BE IT ORDAINED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. The Mayor and Clerk are hereby authorized to execute an amendment to an agreement with the Missouri Highway and Transportation Commission concerning improvement of a portion of South Country Club Drive. The amendment shall be substantially the same in form and content as the agreement attached hereto as Exhibit 1. Section 2. The Director of the Department of Public Works is hereby authorized to execute a change order in connection with the contract with Willard Stockman Construction Co. , Inc. for the improvement of a portion of South Country Club Drive, as provided in the amendment described in Section 1. Section 3 . There is hereby appropriated out of the Unappropriated General Fund Balance the amount of $24, 216.50, and the appropriations are increased for the General Fund - Public Works - Capital Improvements, Account No. 10-43-403 by the amount of $24 , 216.50. Section 4 . This Ordinance shall be in full force and effect from and after its passage and approval. Passed /�" Approved residing Of cer ayor ` ATTEST: i i City Clerk City of Jefferson City South Country Club Drive City Improvement Project State Job No. 5-U-50-50 AMENDMENT TO THE URBAN AGREEMENT FOR JOB NO. 5-U-50-50 This agreement, made and entered into by and between the MISSOURI HIGHWAY AND TRANSPORTATION COMMISSION, hereinafter called "Commission", and the CITY OF JEFFERSON, a municipal corporation in the State of Missouri, hereinafter called "City", WITNESSETH: The parties have heretofore made and entered into an Urban Agreement covering a public improvement designated as Route 50, Cole County, Job No. 5-U-50-50. Said agreement, dated April 6, 1979, provided for improvements which included the relocation of a portion of South Country Club Drive extending south from Route 50 to Station 2+50, a distance of 6.512 mile. The City has now let a contract for a project for the improvement of South Country Club Drive from Station 2+50 to Station 27+00 according to plans and specifications on file in the Department of Public Works Office, Jefferson City, Missouri. In order to avoid the double disruption of traffic at Station 2+50, the common point of both improvements, the Commission and the City deem it to be in the public interest to include by construction change order, a •portion of Job No. 5-U-50-50 in the City's contract for the project to improve South Country Club Drive from Station 2+50 to Station 27+00. In consideration of the foregoing and the mutual covenants and promises contained herein to be faithfully kept and performed by the parties hereto and each of them, it is agreed as follows: 1. The City shall include in a construction .change order to the contract for its I proposed improvement the construction of that portion of Job No. 5-U-50-50, lying between Station 53+85 and Station 2+50 as shown on attached sketch marked "Exhibit A" and made a part of this + agreement. 'The length of the improvement to be included in the change order is 265.44 feet. The improvement to be constructed under this agreement shall be in accordance with plan, sheets and estimates of quantities on file in the offices of the Commission and the City. The Commission shall reimburse the City for the actual cost of the work performed based on unit bid prices shown on "Exhibit B" and made a part of this agreement. 2. Effective upon completion of the improvement covered by this agreement, City shall keep, control, operate, and maintain same as part of City Street System at no cost or expense to the Commission. Ak 3 . Except as- altered, amended, or supplemented hereby, the Urban Agreement for Job No. 5-U-50-50 shall be and remain in full force and effect. - 2 - In Witness Whereof, the parties hereto have caused this agreement to be executed ® by their respective proper officials and the City executes same pursuant to Ordinance No. /0007 of said City, approved on the day of -46'L Executed by City the day ofl�i�-y 1983.
