER & LIGHT COMPANY, a Missouri corporation, and to its successors and assigns, the perpetual easement and right to install, rebuild, operate and maintain underground electric lines, cables, capacitors, switchgear, transformers and appurtenant facilities, for the transmission and distribution of electric energy under, on and through certain lands owned by Grantor(s) situated in the County of Cole, State of Missouri, described as follows: Beginning at the most Southwesterly corner of said Inlot 468; thence S 47° 30' 35" E, along the Southwesterly Line of said Inlot, 37.47 feet; thence N 420 08' 25" E, 25.0 feet; thence N 47° 30' 35" W, 37.47 feet to the Northwesterly Line of said Inlot; thence S 42° 08' 25" W, along said Northwesterly Line, 25.0 feet to the point of beginning. Ask ® together with. 6e right of ingress and egress over lands of Grantor(s) for the purpose of maintaining, repairing, renewing, or servicing said lines and facilities under, on or over said premises and for doing anything necessary for the enjoyment of the easement herein granted. The Installation of such facilities shall be in accordance with Grantee's Rules and Regulations approved by the Public Service Commission of the State of Missouri. Except as provided therein, the installation, maintenance, replacement, removal and repair of the electric facilities will be at Grantee's expense, together with the obligation to return the surface to grade level. Grantor(s) and Grantee agree that all lines, cables, appliances, and equipment appurtenant thereto within the above-described premises shall remain the property of Grantee, and shall be removable at the option of Grantee. Covenants as fo.ilows: Grantee, shall be responsible for the restoration of all disturbed areas. This grant shall be binding upon the parties hereto, their executors, adminis- trators, heirs, successors, and assigns; and it is understood that this grant cannot be changed in any way except in writing, signed by Grantor(s) and a duly authorized agent of Grantee. �j,It�T WITNESS WHERE F.
